Decision No. 03/2005/QD-BBCVT of January 17, 2005, approving the Plan on frequency bands for Vietnam’s IMT-2000 mobile communication system through 2015 in the frequency range 1900-2200 MHz

THE MINISTER OF POST AND TELEMATICS

Pursuant to the May 25, 2002 Ordinance of Post and Telecommunications;

Pursuant to the Government’s Decree No. 90/2002/ND-CP of November 11, 2002, defining functions, tasks, powers and organizational structure of the Ministry of Post and Telematics;

Pursuant to the Government’s Decree No. 24/2004/ND-CP of January 14, 2004, detailing a number of articles of the Ordinance on Post and Telecommunications regarding radio frequencies;

Pursuant to the Government’s Decision No. 85/1998/QD-TTg of April 16, 1998, approving the Plan on Vietnam’s radio frequency spectrum for services;

At the proposal of the director of the Radio Frequency Directorate,

DECIDES:

Article 1: To approve the Plan on frequency bands for Vietnam’s IMT-2000 mobile communication system through 2015 in the frequency range 1900-2200 MHz with the following principal contents:

1. Scope of regulation

The Plan on frequency bands for Vietnam’s IMT-2000 mobile communication system through 2015 in the frequency range 1900-2200 MHz is applicable to implementing the 3rd generation mobile communication system under IMT-2000 standards of the International Telecommunication Union (ITU) in Vietnam.

2. Contents of the Plan

2.1. Use of the frequency bands 1900-1980 MHz, 2010-2025 MH and 2110-2170 MHz may be licensed to implement IMT-2000 in Vietnam. Specifically:

2.1.1. The frequency bands 1900-1920 MHz and 2010-2025 MHz are reserved for radio interfaces using Time Division Duplex (TDD).

2.1.2. The frequency band 1920-1980 MHz is reserved for the uplink and the frequency band 2110-2170 MHz is reserved for the downlink for radio interfaces using Frequency Division Duplex (FDD).

2.2. The frequency bands 1900-1980 MHz and 2110-2170 MHz are allocated for operator of public IMT-2000 as follows:

2.2.1. The frequency bands 1920-1980 MHz and 2110-2170 MHz are allocated for each operator with the minimum bandwidth of 2x15 MHz (15 MHz for the uplink and 15 MHz for the downlink).

2.2.2. The frequency band 1900-1920 MHz is allocated for each operator with the minimum bandwidth of 5 MHz.

2.3. The frequency band 2010-2025 MHz is used for private telecommunications IMT-2000 networks or other applications using IMT-2000. The minimum bandwidth for each network is 5 MHz.

3. Protective frequency bands

The radio frequency spectrum block allocated for each operator of a public or private IMT-2000 network also covers protective frequency bands. The Ministry of Post and Telematics shall prescribe specific protective frequency bands upon licensing.

4. Organization of implementation

4.1. To prepare for implementing IMT-2000 networks, no other radio equipments shall be used in frequency bands reserved for IMT-2000 under this Plan.

4.2. The Ministry of Post and Telematics shall promulgate regulations on licensing IMT-2000. The Radio Frequency Directorate shall guide the implementation of this Plan according to the Ministry of Post and Telematics’s regulations on licensing IMT-2000.

Article 2. This Decision takes effect 15 days after its publication in Cong Bao.

Article 3. The chief of the Office, the director of the Radio Frequency Directorate, the heads of agencies and units under the Ministry of Post and Telematics and telecommunications organizations and enterprises shall implement this Decision.
