CONTRACT

GOVERNMENTAL AGREEMENT

This Contract is made by and between DAVIDSON COUNTY, herein referred to as COUNTY, and the TOWN OF WALLBURG, herein referred to as TOWN.

TOWN has requested COUNTY to provide services and administration for TOWN.

Now therefore, COUNTY and TOWN agree as follows:

1.Tax Administration and Collection: TOWN agrees to pay COUNTY for tax administration and collection services as follows:

A.Five Dollars ($5.00) per bill for real and personal property tax bills.

B.1.5% of the amount collected for motor vehicle tax bills.

C.In the event the services continue after the termination of this Contract or prior to another written Contract, the amount of Five Dollars ($5.00) per bill for real and personal property taxes shall increase each subsequent year by an amount calculated and based on the Consumer Price Index.

2.Fire Protection: COUNTY and TOWN agree that fire protection and funding shall continue as provided immediately prior to incorporation of TOWN.

3.Planning and Zoning: TOWN by resolution adopted COUNTY’s planning, zoning and inspection regulations and authorized COUNTY to administer the planning, zoning and inspection regulations. COUNTY agrees to provide planning services to TOWN at a cost of Twelve Thousand Dollars ($12,000.00) per year beginning July 1, 2007. Such services shall include zoning, zoning enforcement and subdivision and site plan administration. Additional services such as mapping, area plans, flood plains administration, air quality, watershed, road naming, house numbering and road and easement closings are also included. Advertising, printing and legal services are not included. COUNTY shall retain all permit and administration fees collected. COUNTY shall provide services for public hearings at a cost of $20.00 per hour.

4.Law Enforcement: Law enforcement shall be provided by COUNTY as provided in unincorporated areas of COUNTYat a cost of Forty-Nine Thousand Eleven Dollars ($49,011.00) per year beginning July 1, 2007, payable in arrears on or before July 2, 2008.

5.Elections: TOWN agrees to reimburse COUNTY for the actual costs of all TOWN elections that are held by TOWN. TOWN agrees to reimburse COUNTY for a prorata share of the costs attributable to TOWN for TOWN elections held in conjunction with a general or county election.

6.User Fees for Inspections and Other Services: COUNTY agrees to provide inspection services to TOWN at a cost equal to the county fees collected. The services shall include building, fire, mechanical, plumbing, electrical, manufactured housing and modular units. Indirect services such as construction plan review, permit issuance, computer forms and files keeping, administration, disaster response, advertising, printing and legal services are also included.

7.Duration: The duration of this Contract is one year from July 1, 2007; however, the Contract shall continue in effect after one year unless terminated by written notice by COUNTY to TOWN or TOWN to COUNTY. COUNTY and TOWN shall have the right to terminate this Contract after one year from July 1, 2007, by giving to the other party written notice of the termination sixty (60) days prior to the termination date selected by the terminating party.

8.Personnel: COUNTY shall appoint all personnel necessary to the execution of the undertaking of this Contract. The jurisdiction, authority, rights, privileges and immunities (including coverage under the workers’ compensation laws) which the officers, agents and employees of COUNTY enjoy within the territory of COUNTY shall also be enjoyed by them outside the territory of COUNTY when they are acting pursuant to this agreement and within the scope of their authority or the course of their employment.

9.Method of Financing: TOWN shall finance the undertaking as set forth in this Contract with revenues from taxes.

10.Amendments: No modification, amendment or addition to this Contract shall be valid or enforceable unless in writing and signed on behalf of COUNTY and TOWN.

COUNTY and TOWN have caused this Contract to be duly executed.
