NOTICE OF SETTLEMENT

AUTH FUELS SITE

NOTICE is hereby given on behalf of Auth Fuels, Inc. of a settlement relative to releases of oil or hazardous materials at the Auth Fuels Site (Massachusetts Department of Environmental Protection (“DEP”) Release Tracking No. 1-0801), 507 North Main Street, East Longmeadow, Massachusetts (“the Site”). Auth Fuels, Inc. has resolved its liability to the Commonwealth of Massachusetts in a Settlement Agreement regarding the Site. The Settlement Agreement requires Auth Fuels, Inc. to conduct response actions to the extent possible using payments specified in the Settlement Agreement to achieve either a Response Action Outcome or Remedy Operation Status in accordance with the Massachusetts Contingency Plan and any permits issued by DEP. Pursuant to the terms of the Settlement Agreement, compliance with the terms of the Settlement Agreement shall resolve any liability for Auth Fuels, Inc. for claims of contribution, cost recovery or equitable share regarding matters addressed in the Settlement Agreement, pursuant to Section 3A(j)(3) of M.G.L. c. 21E.

A copy of the Settlement Agreement may be reviewed at the DEP Western Regional Offfice, 436 Dwight Street, Springfield, MA. OPPORTUNITY TO COMMENT

In accordance with M.G.L. c. 21E, §3A(j)(2), written comments on the Settlement Agreement may be submitted for a period of 90 days (until the date shown below) to the Commonwealth and Auth Fuels, Inc. by delivering such comments to the persons listed below.
