SECTION II - CONTRACT DOCUMENTS

2.1The CONTRACTDOCUMENTS consist of this CONTRACT, Drawings, Specifications, Addenda issued prior to execution of this CONTRACT, other documents listed in this CONTRACT and Modifications issued after execution of this CONTRACT. These form the CONTRACT, and are as fully a part of the CONTRACT as if attached to this CONTRACT or repeated herein.

2.2The CONTRACTDOCUMENTS are outlined in SECTION IX.

SECTION III - PROJECT DESCRIPTION

3.1The CONTRACTOR will perform the WORK described below for ______(owner’s name) on Unit _____, Building _____, Four Hooppole South Condominium (FHSC), Boy Scout Road, Oakland, Maryland 21550. The WORK consists of but is not limited to demolishing existing sheds and a wood deck and the construction of a new 160 SF wood deck per the Construction Drawings at Enclosure Two.

3.2OPTION ONE( ). (Place an X in the parentheses if you want this option). The CONTRACTOR will construct a new patio shed per the Construction Drawings at Enclosure Two. Under deck aluminum drain pans are the preferred method of waterproofing the storage shed roof. This method is shown in the Construction Drawings. There are other methods which may be used for this purpose but the CONTRACTOR shall obtain approval from the Condo Maintenance Manager before deviating from the preferred method.

SECTION V - INSURANCE

5.1Before commencing the WORK the CONTRACTOR will provide the OWNER(S) with certificates of insurance for contractor’s liability and workman’s compensation.

5.2Should the CONTRACTOR employ any subcontractors he will obtain their proofs of insurance per paragraph 5.1 above and provide same to the OWNER(S) before the subcontractor(s) begin work on the site.

SECTION VI - RESPONSIBILITY FOR REPAIRS/SIDING REPLACEMENT

6.1The OWNER is responsible for the cost of replacing the siding on the lakeside wall of the unit, and such work is not part of this CONTRACT.

6.2The Condominium Association is responsible for repairs to existing siding and the structure underneath on the lakeside wall of the unit. Should the CONTRACTOR in the course of prepping the condo for the new wood deck ledger board find severe mold, insect infestation, and/or rot in the lakeside wall of the condo unit, he must immediately notify the Condo Maintenance Manager, Richard Rohrbaugh (301-387-6551 or 301-387-6291).

6.3The Condominium Association is also responsible for repairs to existing siding and the structure underneath of the “party walls” separating decks.

SECTION VII - CONTRACT AMOUNT

7.1The OWNER shall pay the CONTRACTOR for the CONTRACTOR’S execution of the work the CONTRACT SUM of $______( Dollars) subject to additions and deductions as outlined in the CONTRACT DOCUMENTS.

SECTION VIII - PAYMENT SCHEDULE

8.1Actual payment of the CONTRACT SUM shall be made by selecting one of the three options provided below by placing an X in the parentheses for the option of your choice.

8.1.1OPTION ONE ( ). Make two draw payments as delineated below:

8.1.1.1First Draw - Existing deck demolished, all debris removed from the site to the landfill and a Request for Payment form for one-third of the CONTRACT SUM.

8.1.1.2Second Draw - Project complete which includes final cleanup per the Project Specifications, turning over the completed Release of Liens form to the OWNER(S), turning over to the OWNER(S) the Building Permit reflecting that the county’s final inspection has been passed and the draw approved by the Condo Maintenance Manager by his signature on the Request for Payment form for the final two-thirds of the CONTRACT SUM.

8.1.2OPTION TWO ( ). Make two draw payments as delineated below:

8.1.2.1First Draw - Upon execution of this CONTRACT and a completed Request for Payment form pay the CONTRACTOR one-third of the CONTRACT SUM.

8.1.2.2Second Draw - Project complete which includes final cleanup per the Project Specifications, turning over the completed Release of Liens form to the OWNER(S), turning over to the OWNER(S) the Building Permit reflecting that the county’s final inspection has been passed and the draw approved by the Condo Maintenance Manager by his signature on the Request for Payment form for the final two-thirds of the CONTRACT SUM.

8.1.3OPTION THREE ( ). Make three draw payments as delineated below:

8.1.3.1First Draw - Upon execution of this CONTRACT and a completed Request for Payment form pay the CONTRACTOR one-third of the CONTRACT SUM.

8.1.3.3Third Draw - Project complete which includes final cleanup per the Project Specifications, turning over the completed Release of Liens form to the OWNER(S), turning over to the OWNER(S) the Building Permit reflecting that the county’s final inspection has been passed and the draw approved by the Condo Maintenance Manager by his signature on the Request for Payment form for the final one-third of the CONTRACT SUM.

8.1.4Requests for payment shall be made in accordance with the Construction Specifications at Enclosure One on the forms provided.

8.1.5A payment due the CONTRACTOR as per the CONTRACT but unpaid by the OWNER(S) shall bear interest at one (1) percent per month simple interest.

SECTION IX - CONTRACT DOCUMENTS

9.1Except for any modifications issued subsequent to this CONTRACT, the CONTRACT DOCUMENTS are outlined as follows:

9.1.1This CONTRACT between the OWNER and CONTRACTOR.

9.1.3The Specifications dated 22 October 2009 at Enclosure One.

9.1.4The Construction Drawings, dated 5 October 2009 at Enclosure Two.

SECTION X - GOVERNANCE

10.1In the event of a conflict between this CONTRACT and any of the CONTRACT DOCUMENTS, the provisions of this CONTRACT shall govern.

SECTION XI - CONTRACT APPROVALS

11.1CONTRACTOR: The undersigned, who is duly authorized to sign and commit to the terms of this CONTRACT, agrees that the specifications, construction drawings, price, work schedule and method of payment satisfactory and acceptable.
