Notice of Irrigation well Approval for Homeowners in The Preserve on the Bay, Delwood Point and Magnolia Point

I, ______, request installation of an irrigation well and agree to the following conditions:

  1. The well is used for irrigation purposes only. (not drinking water)
  1. The surface equipment (pump housing, pressure tank, or any associated equipment.) shall not be visible from the street or adjacent property. If positioned outside of an enclosed backyard the equipment shall have an equipment enclosure the same type of construction as the home or concealed by the side of the home behind plantings.
  1. The irrigation system shall be designed to prevent well water from contacting any structural improvement e.g. buildings, walls, walks, fences, driveways, and streets as well as any such improvements on adjacent property. All irrigation near such improvements should remain on city water.
  1. The Association strongly suggests the use of an iron removal system on any well. (Well water should be tested at the outset to determine iron content.)
  1. If staining of structural improvements does occur, the homeowner will immediately cease use of the well and any stain must be removed within 30 days of written notice. (This includes any staining of improvements on neighboring property or streets.)
  1. The Preserve Improvement Association reserves the right to make any necessary repairs at the owner’s expense in cases of non-compliance. The Association strongly suggests the use of a rust rid system on any well. (Well water should be tested at the outset to determine iron content.)

If repairs are not made within 30 days which return the structure to its original quality, the Association retains the right to have the repair made and billed to the owner. Refusal to pay such bills may result in a lien or legal redress.
