Assumption of Risk/Hold Harmless Agreement

ASSUMPTION OF RISK/HOLD HARMLESS AGREEMENT

In consideration of being allowed to participate in the activities of Smoky Mountain Llama Treks, L.L.C. (herein after referred to as “the Outfitters”), I ASSUME ALL RISKS AND RESPONSIBILITIES for the safety of my property and me as well as the safety of the person(s), animals, and any property of any minor who accompanies me. I hereby indemnify and hold harmless the Outfitters.

I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the Outfitters, its' officers, employees, agents and the landowners whose land I will pass collectively, and release the Outfitters from all liability to me, my personal representative of estate, assigns, heirs, and next of kin, for any and all loss or damage, and any claims and/or demands on account of my injury, death, damage, or loss of property incurred during my stay with the Outfitters.

If I am accompanied by a MINOR, in further consideration of being allowed to bring a minor(s) with me, I hereby agree to indemnify the Outfitters and HOLD THEM HARMLESS FROM ALL LIABILITY TO SUCH MINOR or minors' parents, personal representatives, or estate, heirs, next of kin, with respect such minors' presence with the Outfitters. I hereby AGREE THAT I ASSUME ALL RESPONSIBILITY for the conduct and safety of any minor and any minors' property.

I hereby warrant/represent that I am of lawful age and legally competent to sign this release; I understand that the terms of this release are contractual; and that this release shall be binding upon my personal representative or estate, assigns, heirs, next of kin, and that I have signed this release of my own free will.

I hereby acknowledge that if any part of this release is found not to be legally binding upon me, all other parts of this release shall be binding on me and continue in full force and effect. I further warrant and represent that I shall comply with all policies and obey all rules and regulations of the Outfitters, including those outlined herein, and with all written and verbal instructions given me.

I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS RELEASE OF LIABILITY BY CAREFULLY READING IT BEFORE SIGNING IT.
