*When service is performed on your vessel, we will attach a green twist tie to the bow railing or general vicinity. If the service is not needed for the next scheduled week, do not remove the green twist tie and the service will not be performed. The Pump-Out operators will only check for the green twist tie if you are on the schedule for that week.
Pump-Out & Indemnity Agreement
THIS AGREEMENT is made effective the above date, and is by and among THE MOORINGS CONDOMINIUM ASSOCIATION, a Michigan non-profit corporation, herein referred to as “The Moorings”, and the undersigned co-owners(s) of vessel(s) in The Moorings, herein referred to as “Owner”.
RECITALS
On behalf of Owner, The Moorings is willing to provide pump-out services for the sanitation system on the boat identified on the registration form above. The Moorings agrees that the Services will be performed as requested by Owner in exchange for: Owner’s release and indemnification of the Moorings for any and all costs, claims, liabilities, damages, or other obligations arising out of performance of the Services.
NOW, THEREFORE, it is agreed by and among the parties as follows:
1. Indemnification of The Moorings. The Owner, their successors, assigns, and representatives, shall defend, indemnify and hold the Moorings harmless from and against reasonable attorney’s fees and costs, in connection with the loss or damage due to personal injury, death, or damage to property, arising in any manner out of the Services performed. The Moorings shall not be required to institute or defend any action involving any matters herein, or which affect it, or the duties or liabilities under this Agreement. Any costs incurred in any such action by The Moorings, including, but not limited to, reasonable attorneys’ fees, shall be borne by the Owner. The Indemnity contained in this paragraph shall include costs and expenses, including attorney’s fees, incurred by The Moorings in establishing or enforcing its right to indemnity.
2. Binding. This Agreement shall be binding upon and inure to the benefit of the parties and their respective legal representatives, successors and assigns. No party may assign any rights or duties under this Agreement without the prior written consent of the other party.
