A Directive Issued to Implement Proclamation No of 341/2002 of Chamber of Commerce and Sectoral Associations Council

Introduction

In order to further develop the benefit that investors who are engaged in business provide for themselves and for the economic development of the country, through the Chamber of Commerce and through the Sectoral Associations, as well as to realize the objectives indicated for Chamber of Commerce and Sectoral Associations, under Chamber of Commerce and Sectoral Associations Councils Proclamation No 341/2004, and therefore since it has been found necessary to issue a directive which is going to assist the implementation of the proclamation, this directive has been issued.

Article 1: The Issuing Authority

The Ministry of Trade and Industry in accordance with Chamber of Commerce and Sectoral Associations Councils Proclamation No 341/2003, Article 24 and 35 has issued this directive.

Article 2: Definition

The words which are referred as “Ministry, Council or Councils, Region, Sectoral Associations and Businessmen or Business Activity will have the meaning of the proclamation No 341/1995.

Article 3: Concerning the Establishment of Sectoral Associations

3.1  Sectoral Associations can be established at the national, or regional or Woreda levels by Agricultural Product Manufacturing Businessmen by Factoring Produced, Manufacturing Businessmen, by Businessmen who are engaged in minor and small scale Business and in Manufacturing Activity and by businessmen who are engaged in any Manufacturing Activity.

3.2  The Office of the Ministry, from the standpoint of the type of the Manufacturing Activity that Manufacturing Businessmen are engaged, and from the number of members which Sectoral Associations needs to have, will decide.

3.3  Unless conflict rises against this directive the existing sectoral associations as per the directive may continue their activity by acquiring their legal status

Article 4: Mode of Organization of Sectoral Associations

Sectoral Associations, which can become members of Chamber of Commerce and Sectoral Associations Councils will be organized at the National, or Regional or Woreda level in the following manner.

