1. This permit application is for auto repair. The property is in the I-1 Zone of the Capital Heights Transit Overlay Zone as of July 1, 2008. Auto repair is a prohibited use in the Capital Heights Transit Overlay Zone. The applicability section of the Capital Heights Transit Overlay Zone indicates all uses that were lawful or could be certified as a legal nonconforming use on the date of transit district overlay zoning approval are exempt from the TDDP standards and are not nonconforming. Prior permit 8322677-2000-U was issued for small engine repair; motorcycles, lawnmowers-auto, etc. Since the auto repair/small engine repair use legally existed per permit #8322677-2000-U prior to the Central US 1 Corridor, auto repair/small engine repair is exempt from the development district standards with documentation of continuous operation from the rezoning on July 1, 2008 to the present. One piece of documentation must be submitted dating every 6 months or 180 days from July 1, 2008 to the present must. Documentation can consist of invoices/receipts documenting services provided, tax records, utility bills, etc. The documentation must indicate the use of the property and its address. If adequate documentation cannot be provided a Detailed Site Plan approval is required. The applicant should contact Joseph Dehuarte at 301-952-3772 for information on this process. Prior permit comments were not addressed and would still apply to the subject permit:
5/24/17 – WSSC documentation and court order for failure to pay rent was submitted as documentation. I asked that documentation must contain anything that demonstrates the approved use of the property. 6/2/17 – In addition to the WSSC documentation Mr. Drury submitted a business license from Town of Capitol Heights covering the period of July 1, 2014 to June 30, 2015. Permit No. 2718. I called the Town of Capitol Heights and spoke with Monique and she confirmed that an auto body shop has been continuously operating at this location.

2. The submitted location drawing is inadequate for review. A site plan, drawn to scale, must be submitted in accordance with Section 27-254 of the Prince George’s County Zoning Ordinance. (zone, proposed use, parking schedule, 10’ landscape adjacent to Chamber Ave, center line of Chamber Ave etc must be provided).
3. The submitted location drawing is for lots 46 through 56. Lots 50 through 56 are zoned R-T in the Capital Heights Transit Overlay Zone as of July 1, 2008. No permits have been approved for these lots therefore they should not be included on this site plan.
4. The height and type of all fences should be demonstrated on the site plan. Any proposed fencing would need a building permit.
5. Width of the entrance to the parking lot from Chamber Ave. should be provided on the site plan.
6. Width of all gates should be provided on the site plan.
