Please find enclosed the transfer guidelines for the year 2007.
You are requested to take necessary action to effect transfers in respect of ACTOs and Ministerial staff duly following the guide lines scrupulously besides sending a copy of certificate to this office to that effect after completion of transfers.

GENERAL GUIDE LINES:
1 The relaxation of ban is valid only for the period from 1st May, 2007 to 31st May, 2007.
2 All the transfers have to be effected by the competent authorities as per the existing orders on delegation subject to the existing government orders and conditions prescribed herein. The competent authority shall submit the transfer proposals to the next higher authority where transfers are on administrative grounds, and will not approve the transfers unless absolutely necessary and after recording reasons for accepting the proposals.
3 The competent authority as defined shall complete the transfers on or before 31.5.2007. The Nodal Dy. Commissioner is made responsible for the implementation of the transfer orders. In any case, the employee would be deemed to be relieved at the end of 7 days of the receipt of the order. Relief arrangement to be made internally by controlling officers without waiting for substitutes.
The finalised list shall be placed on the internet website at 'commissioner '. On the same day they should also send a hard copy through speed post for the perusal of Commissioner (CT).
4 All transfers other than the transfers for administrative reasons shall be done by counseling up to the cadre of ACTOs. All the employees seeking transfer will be asked to give three preferences and will be accommodated accordingly as far as possible. When more than one employee opts for a particular place, the preference shall be given to the senior most employee subject to the employee not having charges pending against him.
5 The employees who are retiring before 01-05-2008 shall not be transferred. The standing instructions on the transfers of Office Bearers of recognized employees unions as issued in Circular Memo No.26135/Ser. Welfare/2002-1 of G.A. (Services) Department, dt.19.6.2002 shall be followed scrupulously.

6 No person shall be transferred before completion of two years and no person shall be retained beyond 5 years. However, not more than 20% of the employees in any cadre will be transferred. This is to ensure that there is no dislocation of work. Service in all cadres at a station will be counted while calculating period of stay. While effecting the transfers, the Competent authority shall give priority as given below.
a. Longest standing employee downwards.
b. Employee working in “hardship areas”.
c. Employees with outstanding record on request.
d. Husband and Wife cases (Only one of the spouses shall be shifted following the prescribed procedure).
e. Cases of compassionate appointment.
f. Medical grounds for the diseases (either self or spouse or dependant children) of Cancer, Heart Operations, Neurosurgery, Bone TB, Kidney transplantation to places where such facilities are available.
7 If the employees who have put in more than 2 years of service, constitute more than 20% of the total strength, the employees who have put in longer service at a particular station shall be transferred without exceeding the overall ceiling of 20%.
8 The transfers shall be effected from focal to non-focal, non-focal to non-focal or from non-focal to focal posts only. In no case, persons shall be transferred from one focal post to another focal post.
9 The provisions of G.O.Ms.No.610, G.A.(SPF-A) Dept, dt.30.12.1985 will be strictly adhered to and the ratios prescribed maintained.

10 Employees holding posts at the 2nd level gazetted and higher levels shall not be posted to the native districts subject to existing instructions on employees retiring shortly, if any.
11 Employees shall invariably be transferred from their existing location on promotion, unless no such posts exist at a different location.
12 All the transfers effected by following the procedure where employees indicated preference for stations shall be treated as request transfers for the purpose of sanction of T.T.A. and other transfer benefits.
13 The competent authority shall be personally responsible for compliance with the guidelines prescribed above and any deviation from the guidelines herein shall be viewed seriously. The Nodal Dy. Commissioner shall ensure that all the transfers are as per the existing government orders and are kept at barest minimum.
14 The transfer policy should be an effective tool in capacity building with departmental employees getting a variety of experience within the department, thus becoming more fit to hold higher responsibilities.
15 Transfers on compassionate and personal grounds have been misused from time to time. Once transfers are effected, the undersigned will verify the truthfulness of the grounds in a few test cases and report to the Government if necessary, to curb misuse.
16 No relaxation proposal will be entertained for a period of three months commencing from 1st June 2007. Thereafter, Secretaries will review department wise, quarterly, the number of relaxations given within their departments and submit the same to the Chief Secretary / Chief Minister for information.
17 G.Os rendered redundant by this order may be treated as superseded.

18 All transfers may be effected taking into reckoning performance indicators.
19 For reckoning the period of 2 years, 1-5-2007 may be taken as criteria. At the time of merger of ACTO/DCTO offices with the circle officers, the employees have also moved physically from one station to another station. In such cases, the period may be counted from the date of moving to the new station.
20 Transfer of incumbents continued as per specific court orders may be deferred.
21 Those in the intelligence wing in DCs office and Enforcement Wing cannot be treated as Non-focal and should be treated as focal posts.
22 Transfers of incumbents who have come to specific adverse notice may be made without applying the above norms but with prior permission of the Commissioner (CT) by recording the reasons in writing in the absence of any specific vigilance related reports vide which they would have come under adverse notice.
23 Instructions issued by the Government, Commissioner of Commercial Taxes or other Vigilance agencies to post in non-focal places those officials who are facing enquiries should be complied with.
24 Persons facing ACB enquiries and disciplinary cases should not be continued in focal posts and should be posted to non-focal posts.

SPECIFIC GUIDE LINES:
In addition to the above general guide lines, the following specific guidelines have to be followed while effecting transfers.

1) The DCs may obtain options from the A.Cs, CTOs by 18-5-2007, after duly indicating the options of stations/ places and submit proposals to this office, in a complete shape by 19-5-2007 through FAX.
2) A.Cs, CTOs and DCTOs who are within the zone of transfers are permitted to submit 3 options. However, Commissioner(CT) reserves the right not to consider one or any of the options, subject to exigencies of work and other administrative grounds.
3) In the options to be exercised preferences are to be given to a station but not in favour of a particular post,
4) The vacancy position of A.Cs, CTOs and DCTOs is enclosed at Annexure-A.
5) A.Cs, CTOs and DCTOs cadres are not proposed to be posted back to same stations where they had worked previously,
6) (a) The Committee comprising of the Deputy Commissioners of the zone will submit the proposals of the DCTOs as per the transfer guidelines to the office of the Commissioner of Commercial Taxes by 19-5-2007. This will be recommendory.
(b) The Committee has to furnish a certificate that all the guidelines are scrupulously followed without any deviations, while proposing transfers.
CERTAIN INSTRUCTIONS TO DEPUTY COMISIONERS
1) The DCs shall obtain the option forms and complete the transfer procedure by 31-05-2007.
2) The DCs are directed to effect transfers as per the guidelines issued scrupulously. Any deviations will be viewed seriously.
3) The DCs must further submit a certificate that all the guidelines have been scrupulously followed without any deviations after completing the transfers by 31.5.2007.
