ORDINANCE OF THE MARIN COUNTY BOARD OF SUPERVISORS

AMENDING THE ZONING MAPFOR THE PROPERTIES LOCATED AT

St. Vincent’s Drive (155-011-28, 155-011-29, 155-011-30)

Silveira Parkway (155-011-08, 155-121-16)

441 Drake Avenue (052-140-36)

Seminary Drive (043-261-25, 043-261-26)

The Board of Supervisors of the County of Marin hereby ordains as follows:

SECTION I. FINDINGS

I. WHEREAS, the proposed rezoning of these properties will add a combining district to the current zoning district. This change will establish the allowable residential density for affordable housing, as defined by the Marin County Development Code, at a maximum density of 30 units per acre on a limited portion of sites specified in an adopted Housing Element.

II. WHEREAS, the rezoning of these properties will support clustered site design, while preserving a substantial portion of each property as private open space.

III. WHEREAS, the capacity allowed by the Affordable Housing Combining District, as applied to limited acreage for each site, does not exceed the total number of units allowed under the Countywide Plan land use designation for each site.

IV. WHEREAS, The Countywide Plan Policy 8.7 restricts mixed-use sites in the Tamalpais Area Community Plan to 100 units, and Policy S.V-2.5 establishes a total of up to 221 dwelling units for the combined St. Vincent’s/Silveira sites; these policies shall apply to any sites designated under the Affordable Housing Combining District (AH).

V. WHEREAS, the Marin County Planning Commission held duly noticed public hearings on June 24, 2013 and on July 8, 2013 to consider rezoning of these properties to add the Affordable Housing Combining District (AH), and hear testimony in favor of, and in opposition to, the rezoning and recommended that the Marin County Board of Supervisors adopt the proposed zoning map amendments for the above-mentioned properties.

VI. WHEREAS, the Marin County Board of Supervisors held a duly noticed public hearing on September 17, 2013 and continued the hearing to September 24, 2013 to consider rezoning of these properties to add the Affordable Housing Combining District (AH), and hear testimony in favor of, and in opposition to, the rezoning and consider adoption of the proposed zoning map amendments for the above-mentioned properties.

VII. WHEREAS, those properties being rezoned have been evaluated in the Housing Element Supplemental Environmental Impact Report to the 2007 Countywide Plan.

NOW, THEREFORE, BE IT RESOLVEDthat the Marin County Board of Supervisors declares that the property located at St. Vincent’s Drive, and further identified as Assessor’s Parcels 155-011-28, 155-011-29, 155-011-30, and the lots located at Silveira Parkway, and further identified as Assessor’s Parcels 155-011-08 and 155-121-16 as depicted in Exhibit A of this ordinance, are rezoned with a combined zone of A2:AH (Agriculture, Limited: Affordable Housing Combining – 30 units per acre maximum density). The provisions of the AH district can be applied to a maximum of 3.5 acres combined on these properties.

BE IT FURTHER RESOLVED that the Marin County Board of Supervisors declares that property located at 441 Drake Avenue, and further identified as Assessor’s Parcel 052-140-36 as depicted in Exhibit A of this ordinance, is rezoned with a split combined zone of RMP-4.2:AH (Residential Multiple Planned – 4.2 units per acre maximum density: Affordable Housing Combining – 30 units per acre maximum density) and RE-B3: AH (Residential Estate – 20,000 square foot minimum lot area: Affordable Housing Combining – 30 units per acre maximum density). The provisions of the AH zoning district can be applied to a maximum of 0.5 acres on this property.

BE IT FURTHER RESOLVED that the Marin County Board of Supervisors declares that the property located at Seminary Drive, and further identified as Assessor’s Parcels 043-261-25 and 043-261-26 as depicted in Exhibit A of this ordinance, is rezoned with a combined zone of RMP-2.47:AH (Residential Multiple Planned – 2.47 units per acre maximum density: Affordable Housing Combining – 30 units per acre maximum density). The provisions of the AH zoning district can be applied to a maximum of 2 acres on this property.

SECTION III: EFFECTIVE DATE

This Ordinance shall be and is hereby declared to be in full force and effect as of thirty (30) days from and after the date of its passage, and shall be published once before the expiration date of fifteen (15) days after its passage, with the names of the Supervisors voting for and against the same in the Marin Independent Journal, a newspaper of general circulation published in Marin County.

SECTION IV: VOTE

PASSED AND ADOPTED at a special meeting of the Board of Supervisors of the County of Marin held on this 24th day of September, 2013, by the following vote:
