JOINT RESOLUTION # 3

JOINT RESOLUTION OF THE BEN HILL COUNTY BOARD OF COMMISSIONERS AND THE CITY COUNCIL OF THE CITY OF FITZGERALD AGREEING THAT THE DEPARTMENT OF LIESURE SERVICES SHOULD PROCEED WITH ARCHITECTURAL DESIGN AND COST ESTIMATING FOR CONSTRUCTION OF A MULTI-USE RECREATIONAL FACILITY, OFFICES, GYMNASIUM AND/OR SWIMMING POOL FOR RECREATIONAL USES.

Whereas,Ben Hill County and the City of Fitzgerald adopted resolutions approving and authorizing execution of an Intergovernmental Agreement concerning a county 1 percent (1%) special purpose local option sales and use tax to be enacted pursuant to O.C.G.A par 48-8-110 et.Seq.; and

Whereas, said Intergovernmental Agreement was executed the 10th day of May 2010, providing for a referendum to be held, and, if approved, collections to be made for a period of six-years; and

Whereas, said intergovernmental agreement identified a portion of the proceeds of the special purpose local option sales and use tax, if authorized, be used to provide funds to finance the cost of acquiring, constructing, installing and equipping certain capital outlay projects for the construction of a multi-use recreational facility, offices, gymnasium and/or swimming pool for recreational use to be operated by the Department of Leisure Services, to be jointly owned and operated by the County and City; and

Whereas, a Special Election was held on the 20th Day of July 2010 for the qualified voters of Ben Hill County to determine whether an additional sales and use tax of 1 percent (1%) should be imposed on all sales and use in Ben Hill County for a period of 6-years, commencing on the 1ST day of July 2011; and

Whereas, the voters approved the special purpose local option sales and use tax.

NOW, THEREFORE, BE IT RESOLVED BY THE BEN HILL COUNTY BOARD OF COMMISSIONERS AND THE FITZGERALD CITY COUNCIL THAT THE DEPARTMENT OF LEISURE SERVICES SHOULD PROCEED WITH THE ARCHITECTURAL DESIGN AND COST ESTIMATING FOR THE MULTI-USE RECREATIONAL FACILITY, OFFICES, GYMNASIUM AND/OR SWIMMING POOL FOR RECREATIONAL PURPOSES.
