WAIVER/RELEASE AGREEMENT

By clicking on "I Agree," you agree, warrant and covenant as follows:

1. The Rider acknowledges and understands the dangers of the bicycle event and KNOWINGLY AND FREELY ASSUMES ALL RISKSof his/her participation, known and unknown,including but not limited to potential collisions with pedestrians, vehicles, other riders, fixed or moving objects, animals, negligence of other riders, drivers and potential problems with road surfaces and road conditions, equipment failure, inadequate safety equipment and weather conditions, as well as the possibility of a health risks and injury including but not limited to stroke, heart attack, seizure, scrapes, bruises, broken bones, concussion, head injuries, or even fatal illness or injury and EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assumes full responsibility for his/her participation in all aspects of the Cycle for STEM events.

2. The Rider understands and acknowledges that the bike route requires bicycling on public roadways, highways, trails and may involve cycling in inclement weather. The Rider also understands and accepts that there are risks associated with transportation to and from certain locations by motor vehicle.

3. The Rider acknowledges that participation in this Cycle for STEM event requires physical conditioning and biking experience and certifies that he/she is in soundmedical/physical condition, and is fully capable of participating in the ride without risk to self or others. The Rider understands and agrees that it is his/her sole responsibility to consult with his/her personal physician prior to participating in the Cycle for STEM event to insure that such participation will not pose any unusual or unforeseen risks to his/her individual health and wellbeing.

4. The Rider accepts full and sole responsibility for the condition and maintenance of his/her bicycle, riding equipment and safety gear and all costs related thereto. The rider shall be solely responsible for and shall release the RELEASEES from any liability for any damage to, loss of or theft of property. Rider willing agrees to abide by all Cycle for STEM terms and conditions and rules for participation. The Rider acknowledges and understands that the law defines a bicycle as a vehicle and Rider agrees to abide by all traffic/trail laws, traffic signals, signs, rules and regulations.

5. Cycle for STEM requires an ANSI or SNELL approved bicycle helmet to be worn by all participants at all times while sitting on and/or operating a bicycle. The Rider agrees to wear an approved helmet at all required times.

6. Cycle for STEM agrees to provide notice of detailed information for all aspects of the ride and will provide water and snacks at rest stops and will provide assistance for necessary bike repairs.

7. In consideration of being permitted to participate in the Cycle for STEM event The Rider,for himself/herself and on behalf of his/her heirs, assigns, personal representatives and next of kin, HEREBY FOREVER WAIVES, RELEASES, DISCHARGES, INDEMNIFIES, AND HOLDS HARMLESSthe AFCEA EDUCATIONAL FOUNDATION and AFCEA INTERNATIONAL, their officers, directors, members, officials, agents and/or employees, other participants, sponsors, advertisers, and, if applicable, other providers engaged in conducting the event ("RELEASEES"), from any and all claims, demands, losses, and liability arising out of or related to any injury, disability or deaththat the Ridersustains or suffers, or any loss or damage to person or property during this Eventas well as during course inspection, observation, practice runs, and training rides and on/in course routes, roadways, trails, sidewalks, parking areas, restrooms and dressing facilities (including any damages to or loss or theft of property), WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES, OTHER RIDERS PARTICIPATING IN THE EVENT, OR OTHERWISE, to the fullest extent permitted by law..

8. In the event of a legal claim the parties agree to engage in good faith efforts to mediate any dispute that may arise. Any such agreement reached will be formalized by a written contractual agreement at that time. Should the issue not be resolved by mediation between the parties, the parties agree that all disputes, controversies or claims arising as a result as of the Cycle for STEM event shall be submitted to binding arbitration in accordance with the applicable rules of the American Arbitration Association. The cost of such arbitration shall be shared equally by the parties.

9. VENUE and JURISDICTION. This Waiver/Release Agreement shall be governed by the laws of the Commonwealth of Virginia without regard to choice of law rules. To the extent permissible under law, the parties acknowledge the jurisdiction of the courts of Virginia and consent to venue in Virginia for the adjudication of any disputes arising under this Waiver/Release Agreement.

10. If any of the provisions of this Waiver/Release Agreement are declared to be invalid by an arbitrator or a court, all other provisions shall remain in full force and effect.

11. This Waiver/Release Agreement incorporates entire understanding of the Rider and the AFCEA Educational Foundation/AFCEA International. No oral statement or prior written matter extrinsic to this Waiver/Release Agreement shall have any force or effect. The parties are not relying on any representations other than those expressly set herein.

I HAVE READ THIS WAIVER/RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
