namely (i) 2 Nos. of ToyotaInnova / its equivalent, (ii) 1 No. of Xylo/Tavera or its equivalent and (iii) 1 No. of Etios/Fiesta/Dzire for30/31daysupto2,000kmsinamonth,onmonthlybasisatcostceilingofRs.40,000/-permonthforthethe vehicles for the vehicles mentioned at (i) & (ii) above and Rs. 35,000/- per month for the vehicle mentioned at (iii) above for the periodof1yearfromdateofexecutionofcontract/agreementforuseoftheOffice of the Commissioner of CentralExciseandServiceTax,Tiruchirappalli.Theperiodofcontract/agreementmaybefurtherconsideredforextensiononrequestofcontractoronthesametermsandconditionsbythecompetentauthority.

1. TenderProcessandsubmissionofTenderdocuments:-

(i)Thebid/tenderwillconsistoftwoparts–TechnicalbidandFinancialbid.Eachofthebidaretobeplacedintwoseparatesealedenvelopesclearlysuperscribing“Technicalbid”an “Financialbid”whichinturnaretobeplacedinonesealed cover clearly super scribing “Tender for Hiring Vehicle ………..(Vehicle name).” ThenameoftheAgency/firmmustbementionedonenvelops.ThebidofallpartieswhosePriceBidisnotinaseparatesealedcoverortheratesquotedthemfindsmentionintheirTechnicalBidshallberejectedforthwith.Allinformationsoughtunder “Terms and conditions and other information to be supplied”istobegiven inTechnicalBidwhilethepricequotedbythemwillbementionedonlyintheFinancialBid. Separate Bid/Tender is to be submitted each variety / type of vehicle.

(ii) Theoffers/bidsreceivedincompleteand/orfiledaftertheduedateshallbe

summarilyrejected.

(iii) TheTechnicalBidsshallbeopenedbyacommitteeon 29-06-2015at17:00hrsinthepresenceofbidderortheirauthorizedrepresentativewithauthorityletter,iftheyappear.

(iv) ThefinancialbidsofonlythosepartiesshallbeopenedwhoseTechnicalBidsare

foundtobeeligible.

(v) Thedepartmentreservestherighttoacceptorrejectanyoralltenderswithoutassigninganyreason.Incaseofanydisputeofanykindandinrespectofwhatsoever,thedecisionoftheAdditionalCommissioner(P&V),CentralExciseandServiceTax,Tiruchirappalliwillbefinalandbinding.

(vi) Thetenderdocumentsmustbereceivedlatestby29-06-2015at14:00hrs.Thedocumentsreceivedafterduedatetimeduetoanyreasonevenpostaldelayshallnotbeaccepted.

2. Authenticityofthetenderdocument:-

Everypageoftenderdocumentalongwithenclosuresmustbesignedbythebidder.

3. CostofTenderDocument:-

(i)The tender documents containing Terms and conditions alongwith prescribedproforma/formatforfurnishingrequiredinformation/detailscanbeobtainedfromthePRO,CentralExciseServiceTax,Tiruchirappallionanyworking day from 19-06-2015 onwards onpaymentofRs200/-(Rs.TwoHundredonly)(non-refundable)inshapeofDemandDraftdrawninfavouroftheChiefAccountsOfficer,CentralExciseandServiceTax,TiruchirappallipayableatTiruchirappalli.

(ii)Thetenderdocumentsmayalsobedownloadedfromthe and downloadedtenderdocumentsmustbeaccompaniedwithDemandDraftofRs.200/-(Rs.TwoHundredonly)separatelyinrespectofeachvehicleinfavouroftheChiefAccountsOfficer,CentralExciseandServiceTax,TiruchirappallipayableatTiruchirappallifailingwhichtender/bid/offershallbesummarilyrejected.

4. EarnestMoney:-

(i)Each Tenderdocumentsmustbeaccompaniedwithnon-interestbearingEarnestMoneyforeachvehicleseparatelyofRs.11,000/-(Rs.ElevenThousandonly) inshapeofDemandDraftinfavouroftheChiefAccountsOfficer,CentralExciseandServiceTax,TiruchirappallipayableatTiruchirappallifailingwhichtenderwillnotbeconsideredforopeningofFinancialBid.

(ii) Chequeswillnotbeaccepted.

(iii) Noearnestmoneywillbeacceptedaftertheduedateandtimeofsubmissionoftenderdocument.

