1. / SUBJECT: / FORMATION OF THE RED TAPE REDUCTION TASK FORCE (DISTRICTS: ALL)OVERVIEW:
Over the past several years, the County’s Department of Planning and Land Use (DPLU) has been undergoing business process reengineering. While the Department has made great strides, we believe that more can be done with the help of an independent task force. This Board Letter authorizes the establishment of a task force of land use experts to focus special attention on the business side of operations at DPLU.

CHAIRMAN HORN AND VICE CHAIRMAN ROBERTS
1. In accordance with Board Policy A-74, Citizen Participation in County Boards, Commissions and Committees, direct the Chief Administrative Officer (CAO) to return to the Board within 30 days with a resolution establishing the Red Tape Reduction Task Force.
2. Direct the CAO to assess the County costs of supporting the task force, identify a funding source and return with a recommendation in 30 days.

ON MOTION of Supervisor Horn, seconded by Supervisor Roberts, the Board took action as recommended, directing the Chief Administrative Officer to consider the Supervisors comments in developing the recommendations.

2. / SUBJECT: / EXPLORING OPTIONS FOR UPDATING EQUINE REGULATIONS (DISTRICTS: ALL)
OVERVIEW:
Equestrian facilities and activities have long been a significant component of our backcountry’s culture. Recently, the equine community has approached the County of San Diego expressing frustration over costly and burdensome regulations in our zoning ordinance for equine operations.
Our existing equine regulations appear to be out-of-date for the unincorporated areas of the County. It is important that the County of San Diego makes certain that the equine industry continues to have a vital role in our rural communities and operates under regulations that are appropriate and fair.
Today’s board letter directs staff to work with the equine community and any other interested parties to investigate options that would protect and promote equestrian operations while ensuring that we have reasonable permit fees and regulations.

There is no fiscal impact associated with this action.

Direct the Chief Administrative Officer (CAO) to work with the equine community and any other interested parties to investigate options that would protect and promote equine operations throughout the unincorporated areas of San Diego County, including the potential development of a tiered equine ordinance, assessing the costly and burdensome equine regulations and exploring any other appropriate changes, and report back to the board within 120 days.

3. / SUBJECT: / PRESENTATION BY THE SAN DIEGO REGIONAL AIRPORT AUTHORITY ON THE REGIONAL AVIATION STRATEGIC PLAN (DISTRICTS: ALL)
OVERVIEW:
In 2007, Senator Christine Kehoe introduced Senate Bill 10 which mandates that the San Diego County Regional Airport Authority (Airport Authority), in collaboration with the San Diego Association of Governments (SANDAG), prepare a Regional Aviation Strategic Plan (RASP) to evaluate ways to optimize the public use airports in the region.
The primary objectives of the RASP are to: 1) Define the region’s long-range air transportation needs and the roles of each airport in meeting those needs, 2) Determine opportunities and constraints with respect to accommodating future demand, and 3) Develop strategies to maximize the efficiency and effectiveness of existing and planned facilities to meet the demand for air service in the San Diego County Airport System.
As mandated by SB 10, the RASP must be completed by June 30, 2011. The RASP will also be incorporated into SANDAG’s next update of the Regional Transportation Plan (RTP) currently under consideration. Today, the Board is asked to receive a presentation and provide feedback to Airport Authority staff for consideration as they finalize their Regional Aviation Strategic Plan.

There is no fiscal impact to the County General Fund .

1. Receive a presentation on the Regional Aviation Strategic Plan by the San Diego Regional Airport Authority.
2. Direct the Chief Administrative Officer to draft a letter for the Chairman’s signature that will provide Airport Authority staff the County’s position on any impacts to County airports as a result of the Regional Aviation Strategic Plan .

4. / SUBJECT: / ANNUAL REPORT OF THE COUNTY MAINTAINED ROAD SYSTEM (DISTRICTS: ALL)
OVERVIEW:
Section 2121 of the California Streets and Highways Code requires the County to submit to the California Department of Transportation (Caltrans) any additions to, or exclusions from, its mileage of maintained County roads. The most recent update was approved by your Board on March 24, 2010 (10), and certified by Caltrans thereafter.
Total mileage of County maintained roads has increased by 1.35 miles since the last certification and is now 1,932.05 miles. The recommended action to adopt the resolution will allow Caltrans to certify the new reported road mileage to the State Controller.
FISCAL IMPACT:
Recommended action has no cost in current or subsequent years, and will require no additional staff years. Maintenance costs for County roads are funded using Gas Tax revenues.

1. Find that the proposed action is exempt from the California Environmental Quality Act (CEQA) as specified under Section 15061(b)(3) of the State CEQA Guidelines.
2. Adopt a resolution entitled Resolution of the County of San Diego Board of Supervisors Transmitting the Annual Report to the State Department of Transportation of the County’s Maintained Roads – 2011.