4.1  The Sectoral Associations which will be organized initially at the National levels are the following

4.1.1  The Ethiopian Printers and Publishers Association

4.1.2  The Ethiopian Leather, Shoes and Leather Products Manufacturing Association.

4.1.3  The Ethiopian Sugar and Sweats Manufacturing Association.

4.1.4  The Ethiopian Textile and Garments Manufacturing Association.

4.1.5  The Ethiopian Vegetable, Fruit and Flowers Manufacturing Association.

4.1.6  The Ethiopian Broom Corm and Broom corn products Manufacturing Association.

4.1.7  The Ethiopian Pharmaceutical and Medical Equipment Manufacturing Association.

4.1.8  The Ethiopian Taxidermy Manufacturing Association.

4.1.9  Ethiopian Construction Equipment Manufacturing Association.

4.1.10  The Ethiopian Mechanical Engineering and Basic Metals Manufacturing Association.

4.1.11  The Ethiopian Chemical Manufacturing Association.

4.1.12  The Ethiopian Tayr and Plastic Products Manufacturing Association.

4.1.13  Ethiopian Meet Manufacturing Exporters Association.

4.1.14  The Ethiopian Electrical and Electronics Equipment Manufacturing Association.

4.1.15  The Ethiopian Tobacco and Matches Manufacturing Association.

4.1.16  The Ethiopian Cosmetics Manufacturing Association.

4.1.17  The Ethiopian Ceramics and Glasses and Bottles Manufacturing Association.

4.1.18  The Ethiopian non-Metallic Minerals Manufacturing Association.

4.1.19  The Ethiopian Precious Minerals Manufacturing Association.

4.1.20  The Ethiopian Pulps and Paper Product Manufacturing Association.

4.1.21  Ethiopian grain , oil seed and spices producers and exporters

4.2  The Sectoral Associations which will be organized initially at the Regional Level are the following.

4.2.1  Cotton Producers and ginnery Owners Association

4.2.2  Fishery Producers Association

4.2.3  Crops Producers Association

4.2.4  Forest Development and Wood Producers Association

4.2.5  Salt Producers Association

4.2.6  Food and Liquor Producers Association

4.2.7  Coffee processing associations

4.3  The Sectoral Associations which will be organized initially at the city or Woreda level are the following.

4.3.1  Wood and Reeds Products Manufacturing Association

4.3.2  Grain Mills Owners Producers Association

4.3.3  Dress and Canvas Tailors Association

4.3.4  Home Economics and Traditional Food Products Manufacturing Association

4.3.5  Silk Screen and Advertising Publishing Manufacturing Association

4.3.6  Garage Service Rendering Association

4.3.7  Small construction Equipment Manufacturing Association

4.3.8  Domestic Animals Breeders and Animal Products Manufacturing Association

4.3.9  Weaving Products and Carpet Manufacturing Association

4.3.10  Metal Products manufacturing and Jewelers Association

4.3.11  Sweaters Manufacturing Association

4.3.12  Jewelry and Cultural Artifacts Association

4.3.13  Pot Work Producers Association.

Article 5 Representation at the Chamber of Commerce and Sectoral Association Council.

5.1.  The following sectoral Association shall directly become members of the city chambers of commerce and sectoral associations councils.

5.1.1.  The Dress and Canvas Tailors Association

5.1.2.  Home Economics and Cultural Food Product Manufacturing Association

5.1.3.  Weaving Products and Carpet Manufacturing Association

5.1.4.  Sweaters Producers Association

5.2.  The following Sectoral Associations shall directly become members of the Ethiopian Chamber of Commerce and Sectoral Associations Councils.

5.2.1.  The Ethiopian Sugar and Sweats Manufacturing Association

5.2.2.  The Ethiopian Textiles and Garment Manufacturing Association

5.2.3.  The Ethiopian Leather, Shoes and Leather Product Manufacturing Association

5.2.4.  The Ethiopian Meat Exporters Association

5.2.5.  The Ethiopian Vegetable, Fruit and Flower Producers Association

5.2.6.  Ethiopian grain , oil seed and spices producers and exporters

5.3.  The Office of the Ministry, subject to what has been stipulated in sub article 5.2 above, can decide to make some Sectoral Associations that are organized nationally, by taking into consideration the role they play in interconnecting the Agricultural and Industrial Sectors of our Country, in generating employment opportunities for citizens, in generating foreign exchange by expanding exports, and in general the role they play in the economic activity of our country become directly members of the chambers of commerce in Ethiopia and Sectoral Associations Council.

Article 6: The Criteria that Sectoral Associations and Councils should fulfill for Establishment.

The Sectoral Associations and Sectroral Associations Councils are organized in accordance with the stipulation made for Associations, in the Civil Code No 404-482.

6.1 Sectoral associations and sectoral association councils are estasblished under Ethiopian law No 404 up to 482 as per this regulation and

Article 7: Conditions under which Sectoral Associations Obtain Legal Personality

7.1  The Sectoral Associations which are organized nationally will be registered with the Ministry of Trade and Industry and shall receive legal personality there of.

7.2  The Sectoral Associations which are organized at the Regional and Woreda level will be registered with the concerned Regional Bureaus and will receive legal personality there of.

Article 8: Condition under which Sectoral Associations Councils Obtain Legal Personality

8.1 The Sectoral Associations Councils which are organized nationally will be registered with the Ministry of Trade and Industry and shall receive legal personality there of.

8.2 The Sectoral Associations Councils which are organized at the Regional and Woreda level will be registered with the concerned Regional Bureaus and will receive legal personality there of.

Article 9: Concerning the Issuance of Certificate of Legal Personality.

The Ministry of Trade and Industry, or the concerned Regional Bureaus shall issue a certificate of legal personality to the Sectoral Associations and Sectoral Associations Councils they register.

Article 10: Concerning the registration of chamber and sectoral associations.

Article 11: Concerning the Amendment of the Directive

The Office of the Ministry can amend this directive at any time.

Article 12: The Scope of Applicability and the Duration of the Directive

12.1  This Directive will be applicable up on councils and Sectoral Associations which will be organized at any level in accordance with the Chamber of Commerce and Sectoral Associations Councils Proclamation No 341/2004.

12.2  This directive will be valid starting from April 23rd 2004.