(iv) EarnestmoneydepositedwithotherTenderwillnotbeadjustablewiththisTender.(v) NobankcommissionorinterestwillbepaidontheEarnestMoney.

(vi) IfabidderwithdrawsitsofferafteropeningofTechnicalBidorFinancialBidbeforeawardoftendertoothervalidtenderer,theearnestmoneydepositedbythemwillbeforfeited.

(vii) IfasuccessfulbidderfailstodepositrequisiteamounttowardsthePerformanceSecuritywithinspecifiedtimeasperintimation/requestoftheCentralExciseandServiceTax,Tiruchirappalli,theearnestmoneywillbeforfeited.

(viii) IfasuccessfulbidderfailstoexecuteanAgreementwithinspecifiedtimeasperintimation/requestoftheCentralExciseandServiceTax,Tiruchirappalli,theearnestmoneywillbeforfeited.

(ix) Central/StateGovernmentandCentral/StateGovernmentUndertakingsareexemptedfromdepositofEarnestMoney.

5. PerformanceSecurity:-

(i)The successful tenderer will be wholly and solely responsible for anydamage/levy/claimwillbeliabletopaythesaiddamage/levy/claim.Inthiscontext,thesuccessfulbidder, against each successful tender, willdepositRs.33,000/-(Rs.ThirtyThree ThousandOnly)for each vehicleasperformancesecuritywhichisnon-interestbearingintheshapeofBankDraft/BankGuaranteeissuedbyaNationalizedBankonlydrawninfavouroftheChiefAccountsOfficer,CentralExciseandServiceTax,TiruchirappallipayableatTiruchirappalli.

6. RefundofEarnestMoneyandPerformanceSecurity:-

(i)Earnestmoneydepositedbytheunsuccessfulbidderwillberefundedtobidderattheearliestafterfinalizationofthetender.EarnestmoneywillberefundedtothesuccessfulbidderonreceiptofPerformanceSecurity.

(ii)Further,thePerformanceSecuritywillberefunded/returnedtothesuccessfulbidderaftersuccessfulcompletionoftheContractAgreementandsettlementofaccountswithinthreemonthsofcompletionofcontractualperiod.

(iii) ThePerformanceSecuritywillbeforfeitedincaseofunsatisfactoryperformanceof

thesuccessfulbidder.ThedecisionoftheJointCommissioner(HAE),CentralExciseandServiceTax,Tiruchirappallionthisaccountwillbefinalandbindingonsuccessfulbidder.

7. Rates:-

(i)Rate / bid / offer must be without any condition, assumption, qualification,reservationorvariation.Rate/bid/offermustbementionedinprescribedproformainfiguresandinwordsinrespectofeachvehicleseparately. Incaseofanydiscrepancy,ratesquotedinwordswillprevail.Conditionaltenderofferorofferatvariancefromprescribedspecificationwouldbeineligibletocompeteforthetender.Pricesandpricecomponentsshallbefirmandshallnotbesubjecttoanypricevariationoradjustmentonaccountofanypriceescalationsthroughouttheexecutionofthecontract.

(ii) TherateforthevehiclemustbeatcostceilingofRs.40,000/- (Rs. Forty Thousands

Only)excluding taxesfor each of the vehicles viz., Innova, Xylo/Taverafor2000kmspermonthand Rupees 35,000/- for the vehicle Fiesta/Etios/Dzirefor2500kmspermonth.

(iii) Thebiddershallquotetheirrateindetailsofthebasepriceandservicetax.TheServiceTaxwillbepaidonsubmissionofdocumentaryevidenceaboutpaymentofservicetaxbythesuccessfulbidder.

(iv) Forrunningofthevehiclelogbookhavetobemaintained.Paymentfortheexcesskilometersshallbemadeaspertenderedrateperkm.for500kmsforthespecifiedvehicle.

(v) Contractedhire charges include all charges,viz. charges ofdriver, repairsandparking,maintenanceofvehicle,insurance,alltaxesasperMotorVehicleAct/StateGovernment/CentralGovernment,petrol/diesel,oilandalsoanyotherincidentalexpensesinrunningandmaintenanceofvehicleandpenalty/fineetc.

(vi) Thelowesttenderwillbearrivedbasedonsumofthequotedratefor30/31daysinthemonthupto2000kmsandrateperkmbeyond2000kmsrestrictedto500kmsper month. The tender getting lowest consolidated rate will be declared assuccessfulbidder.