5. / SUBJECT: / ACCEPTANCE OF A DONATION OF TWO CABINS TO THE DEPARTMENT OF PARKS AND RECREATION TO BE INSTALLED AT DOS PICOS REGIONAL PARK (DISTRICT: 2)
OVERVIEW:
Dos Picos Regional Park is located in the unincorporated community of Ramona (2009 Thomas Guide page 1171, H5). The park offers camping, picnicking, hiking, fishing, biking, accommodations for weddings or other large group events and places for visitors to enjoy nature. Sheltered by steep, boulder-strewn mountain slopes, this park is designed to highlight the ancient oak groves that make stays at the park memorable.
Cabins by the Lake, Inc., a nonprofit organization, proposes to donate two cabins to the Department of Parks and Recreation for use at Dos Picos Regional Park. The cabins are designed to accommodate people with disabilities. The Department of Parks and Recreation has determined that Dos Picos Regional Park is an ideal site for the cabins. The total value of the donation, including the cabins, delivery and installation, is estimated at $91,000.
This request is to accept a donation of two cabins to the Department of Parks and Recreation. If approved, the cabins are expected to be installed in Spring 2011.
FISCAL IMPACT:
The proposed action will authorize the Director of the Department of Parks and Recreation (DPR) to accept a donation of two cabins, valued at $91,000, from Cabins by the Lake, Inc. These disabled friendly cabins will be installed at Dos Picos Regional Park. Upon installation, the cabins will be available to the public for rental for overnight stays. Annual operations and maintenance of the cabins will be provided by existing DPR staff. No new staff years and no additional costs to the General Fund will result from this action.

3. Find that this project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines, Section 15303.
4. Pursuant to Administrative Code Section 66 and Board Policy A-112, accept a donation of two cabins (including delivery and installation) to be located at Dos Picos Regional Park valued at $91,000 from Cabins by the Lake, Inc., to the Department of Parks and Recreation.
5. Authorize the Chairman of the Board of Supervisors to sign a letter of appreciation to Cabins by the Lake, Inc. for the donation.

6. / SUBJECT: / GILLESPIE FIELD INDUSTRIAL PARK – NEW 42-YEAR, 10-MONTH INDUSTRIAL LEASE WITH THREE ARCH CAPITAL, INC. (DISTRICT: 2)
OVERVIEW:
The County of San Diego operates Gillespie Field (2008 Thomas Guide, Page 1251, E-2), a general aviation airport in El Cajon. The non-aviation portion of Gillespie Field includes three industrial parks occupied by diverse industrial tenants. The oldest of these parks, the Gillespie Field Industrial Park, was developed in the late 1970s.
On December 5, 1978 (33), the Board approved a 55-year industrial ground lease in Gillespie Field Industrial Park with Michael House. In 1980, the lessee completed construction of a one-story, 15,700 square-foot concrete tilt-up industrial building. After multiple transfers to other parties, the lease was most recently assigned to Three Arch Capital, Inc. in 2010, which acquired it from a lender.
Three Arch Capital, Inc. is planning to rehabilitate and enhance the building for business use, which will require a significant investment. After determining that the remaining term of 22 years and 10 months limited its opportunities to recoup the investment needed to improve the property to make it marketable, as well as its ability to finance those improvements, Three Arch Capital, Inc. approached the County and worked with staff to negotiate a new lease with 20 years of additional term. This is a request to approve a new 42-year, 10-month lease with Three Arch Capital, Inc.
FISCAL IMPACT:
If approved, this request will result in additional revenue of $57,654 in the Fiscal Year 2010-11 Airport Enterprise Fund spending plan. The funding source will be equity payments received under the terms of the new lease agreement. There will be no impact to the County General Fund and no additional staff years required.
BUSINESS IMPACT STATEMENT:
The purpose of Gillespie Field Industrial Park and its leases is to help provide employment in East County. Active leases and business investment help fulfill this purpose. The non-aviation portion of Gillespie Field includes three industrial parks occupied by diverse industrial tenants. The Gillespie Field Industrial Park (GFIP) is one of these industrial parks. This approximately 51-acre park contains 33 individual ground leases that house numerous light industrial businesses. A vibrant industrial park with buildings in good repair and active businesses enhances the sustainability of the airport system.

6. Find in accordance with Section 15301 of the California Environmental Quality Act (CEQA) Guidelines that proposed lease is categorically exempt from CEQA provisions as it involves continuation of an existing use.
7. Approve and authorize Clerk of the Board to execute, upon receipt, three copies of the Industrial Lease with Three Arch Capital, Inc. (4 VOTES)

7. / SUBJECT: / TECHNICAL ASSISTANCE AGREEMENT BETWEEN THE BORDER ENVIRONMENT COOPERATION COMMISSION (THE “BECC”) AND THE DEPARTMENT OF ENVIRONMENTAL HEALTH (DISTRICTS: ALL)
OVERVIEW:
Since September 11, 2001, the homeland security risk challenges posed by biological, chemical, and nuclear terrorism have added a new and difficult dimension to bi-national preparedness efforts. The United States Environmental Protection Agency considers the development of a San Diego/Tijuana Sister Cities Bi-national Prevention and Emergency Response Plan of critical importance. The Department of Environmental Health plays a vital role in the multiple aspects of the County’s emergency planning responsibilities and is the lead Department for bi-national prevention and emergency response because the Chief of the Department’s Hazardous Materials Division is the United States co-chair of the Border 2012 Emergency Preparedness and Response Task Force for the San Diego-Tijuana region.
