A CONCURRENT RESOLUTION directing the Legislative Research Commission to create a task force to study Kentucky's system used to issue driver licenses.

WHEREAS, issuance of an instruction permit or operator's license is a function of the Kentucky Transportation Cabinet; and

WHEREAS, the Circuit Court Clerk of each county has been authorized since 1936 to act on behalf of the Transportation Cabinet for the purpose of issuing instruction permits and operator's licenses; and

WHEREAS, the time Circuit Court Clerks and their deputies are required to devote daily to the issuance of instruction permits and operator's licenses continues to escalate at a rapid pace;

NOW, THEREFORE,

Be it resolved by the House of Representatives of the General Assembly of the Commonwealth of Kentucky, the Senate concurring therein:

Section 1. The Legislative Research Commission shall establish a task force to study Kentucky's system used to issue driver licenses. The purpose of the task force shall be to analyze the current cost of issuing Kentucky instruction permits and operator's licenses; analyze the current system used to issue Kentucky instruction permits and operator's licenses; and analyze the system used by other states to issue instruction permits and operator's licenses.

Section 2. The task force shall be composed of fifteen members. The chairs of the House and Senate Transportation Committees shall serve as co-chairs of the task force. The Legislative Research Commission shall appoint two members of the House of Representatives and two members of the Senate. The Legislative Research Commission shall appoint nine additional members based on the following recommendations: The Governor shall recommend one member who represents the Governor's Office of Technology and one member who represents the Governor's Office of Policy and Management; the Chief Justice of the Supreme Court shall recommend two members who represent the Administrative Office of the Courts; the Secretary of the Transportation Cabinet shall recommend two members who represent the cabinet; the President of the Circuit Clerks Association shall recommend three members who are circuit clerks that are members of the Circuit Clerks Association.

Section 3. The task force shall report its findings to the Legislative Research Commission for referral to the appropriate committee. The report shall be due not later than one year from the date of the first meeting of the task force. Meetings of the task force shall be monthly and on a schedule established by the Legislative Research Commission.

Section 4. Provisions of this resolution to the contrary notwithstanding, the Legislative Research Commission shall have the authority to alternatively assign the issues identified herein to an interim joint committee or subcommittee thereof, and to designate a study completion date.