8. SublettingofContract:-

Thesuccessfulbiddershallnotbeallowedtosublet/subcontractthecontracttoanyothercontractor.

9. Contractperiod:-

(i)Thecontractshallbeinforceforaperiodof1(one)yearfromthedateofexecutionofthecontract/agreement.

(ii) CentralExciseandServiceTax,Tiruchirappallireservestherighttoextendorreducetheperiodoftime.CentralExciseandServiceTax,Tiruchirappallicanterminatethecontractincaseofpoorperformanceaftergivingonemonthadvancenotice.Thedepartmentwillhavetherighttoterminatethecontractofsuccessfulbidderandallotthesametoanyotherwillingvalidbidderincaseofunsatisfactoryperformanceofthesuccessfulbidder.Thecontractcanalsobeterminatedprematurelyincaseofintroductionofchangeofsystemoftheinstanttender.

10. Prescribedformat/proforma:-

(i)Annexure–AandAnnexure–Baretobedulyfilledforthevehiclebeingoffered.AcompletecopyofRCBookinrespectofeachvehicleindicatingdateofmanufacturerandcommercialregistrationistobesubmittedwithAnnexure–Afailingwhichbidwillbedisqualified/rejected.Incase,thebidderwantstogivenewvehicleafterawardofContracttheclauseofsubmissionofRCBookwillnotbeapplicable.

(ii)Anaffidavitinprescribedproformai.e.Annexure–Cregardingnon-blacklistingornon-convictingbyanycourtoflawistobedulysubmittedinrespectofthevehicle.

(iii) ThesuccessfulbidderhastosubmitabankguaranteeintheshapeofDemandDraftor in prescribed proforma i.e. Annexure – D before execution of thecontract/agreementinrespectofthevehicle.

11. Capabilities,specificationformalitiesforDriver:-

(i)Thebiddersmustensurethatthedriversemployedhavevaliddrivinglicenseandcleandrivingrecord.

(ii) The drivers of the vehicle provided must follow traffic rules and all other

regulationsprescribedbytheGovernmentfromtimetotime.

(iii) Thedriversshallobservealltheetiquetteandprotocolwhileperformingthedutyandshallbeneatlydressed.

(iv) Thedriversshouldhaveminimum5yearsofexperienceofdriving.Theyshouldhavevaliddrivinglicensefordrivingpassengervehiclesonhire.

(v) ThedriversshouldbewellversedwiththeroadsandtheplacesinTamilnaduandshouldhaveexperienceincity/urbandrivingaswellasruraldriving.

(vi) Oncethedriverhasbeenallottedtoaparticularvehicle,heshouldremainwiththe samevehicleforaperiodofatleastoneyear.Anychangeinthedesignateddrivershouldbeintimatedtotheconcernedofficerbefore24hourssuchchangeiseffected.

(vii) Thedrivershouldbeprovidedwithagoodworkingmobilephonewhichshouldnotinswitchoffmodeatanypointoftime.

(viii)Thedrivershouldbedecentandwellbehavedandshouldnothaveanycriminal/adversepolicerecordagainsthimandheshouldnothaveanypasthistoryofaccidents.

(ix) Thedrivershouldnotbeaddicted.

(x) Thedrivershouldbeready/preparedforoutstationjourneysatshortnotice.

12. BillingandPayment:-

(i)Thebillingwillbedoneonmonthlybasis.Themonthlybills,induplicate,shallbesubmittedtotheconcernedvehiclein-chargewithin1STweekofeverysubsequentmonth.Non-submissionofthebillbeyond1STweekofeverymonthwithoutjustificationwouldnotbeentertainedanditwouldbepresumedthatbidderhasnoclaimforpayment.

(ii) Thedepartmentwillnotmakeanyadvancepayment.

13. Validityoftheoffer/bid:-

(i)Theoffer/bidofthebidderwillbevalidforatleastsixmonthsfromthedateofopeningofTechnicalbid.

14. Agreement:-

(i)ThesuccessfulbidderwillhavetoexecuteacontractagreementasperAnnexure-Ewiththedepartment.Thevalidityofcontractagreementwillbeforaperiodof1(one)yearforthevehiclefromthedateofexecutionofthecontract/agreement.

15. Penalty:-

(i) ApenaltyofRs.1,000/-onlypervehiclewillbeleviedifanyvehicleordriveroragency/firmfailtomeeteffectivetermsandconditionsonanyday.

