Certificates

TERMS AND CONDITIONS:

1. PROVISIONAL BOOKING: Either verbally or by telephone, will be held for three days maximum.

Until confirmed, no booking is binding on the School.

2. CONFIRMED BOOKINGS: will be considered firm once the booking form is received, completed in full and signed, with the minimum deposit/balance.

3. DEPOSIT: if a booking is made 28 days before the published date of the course, a deposit is required.

If within 28 days, the full course fee is required.

4. COURSE DURATION:

a) 2 day weekend courses from approx. 1900hrs Friday until approx. 1600hrs the following Sunday.

b) 3 day weekend courses from approx. 19.00hrs Thursday or Friday until approx. 16.00hrs the following Sunday or Monday

c) 5 day courses from approx. 1900hrs Sunday until approx. 1600hrs the following Friday.

d) 9 day courses from approx. 1900hrs Friday until approx. 1600hrs the following Sunday.

e) Adventure Cruises from approx. 1900hrs Friday until approx. 1600hrs the following Friday.

5. NON-ARRIVAL: Any client failing to arrive for any reason whatsoever including illness without notifying the School, will forfeit automatically the total monies paid and by doing so no liability whatsoever shall attach to the School.

6. SEA SICKNESS: Clients with special medical problems should check that their GP considers them safe to sail, advise Pembrokeshire Cruising of any such condition when booking, and both Principal and skipper when reporting for the course. Necessary personal medications should be brought with you.

7. SKIPPER'S/PRINCIPAL'S DECISIONS: The Principal's decision is final at all times on all Pembrokeshire Cruising property and Pembrokeshire Cruising vessels until the skipper takes over.

a) Skipper's decision: from the moment the skipper steps on board the instruction vessel in accordance with marine practice, the skipper's decisions are always final.

b) All crew/clients will accept all orders and decisions given to them by the skipper at all times whilst on board the Pembrokeshire Cruising vessel or ashore, for the duration of the course until its completion and the client is no longer on board. The skipper's authority is total night and day in accordance with marine law.

c) If for whatever reason a client does not accept an order from the skipper or his designated substitute, whether the client considers it to be reasonable or not, the client shall be considered to be in breach of the Articles of Sailing. The skipper shall take any action or decision he considers fit for the well-being of his vessel and crew. If the client is placed ashore at the nearest port, no liability whatsoever shall attach itself to the School and neither shall the client have any redress for any expense or unused portion of the fee. Neither any redress against the skipper or School as result of any action taken by the Skipper.

8. SEA TIME: Every effort will be made to give clients maximum sea time. However, if in the skipper's opinion, weather conditions, safety or any other consideration renders it imprudent, the skipper's decision is final.

9. VESSEL CHANGE: If the School changes vessels due to any vessel becoming unsuitable for any reason whatsoever or delay, this does not in any way affect the validity of the booking or the terms and conditions stated here in which remain good

10. CLIENT CANCELLATION: All cancellations must be in writing. Your personal insurance provides cover against certain unavoidable cancellation. If you cancel up to 28 days before the start of your course, you only loose your

deposit. If less than 28 days notice of cancellation is given after payment of the balance of the course fee has been made, 80 per cent of your course fee is retained. If you cancel two weeks or less before the start of your course, 100 per cent of the course fee will be retained. Course bookings are non transferable.

11. SCHOOL CANCELLATION: If, for any reason, the School is unable to fulfil a booking or a vessel becomes unseaworthy for any reason whatsoever, the School will immediately inform the client. No liability shall attach itself to the School beyond the refund of the full fee paid by the client(s) or unused portions thereof.

12. SCHOOL INSURANCE: The School is insured for instruction. However, clients' needs vary. The School strongly advises clients to obtain their own insurance against sickness, illness, course fees, illness/accident on board, or any other cover the client considers prudent for his personal well being or lifestyle. The client agrees the School insurance policies are adequate and the policy is available for inspection on request.

13. DISCLAIMER: No liability is accepted for any clients' vehicles parked, or possessions in the vehicle, on the marina or for possessions in the School's vessels.

14. BREAKAGES OR DAMAGE: Howsoever caused, must immediately be notified to the skipper or Principal for safety. Clients shall be liable for any loss or damage to School equipment up to and including the first £100.00 per item.

15. CERTIFICATES: The School's standards of instruction are high and certificates will only be issued at the end of a course if, in the opinion of the school's Principal and instructors, the client has reached the standard necessary. The school Principal's and instructors' decision shall be final and accepted by all clients.

16. DISPUTE: In the event of a dispute not being settled by mutual agreement, it is agreed that the President of the British Law Society shall elect an Arbitrator whose decision shall be final. It is further agreed that all agreements between customers, clients and staff of Pembrokeshire Cruising shall be governed by British Law, even when the dispute occurs outside British territorial waters
