On page 7, after line 20, insert the following:

"SECTION 3. A NEW SECTION OF KRS 146.410 TO 146.535 IS CREATED TO READ AS FOLLOWS:

(1)As used in this section, "legacy nature preserve" means a nature preserve that:

(a)Provides educational programming in cooperation with a Kentucky county board of education and allows public, private, and home-schooled students access to outdoor learning opportunities;

(b)Contains a manmade structure that is open to the public and that requires special maintenance and preservation efforts due to its exceptional age and historical or cultural significance;

(c)Incurs costs in allowing guests to engage in interactive demonstrations relating to daily life on a Kentucky historical farm, including but not limited to costs incurred by keeping and raising barnyard animals for public interaction; and

(d)Is managed, through a management agreement with the commission, by a 501(c)(3) nonprofit organization that is responsible, in whole or in part, for the costs of managing and maintaining the property and any structures contained thereon.

(2)Upon a majority vote of its board of directors, the 501(c)(3) nonprofit organization that manages a legacy nature preserve may:

(a)Provide better access to the legacy nature preserve to persons with physical disabilities, including but not limited to providing for paved or hardened parking, trails, entryways, and connecting paths to structures;

(b)Construct restrooms that are accessible to persons with physical disabilities on the locations of existing nonhistorical structures and within two hundred fifty (250) feet of an existing historical structure;

(c)Renovate, demolish, or replace any structure that was built to accommodate visitors to the legacy nature preserve;

(d)Continue to host activities at the legacy nature preserve that historically have been allowed by the commission;

(e)Once per calendar year, allow a historical reenactment and encampment, including but not limited to an overnight stay with campfires, which shall be permitted by the commission so long as they are in compliance with all relevant local fire safety regulations; and

(f)Once per calendar year, allow an archery event, which shall be permitted by the commission provided that all relevant safety precautions are followed to ensure that any risks to human and animal safety are minimized.

(3)All activities authorized by this section shall be done in accordance with the articles of dedication for the legacy nature preserve and the provisions of this chapter. The commission shall exercise its authority under the articles of dedication for the legacy nature preserve to grant permission to the 501(c)(3) organization that manages the legacy nature preserve to engage in all of the activities authorized under this section.

(4)The commission shall continue to authorize, to the same extent as previously allowed, the keeping and raising of farm animals on any legacy nature preserve that had previously been authorized by the commission to keep and raise farm animals for a period of five (5) years prior to the effective date of this Act, as long as there is no future increase in the number of farm animals over what had previously been allowed."; and

On page 7, line 21, delete "Section 3" and insert "Section 4" in lieu thereof.