16. Termsandconditions:-

(i) Thevehicleswillbeusedforofficeasstaffcarandoperationalvehiclesupto30/31daysupto2000kmsinamonth and upto 2500 km for the vehicle at Sl. No.1 of the table above.

(ii)ThevehicleswillbedeemedtobeatthedisposalofCentralExciseandServiceTax,Tiruchirappalliduringtheperiodofoperationaluseandcontractorshallhavetomakeavailablethevehicleonallthedaysofamonth,sevendaysaweek.

(iii) Thevehiclesmustbeavailableatanytimeofanydayasdesiredbythedepartment.Also,incaseofbreakdownofanyvehicle,substitutevehicleshallbeprovidedintimefailingwhichthedepartmentshallhavetherighttohireavehiclefromthemarketandcostincurredtothiswillbebornebythefirm.

(iv) Theliabilitiesoftheofficialofthisofficewillbelimitedtothehiringchargesagreedinthecontract.

(v) Theresponsibilityforthesafetyandsecurityofthevehiclesprovidedtodepartmentsolelylieswiththecontractor. Itisalsothecontractors absoluteresponsibilityto takecareofanydamage/repairscausedtothevehicleduringthevalidityofthecontract.

(vi) ThevehicleshouldfulfillthelegalobligationsprescribedbytheStateTransportAuthoritylikepaymentofroadtax,etc.Allrequirementsundervariousstatutorylawsmustbecompliedwith.Anydefaultwillbeliabilityofthecontractorandthisdepartmentshallnotbeliableinanymatterwhatsoever.Incaseofanyaccidentoranyothercontingency,anyclaimarisingoutofitshallbebornebythecontractoronlyandnoclaimwhatsoevershallbebornebytheCentralExciseandServiceTax,Tiruchirappalli.

(vii) InsuranceofthevehiclesandtheriskofpassengertravellinginthevehiclesshouldbecoveredbythecontractortotheextentofliabilityasspecifiedintheMotorVehicleActRulesmadethere-underoranyotherlawinforce.

(viii) Vehicle must be kept clean, odor free, in excellent condition, mechanically fit,suitableforofficialuseandshouldnotbeolderthan2014modelonthedateofthetendernotice.

(ix) Thefirm/agencyshouldnotbeblacklistedfromanyCentralGovernment/StateGovernment/CentralandStateundertakingsand/orconvictedbyaCourtofLaw.Anaffidavitregardingnon-blacklistingofthefirmshouldbeattachedasproof.Inabsenceofproofthetender/bidwillberejected.

17. Dispute resolving mechanism:-

(i) Incaseofanydisputeofanykindandinrespectofwhatsoeverarisingoutoftender / contract , the decision of the Commissioner of Central Excise & Service Tax at Triuchirapallai will be final and binding.

D. TermsandConditionforhiringofthevehicle:

1. PerformanceSecurity:-

(i)The successful tenderer will be wholly and solely responsible for anydamage/levy/claimwillbeliabletopaythesaiddamage/levy/claim.Inthiscontext,thesuccessfulbidderwilldepositRs.33,000/-(Rs.ThirtyThree ThousandOnly)asperformancesecuritywhichisnon-interestbearingintheshapeofBankDraft/BankGuaranteeissuedbyaNationalizedBankonlydrawninfavouroftheChiefAccountsOfficer,CentralExciseandServiceTax,TiruchirappallipayableatTiruchirappalli.

2. SublettingofContract:-

(i)Thesuccessfulbiddershallnotbeallowedtosublet/subcontractthecontracttoanyothercontractor.

3. Contractperiod:-

(i)Thecontractshallbeinforcefromthedateofexecutionofthecontract/

Agreement upto ……………(date).

(ii)CentralExciseandServiceTax (CEST),Tiruchirappallireservestherighttoextendorreducetheperiodoftime.CEST(HAE),Tiruchirappallicanterminatethecontractincaseofpoorperformanceaftergivingonemonthadvancenotice.Thedepartmentwillhavetherighttoterminatethecontractofsuccessfulbidderandallotthesametoanyotherwillingvalidbidderincaseofunsatisfactoryperformanceofthesuccessfulbidder.Thecontractcanalsobeterminatedprematurelyincaseofintroductionofchangeofsystemoftheinstanttender.

4. Capabilities,specificationformalitiesforDriver:-

(i)Thebiddersmustensurethatthedriversemployedhavevaliddrivinglicenseandcleandrivingrecord.

