On the 91 day of April, 2012 at 9 0 A.M. 0 P.M. (Specifically include facts constituting cause for arrest).

NARRATIVE: On 7/29/11, Detective Ramos of the Boynton Beach Police Department interviewed a Confidential Informant (CI) at the Palm Beach State Attorney's Office. The Cl advised approximately four weeks prior to the interview he responded to a Craigslist personal ad under "MW4M" (male and female looking for male.) The Cl advised the ad included language about "porn". In replying to the ad, the Cl began communicating with a male subject known only as "Stu." Stu advised in an email communication that his girlfriend liked to have sex while asleep. The Cl stated he did not believe someone could have sex asleep, but that he would play along. Upon his arrival to the residence, the Cl was led inside by Stu. Stu immediately asked the Cl if he wanted to see porn and proceeded to show the Cl pornography on a laptop computer. The Cl was then shown pornographic images of two white females, whom he advised were possibly minors. Stu advised the Cl that the two females were

16 or 17 years old, and of his girlfriend's daughter and her friend. The Cl said some of the images appeared to be screen shots of videos. Stu told the Cl that he had a hidden camera disguised as an air freshener in his bathroom and took videos of his girlfriend's daughter while she occupied the bathroom. The Cl said both females appeared to be sleeping in some of the photos, and that Stu had told him he had put medicine in their ice cream and waited till they fell asleep to take photos of them. The Cl described pictures of one of the females as of her lying on a bed with her shirt pulled up exposing her breasts, another of a male's hand holding her vagina open, and a close up of her nipple. After viewing the pornography, the Cl then engaged in sexual activity with an adult female who he assumed was Stu's girlfriend.

On 3/25/12, a search warrant was obtained for Stuart Miller's residence. In questioning Miller as to his claim of drugging his step-daughter and her friend with ice cream mixed with medication, he stated he was merely "bullshitting" in saying that, and denied the allegation. In asking Miller why there was a bottle of medication located directly behind the ice cream in the freezer, he stated the medication is prescribed to him to help him sleep and that he keeps it in the freezer to preserve it.

On 3/26/12, I was contacted by PBSO to advise Stuart Miller had left his wife a suicide note in which he wrote he was ending his life based on what he had done. It was determine Miller had barricaded himself in a motel room in North Palm Beach to end his life. On 3.27.12, an arrest warrant was obtained for Stewart Miller for 2 counts of sexual battery on a mentally defective person (PBSO Case

#12-250033). Entry was then gained into Miller's room and he was found by the door on his knees attempting to stick a knife into an electrical socket. Miller was immediately transported to St. Mary's Hospital, where he underwent emergency surgery for the self inflicted cut to his throat.

On 3/28/12, this detective conducted a second interview with Stuart Miller. Miller was asked about 41 photographs found on his computer which included a white male and female lying in a bed together who appeared to be sleeping and/or unconscious. In the series of photographs taken the female's breasts, vagina and anus are exposed in order to take pictures. Miller identified the male as his son (Victim #2) and his son's girlfriend (Victim #1). While Miller admitted to taking pictures while the two were sleeping, he refused to answer questions in regards to his serving the victims ice cream mixed with medication.

On 3/31/12, in a statement taken from Victim #2, he advised in late June, 2010, he came to visit Miller with his girlfriend and a friend. In arriving to Miller's condo on a Friday evening, Miller offered the 3 guests ice cream, which they all accepted and consumed. Victim #2 advised the ice cream was set out in 3 bowls and placed on the kitchen counter. The ice creamed appeared odd to Victim #2 as it looked stirred, not scooped. Victim #2 became suspicious, stating "I looked at it and thought what the fuck?" "We ate it and then Victim #1 started acting weird." Victim #2 advised he did not say anything to Victim #1 or his friend about the appearance of the ice cream and tried to put it out of his mind. Victim # 2 further explained approximately 45 minutes after consuming the ice cream Victim #1 began acting like an "idiot", which was very out of character for her. "She was a mess. She was stumbling." Being irritated by her actions, Victim #2 put Victim #1 to bed in her clothing, then joined her thereafter. The following morning, in questioning Victim #1 on her behavior, she did not recall how she had acted or how she got to bed. In then showing Victim #2 several photographs obtained from Miller's computer, Victim #2 identified himself and his girlfriend in the photographs. The photographs include both of them lying on a bed in which they appear asleep or unconscious. After viewing the pictures Victim #2 was certain he and Victim #1 had both been drugged and touched against their will. Victim

#2 stated, "My father has a history of being a bad person." Victim #2 then went on to speak about Miller's extensive criminal history to include a 4 year prison sentence for a drug charge, being the suspect of a sexual battery; having engaged in 12 affairs during his first marriage, etc. Victim #2 stated "I suspected one year ago that when we were there that my dad drugged our ice cream."

On 3/31/12, in a taped statement taken from Victim #1, she advised in late June, 2010, she came to visit Miller with her boyfriend and a friend. In arriving on a Friday evening, Victim 1 was introduced to Stuart Miller and his wife. Miller then offered the 3 guests ice cream, which they all accepted and consumed. Victim #1 recalled taking a bowl of chocolate ice cream off the counter and eating it, but does not recall the ice cream's texture or appearance. Victim #1 advised the next thing she remembered was waking up the next morning in bed with Victim #2, still dressed in her clothing. Victim #1 did not recall when or how she got to bed, and in asking Victim #2 what had happened, he advised her he had put her to bed as she had become inappropriate and erratic in her behavior.
