Several disciplinary hearings have been held in the Naledi Local Municipality against employees, including some Section 57 managers.

For the years 2008/2009 and 2009/2010, supply the following information per year as below:

  1. Full list of all disciplinary hearings held;
  2. Against whom was the hearing held, including post level;
  3. What was the accusation;
  4. What was the result of each hearing;
  1. What action was taken against the person as a result of the hearing, if found guilty;
  1. List per hearing, if own personnel, legal or otherwise conducted the hearing and or investigated the circumstances, and
  2. If own personnel were not utilized, who was, and at what cost.
  3. Finally, what was the ORIGINAL budget for legal service?

  1. Kindly indicate if the Department compiled Quarterly

Financial Reports for the expenditure of NW Departments for the following quarters:

  1. 3rd Quarter 2008 – 2009
  2. 4th Quarter 2008 – 2009
  3. 1st Quarter 2009 – 2010
  4. 2nd Quarter 2009 – 2010
  5. 3rd Quarter 2009 – 2010
  6. 4th Quarter 2009 – 2010

provided to members of the North West Provincial

Dismissal of MEC Bothman

  1. With regard to the statement made by the SACP, please confirm whether the MEC was informed by the Premiers’ office to hand in the credit card before or on September 30, 2010.
  1. Kindly indicate what other benefits the MEC has to forfeit, what the value of the benefits are, and when she has to forfeit them. (Actual dates).

QUESTION POSE BY HON. FRANZSEN TO THE MEMBER OF EXECUTIVE COUNCIL RESPONSIBLE FOR TRANSPORT, ROADS AND PUBLIC WORKS [20100914-W38]

Background;

I have received concerns from operators transporting abnormal loads through the North West Province. Some of them are situated in other Provinces, but need to apply for permits in the North West Province as they transverse the Province.

At times the time required to transport an abnormal load and the acquisition of the permit is very limited, and taking into account that due to public holidays, school closing and opening days and other considerations, the number of days available to transport abnormal loads is limited in any year.

Problems mentioned are that when telephone queries are attempted, the caller receives no answer from the respective office, the permit is not issued and he most likely “losses” the contract.

Thus;

  1. Where in the North West Province does a contractor apply for a permit for an abnormal load,
  1. How long does it take to issue such a permit if all requirements are supplied / met,
  1. What are the normal working hours of this office
  1. What are the various means available for a contractor to apply for an abnormal permit,
  1. Is consideration given to issuing permits outside the normal working hours,
  1. If so, provide detail,
  1. Does the North West Province require the “original” permit issued by other Provinces and the North West Province to be available with the load,
  1. If so, how would a transport contractor from say Limpopo provide the driver of an abnormal load from Sishen, within say 24 hrs,
  1. If a contractor experiences problems with the issuing of a permit, is there any recourse, call centre or other means to present his problem?

(1)Whether each hospital in the North West Province has a health care risk waste (HCRW) service provider contracted; if not, (a) why not and (b) how is such hospitals’ HCRW disposed of; if so, (i) what are their names in each case, (ii) when was each contract awarded, (iii) what is the value of each contract and (iv) when will each contract end;

(2)Whether the department of health determines the capacity of individual HCRW service providers to deliver on the terms of the contract before such a contract is awarded; if not, why not; if so, what are the relevant details;

(3)Whether there are any penalty clauses stipulated in the contract for failure to dispose of HCRW in accordance with the law; if not, why not; if so, what are the relevant details;

(4)What was the amount of HCRW generated by each hospital in the NW province in the 2008-09 financial year?

With reference to the rental agreement between the Hartebeespoort SAPD and Municipality of Madibeng, (attached for your perusal)(attachments were sent to the MEC)please indicate the following:-

  1. When was permission sought to lease premises from the Municipality of Madibeng?
  2. When was this permission granted?
  3. When will the legalities of the lease agreement be finalised.
  1. Who is ultimately responsible for the Notarial Registration of the Lease Agreement?
  1. When will the SAPD finally be able to occupy the said offices.

What arrangements have been put in place to accommodate the SAPS at Hartebeespoort during the protracted period required to conclude the lease agreement?

  2. Who are these administrators in respect of each tribal council,
  3. Are there any tribal councils that have requested or need the services of an administrator, which are they?