(ii)The drivers of the vehicle provided must follow traffic rules and all otherregulationsprescribedbytheGovernmentfromtimetotime.

(iii) Thedriversshallobservealltheetiquetteandprotocolwhileperformingthe

dutyandshallbeneatlydressed.

(iv) Thedriversshouldhaveminimum5yearsofexperienceofdriving.Theyshouldhavevaliddrivinglicensefordrivingpassengervehiclesonhire.

(v) ThedriversshouldbewellversedwiththeroadsandtheplacesinTamilnaduandshouldhaveexperienceincity/urbandrivingaswellasruraldriving.

(vi) Oncethedriverhasbeenallottedtoaparticularvehicle,heshouldremainwiththesamevehicleforaperiodofatleastoneyear.Anychangeinthedesignateddrivershouldbeintimatedtotheconcernedofficerbefore24hourssuchchangeis_effected.

(vii) Thedrivershouldbeprovidedwithagoodworkingmobilephonewhichshouldnotinswitchoffmodeatanypointoftime.

(viii) Thedrivershouldbedecentandwellbehavedandshouldnothaveanycriminal/adversepolicerecordagainsthimandheshouldnothaveanypasthistoryofaccidents.

(ix) Thedrivershouldnotbeaddicted.

(x) Thedrivershouldbeready/preparedforoutstationjourneysatshortnotice.

5. BillingandPayment:-

(i)Thebillingwillbedoneonmonthlybasis.Themonthlybills,induplicate,shallbesubmittedtotheconcernedvehiclein-chargewithin1ST weekofeverysubsequentmonth.Non-submissionofthebillbeyond1STweekofeverymonthwithoutjustificationwouldnotbeentertainedanditwouldbepresumedthatbidderhasnoclaimforpayment.

(ii) Thedepartmentwillnotmakeanyadvancepayment.

6. Penalty:-

(i) ApenaltyofRs.1,000/-( Rupees One Thousand)onlyperday per vehiclewillbeleviedifanyvehicleordriveroragency/firmfailtomeeteffectivetermsandconditionsonanyday.

7. OtherTermsandconditions:-

(i) Thevehicleswillbeusedforofficeasstaffcarandoperationalvehicleupto

30/31daysupto2000kmsinamonth and upto 2500 km for the vehicle at Sl. No.1 of the table above.

(ii)ThevehicleswillbedeemedtobeatthedisposalofCEST(HAE),Tiruchirappalliduringtheperiodofoperationaluseandcontractorshallhavetomakeavailablethevehicleonallthedaysofamonth,sevendaysaweek.

(iii) The vehicles must be available at any time of any day as desired by thedepartment.Also,incaseofbreakdownofanyvehicle,substitutevehicleshallbeprovidedintimefailingwhichthedepartmentshallhavetherighttohireavehiclefromthemarketandcostincurredtothiswillbebornebythefirm.

(iv) Theliabilitiesoftheofficialofthisofficewillbelimitedtothehiringchargesagreedinthecontract.

(v) Theresponsibilityforthesafetyandsecurityofthevehiclesprovidedto departmentsolelylieswiththe contractor. Itisalsothe contractor’s absoluteresponsibilitytotakecareofanydamage/repairscausedtothevehicleduringthevalidityofthecontract.

(vii) InsuranceofthevehiclesandtheriskofpassengertravellinginthevehiclesshouldbecoveredbythecontractortotheextentofliabilityasspecifiedintheMotorVehicleActRulesmadethere-underoranyotherlawinforce.

(viii) Vehiclemustbekeptclean,odorfree,inexcellentcondition,mechanicallyfit,

suitableforofficialuseandshouldnotbemorethan2yearsoldonthedateofthetendernotice.

8. JurisdictionoftheCourt:-

(i)Incaseofanydisputeofanykindandinrespectofwhatsoeverarisingoutoftender/contract,thedecisionofthe Hon’ble CourtatTiruchirappalliwillbefinaland binding.

InrespectofanyTermsandConditions,ifanythingismissing,theprovisionsoftenderdocumentswillprevail.

E. ApplicableLaw:

ThecontractshallbeinterpretedinaccordancewiththeIndianLaws.

F. Notice:

Anynoticebyonepartytootherpursuanttothecontractshallbesentinwritingorbytelegramortelex/cable/faxandconfirmedinwritingtothe

addressspecifiedforthatpurposeinthecontract.

Anoticeshallbeeffectivewhendeliveredoronthenoticeseffectivedate,whicheverisearlier.
