ORDINANCE NO. 1461

An ordinance AMENDING AND SUPPLEMENTING

ARTICLE 16 OF CHAPTER 5 OF THE CODE OF THE

BOROUGH OF GLENRIDGE ENTITLED Business

License REGISTRATION WITH THE INCLUSION OF A

NEW SECTION 5.16.05 PROVIDING FOR THE COLLECTION,

PREPARATION AND MAINTENANCE OF A

NON-SOLICITATION LIST

BE IT ENACTED AND ORDAINED, by the Mayor and The Borough Council Of

The Borough OfGlenRidge, in TheCounty Of Essex and The State Of New Jersey,

as follows:

Section 1. Article 16 of Chapter 5 of the code of the Borough of Glen Ridge entitled Business Licenses and Registration is hereby amended and supplemented with the inclusion of a new section 5.16.025 to be entitled “Collection, Preparation and Maintenance of a Non-solicitation List.

5.16.025A. The office of the Administrator/Borough Clerk shall collect, prepare and maintain a list of addresses of those premises where the owner and/or occupant has notified the Borough Clerk that soliciting and canvassing is not permitted on his/her premises. To be included on the non-solicitation list, residents shall complete a form. With the adoption of this Ordinance, the office of the Borough Clerk shall mail the form to all residential property owners or occupants. Thereafter, the form shall be available in the MunicipalBuilding’s General Office during normal business hours, Mondays through Fridays from8:30AM to 4:30 PM except on week-ends and legal holidays.

5.16.025B. the Administrator/Borough Clerk and /or Deputy Borough Clerk shall submit the non-solicitation list to the Chief of Police on a quarterly basis which non-solicitation listing shall be distributed to applicants seeking a license to solicit or canvas at any address on the non-solicitation list.

5.16.025C. Updating of Non-Solicitation List: On or about January 1st, April1st, July 1st and October 1st of each year, the Office of the Borough Clerk shall update the list. The updated list shall then be forwarded to the Chief of Police for distribution to solicitors and /or canvassers.

5.16.025D. Any solicitor or canvasser violating the provisions of Section 5.16.025, described above, shall be punishable by a fine and or imprisonment as prescribed in Section 5.16.030 of the code of the Borough of Glen Ridge entitles “Solicitations and Canvassers”

Section 2. If any section, sub-section, paragraph, sentence or any other part

of the Ordinance is declared unconstitutional or invalid, such

judgment shall not affect, impair or invalidate the remainder of the

Ordinance.

Section 3.All ordinances or parts of ordinances which are inconsistent with the provisions of the Ordinance are hereby repealed to the extent of such inconsistency.

Section 4.This Ordinance shall take effect in accordance with law.

Be it further enacted and ordained, that this Ordinance shall take effect immediately upon final passage and publication thereof, as provided by law.
