INTERPRETATION

6. The latest Regulations are the School and Early Years Finance (England) Regulations 20142016. The Regulations state that schemes must deal with the following matters:

4.5Planning for Deficits

A governing body cannot plan for a deficit balance other than in the following circumstances:

(i)for schools maintained by the local authority under the previous Local Management of Schools arrangements, a deficit balance is allowed where a deficit recovery plan had been prepared by the school and agreed by the Director of Schools, Children and Families;

(ii)under the arrangements for Licensed Deficits Loan Schemes as set out at paragraph 4.109 of this Scheme.

4.9Licensed Deficits

Schools may plan for a deficit balance in future years, subject to the agreement of the Director of Schools, Children and Families and the Local Authority’s designated Section 151 Officer, in accordance with the following conditions/requirements:

(i)the maximum length of time over which schools may normally repay the deficit (i.e. reach at least a zero balance), will be three years. Schools will need to prepare a recovery plan in a format specified by the Authority and progress towards the elimination of the deficit will be reviewed formally at least every six months. Schools will need to adjust their plans accordingly should the financial position of the school improve or worsen during this period.

(ii)licensed deficits will normally only be agreed where circumstances affecting a school change in ways which could not reasonably have been foreseen and the school concerned needs a period in excess of one financial year in order to effect a reduction in its annual level of expenditure and/or an increase in its annual level of income sufficient to eliminate the budget deficit;

(iii)a licensed deficit shall not normally exceed 5% of a schools budget share;

(iv)no more than 30% of the total of schools accumulated balances held by the Local Authority’s designated Section 151 Officer as part of the County Fund will be used to back these arrangements.
There is no Licenced Deficit Scheme

4.10 Loan schemes

There is no loan scheme in place for schools within the Authority.

The Authority operates a loan scheme for schools that may require a revenue loan during a period of financial difficulty.
Schools wishing to apply for a loan must write to the Director of Education stating the circumstances of why a loan is required. An affordable repayment plan must accompany the loan request and must not usually exceed 3 years. There is no minimum period.

The decision will be based on the circumstances of the school and the ability to repay the loan. The decision will be taken by the Director of Education and the Director of Finance and Procurement. The Authority reserves the right to refuse a loan for any reason.

The loan will be repayable starting 1st April following the agreement of the loan. For example a loan agreed in September 2017 will be repayable from April 2018.

Interest will be payable on the basis of the average Local Authority Seven Day Interest Rate.

In the event of a closure or merger of schools the loan must be repaid immediately. Where a school closes as part of converting to an academy the loan will be repayable before conversion, unless agreed to continue and transferred as part of the Commercial Transfer Agreement.

Loans will be funded from school balances and no more than 30% will be used to back these arrangements.
