The (political subdivision), by and through its (authorized signatory), has determined it is in the best interests of the taxpayers and the (political subdivision) to expedite the certification of tax ratesby the Department of Local Government Finance (“Department”) in order that the 2008-pay-2009 property tax bills may be issuedin a more timely manner. The (politicalsubdivision), has, therefore, voluntarily elected to waive all but the first day of theten(10) day response period to which it is entitled pursuant to IC 6-1.1-17-16(d) with respect to a change in the budget, tax rate, or tax levy by the Department.

VOLUNTARY WAIVER

  1. The undersigned hereby certify(ies) that we/I have the legal authority to act on behalf of (political subdivision) in this matter.
  1. (Political subdivision)acknowledges that, pursuant to IC 6-1.1-17-16(d),it has ten (10) days from the date (political subdivision) receives notice of any revision, reduction, or increase the Department proposes in (political subdivision)’s tax levy or tax rate to provide a written response to the Department. The response may include budget reductions, reallocation of levies, a revision in the amount of miscellaneous revenues, and further review of any other item about which, in the view of (political subdivision), the Department is in error. The Department is required to consider the adjustments as specified in (political subdivision)’s response if the response is provided as required by IC 6-1.1-17-16(d). The Department is required to deliver a final decision to (political subdivision).
  1. (Political subdivision) desires to, and hereby does, knowingly and voluntarily WAIVE, all but the first day of the ten(10) day periodreferenced in IC 6-1.1-17-16(d), also know as the “1782 period,”with respect to its response to a change in the budget, tax rate, or tax levy by the Departmentwith respect to the 2009 budget. (Political subdivision) recognizes that one (1) dayis sufficient for its review.
