BOONSBORO MAYOR AND COUNCIL
PUBLIC HEARING AND REGULAR MEETING MINUTES
September 4, 2007

The Mayor and Council of Boonsboro held a public hearing at 6:45 PM on Monday, September 4, 2007 in the Eugene C. Smith Community Center in Shafer Park to gain public comment on Ordinance 2007-09; Amendments to the Zoning Ordinance. In attendance were Mayor Kauffman, Assistant Mayor Long, Councilmen Chambers, Grove, Hawkins, Nuice, Councilwoman Mose, Town Manager Smith, and Police Chief Hewett. Also in attendance were Planning Commission members Snyder, Faulder, Wright, Maricle, and Ambrose. The notice of public hearing was advertised in the Herald-Mail Newspaper on August 17 and 24, 2007. There was no public comment and the public hearing closed at 6:50 PM.

The regular meeting session convened at 7:00 PM. with the pledge and invocation. In attendance were Mayor Kauffman, Assistant Mayor Long, Councilmen Chambers, Grove, Hawkins, Nuice, and Councilwoman Mose. Also in attendance were Town Manager Smith and Police Chief Hewett.

The regular session of the Mayor and Council on Monday, August 6, 2007 closed at 9:00 PM. and moved into executive session to discuss two personnel matter and a contractual issue as stated under 10-508-1 of the Annotated Code of Maryland. In attendance were Mayor Kauffman, Assistant Mayor Long, Councilmen Chambers, Grove, Hawkins, Nuice, Councilwoman Mose, and Town Manager Smith.

Motion by Long, second by Mose to approve the August 6, 2007 Public Hearing Meeting and Regular Meeting Minutes and motion carried.

Motion by Chambers, second by Long to approve the August 6, 2007 Executive Session Meeting Minutes and motion carried.

Motion by Grove, second by Nuice to approve the August 27, 2007 Workshop Meeting Minutes, and motion carried.

Motion by Hawkins, second by Chambers to approve the August 27, 2007 Workshop Executive Meeting Minutes, and motion carried.

Motion by Nuice, second by Long, to approve the August 2007 Treasurers Report and motion carried.

Motion by Grove, second by Hawkins to approve the August 2007 bills to be paid and motion carried.

GUESTS:

Use of School Facilities: Coach Anders, Jeremy Barkdoll and Doug Turner. BAAA – 320 students, which includes football players and cheerleaders, are having problems with the use of school property for activities due to conflict with other organizations given priority. Approved for Sunday only usage of school fields. Requesting land from Mayor and Council (5 - 10 acres) for practice and regulation fields. Mayor stated it is time for cooperation from the Board of Education, and support for local and sport organizations that feed into the schools. Also, opportunities for Open Space with recent annexation, use of Sinnisen Tract for practice field until park expansion.

NEW BUSINESS

Approval of Ordinance 2007-09; Amendments to the Zoning Ordinance: Motion by Hawkins, second by Long to approve the Ordinance. Motion carried.

Ratification of Notice of Award for Construction of Wastewater Treatment Facility: Discussion of construction bid held during Executive Session Meeting on August 6, 2007. Issue of the notice of award to Kinsley Construction for the construction of the Wastewater Treatment Facility. Motion by Chambers, second by Grove. Motion carried.

Donation Requests: Boonsboro Athletic Boosters, Inc for $250. Motion by Long, second by Mose. Motion carried. Community Free Clinic for $100. Motion by Hawkins, second by Nuice. Motion carried.

Approval of Specification for Bid of New Truck: One ton 4x4 truck, money budgeted for FY08, split between all three funds. Request to proceed with request for bids due to repair costs of $8-$12,000 for the 1994 GMC truck to be replaced with the new truck. Motion by Hawkins, second by Grove. Motion carried.

Approval of Saturday, October 13, 2007 for Bulk Trash Pickup Day: By Peck Refuse. Motion by Chambers, second by Nuice. Motion carried.

Approval of Wednesday, October 31, 2007 for Trick-or-Treat from 6:00 PM to 8:00 PM: Motion by Long, second by Grove. Motion carried.

BOE Parking: Councilman Hawkins stated the parking situation in fenced lot area is resolved. Problems with students without school parking permits parking throughout Boonsboro residential areas.

COMMISSION REPORTS

Planning Commission: Councilman Nuice – Middletown Valley Bank pending final plat approval on entrance – Battlefield Estates has preliminary plat approval, and working on Storm Water Maintenance issues – Town Planner vacancy in newspaper. Holding interviews - Regular meeting in October.

BDDA: Town Manager Smith – Plans to put together “Welcome” packets for new residents and businesses in Town - Discussed plans for Boonesborough Days, 9-11 Parade, Trick-or-Treating, Nora Roberts book signing, Olde Tyme Christmas, and Christmas decorating contest.

Police & Public Safety: Assistant Mayor Long – National Night Out was in lieu of formal meeting. National Night Out was on the front page of The Citizen newspaper.

Police Department Report: Chief Hewett – 408 calls for service in August - Unlocked cars being broken into in Town and southern part of the County – encouraged to lock cars.

Utilities: Councilman Chambers – Alternate 40 Waterline pending Board of Public Works approval by MDE. Wastewater Treatment Plant notice to proceed and begin work in September. Should be issued next week with pre-construction meeting to follow.

Park Board: Councilman Hawkins – Another church interested in old park equipment. At least three groups now interested in equipment. Two vacancies to be filled on Park Commission. National Guard to come in 2008. Olde Tyme Christmas on December 7, 2007. Grills for park ordered. Library - October 26, 2007 for the turn over date - windows are in, doors in and building is being locked. Interior work to begin soon. Park expansion update – CDM staff to push SHA for turning lane on street.

Town Manager: Town Manager Smith – Grant Funding received – St. Paul Street road project underway – Recycling Center update – Glenn Hutzell to have Wolfsville Commons survey completed by September 14, 2007.

Motion by Chambers, second by Hawkins to close the regular session at 8:20 PM and move into executive session to discuss personnel matter. Motion carried.
