CALL TO ORDER

EXECUTIVE SESSION

The motion was made and passed to go into Executive Session pursuant to Virginia Code, 2.2-3711-A (15), for the purpose of conducting Next Friend reviews. Members present were Bobby Montgomery, Sue Douthat, Shannon Slaughter, and Michael Williams. Also present were Horizon Behavioral Health’s representative Chonita Williams, as well as Dolores Kee, Hazel West, and the consumer.

Present for 2 Next Friend requests were Horizon Behavioral Health’s representative Robin Buzzard; Sylvia Hobson; Sheron Colston; and the 2 consumers. The Committee determined that Ms. Colston cannot be Next Friend because she actually is an employee of HBH.

Present for a Next Friend request were Horizon Behavioral Health’s representative Matilda Scott; Carrie Tomlin and Kaley Aragon from Links to Life; Ella Adams and the consumer.

Upon reconvening in public session, the Central Virginia Community Services Local Human Rights Committee unanimously certified that to the best of their knowledge only public business matters lawfully exempt from open meeting requirements and Virginia Code, 2.2-3711-A (15), the discussion of a Next Friend review, was discussed.

The motion was made and unanimously carried to appoint Ms. Kee and Ms. Adams as Next Friends for the above 2 individuals.

The motion was made and passed to go into Executive Session pursuant to Virginia Code, 2.2-3711 (15), for the purpose of discussing the restrictive treatment plans for individuals receiving service. This review necessarily involved discussion and consideration of mental and medical records excluded and information excluded from the Freedom of Information Act. Members present were Bobby Montgomery, Sue Douthat, Shannon Slaughter, and Michael Williams.

Wall representative Candice Bowman presented 4 plans. The Committee asked for a yearly update on the 1st plan. Vickie Frazier was also present for the 2nd plan; a yearly update was requested. Gayle Burford and Kara Scott, both also from Wall, joined Ms. Bowman for the 3rd presentation. Members gave several suggestions and asked them to return in 4 months to present an update. Ms. Russell and a consumer joined Ms. Bowman for the next presentation; an annual update was requested.

Wall representative Jenise Burford presented the next 3 plans. The Committee asked for a six-month update, a 4-month update, and an annual update for these.

Wall representative Rebecca Ledingham presented a plan, for which the Committee asked for a 4-month update.

DePaul representative Ryan Long presented plans for 8 consumers (the 9th consumer moved to Richmond after she sent in her plans). A quarterly update was requested for 4 plans and an annual update for 2 plans (1 individual has a quarterly update for part of his plan and an annual for the other part of his plan). One plan does not have to be heard again, and 2 were tabled until January, awaiting more information.

Lutheran Family Services’ representative Jamie Gagnon and DF discussed an issue with the Committee, which requested a 1-page annual update. The consumer was introduced, but then chose to leave the room.

Upon reconvening in public session, the Central Virginia Community Services Local Human Rights Committee unanimously certified that to the best of each Local Human Rights Committee member’s knowledge, only public business matters lawfully exempt from statutory open meeting requirements, and only public business matters identified in the motion to convene the Executive Session were discussed in the Executive Session.

The motion was made and unanimously carried to acknowledge the review and commentary of the restrictive treatment plans discussed in closed session.

INTRODUCTION OF NEW MEMBERS

Sue Douthat and Michael Williams were welcomed as new members to the Committee.

DRAFT MINUTES

The Committee unanimously passed a motion to approve the draft minutes from the July 14, 2015 and November 11, 2015 meetings, as written.

PUBLIC COMMENT TIME – Wall Residential is celebrating its 20th year and welcomes visitors on December 21 from 12 to 2 at their Madison Heights location.

SECURITY CAMERA POLICIES AND PROCEDURES for Cabaniss Consultants and Harmony, a division of Cabaniss Day Support

Ms. Cabaniss presented these policies and procedures and answered questions from members.

The motion was made and unanimously carried to accept Cabaniss’ Security Camera Policies and Procedures.

PROGRAM UPDATES

Anderson-serves 150, no complaints or allegations of abuse/neglect. The Arc of Central Virginia – serves a total of 83; no complaints or allegations of abuse/neglect. Bedford Adult Day – serves 22 ID, 50 overall, no peer-to-peer, no complaints or allegations of abuse/neglect. Blackberry Ridge has served 12 individuals since the last report, no complaints or allegations of abuse/neglect. Blue Ridge Behavioral Healthcare - in 2 homes serves 3 consumers, no changes, no complaints or allegations of abuse/neglect. Blue Ridge Residential – serves 45 in sponsored residential homes and 2 in-home, no complaints or allegations of abuse/neglect. Braley and Thompson – no services, no clients, no complaints or allegations of abuse/neglect. Cabaniss Consultants – serves 22 individuals in group and sponsored homes, no complaints or allegations of abuse/neglect. Harmony – their new Executive Director was introduced, serves about 35 individuals. Creative Family Solutions – serves more than 60, no program changes, no complaints or allegations of abuse/neglect. DePaul Community Resources – serves 98, 3 allegations pending. Dominion – serves 66, no complaints or allegations of abuse/neglect. Family Preservation – serves 189 in Farmville and 145 in Lynchburg, no program changes, no complaints or allegations of abuse/neglect. Foundation Stones – serves 8, annual license was renewed, no complaints or allegations of abuse/neglect. Genesis Manor – serves 7 individuals at 2 locations, 1 allegation of abuse unfounded, Westchester location was licensed, Knott St. location was closed Nov. 2. Hall Community Services – serves 4 individuals, no complaints or allegations of abuse/neglect. Harvest Outreach – serves 67, 5 peer-to-peer unfounded, no changes, no complaints or allegations of abuse/neglect. Heart Havens – serves 5 individuals, has 2 on hold, has new QA manager, no complaints or allegations of abuse/neglect. Horizon Behavioral Health – serves more than 7000, 3 cases of neglect and abuse – founded, 11 peer-to-peer – unfounded. Humankind - serves a total of 35, 1 citation for lack of documentation. Immanuel Residential – is waiting for Ms. Miles to come out and license her. Intercept – serves 50, Ms. Miles licensed CS and Crisis Intervention. JL Support – serves 53, moving to a different suite, no complaints or allegations of abuse/neglect. Jubilee – serves 6, approved for Day Treatment at Dunbar, no complaints or allegations of abuse/neglect. Landmark Haven – serves 2, has 1 opening, no complaints or allegations of abuse/neglect. Laury – serves 8, no program changes, no complaints or allegations of abuse/neglect. Lifeline – serves 9, no complaints or allegations of abuse/neglect. Links to Life – serves 12, 9 allegations of abuse, 1 founded med error. Living Water – serves 5 in intensive in-home, no complaints or allegations of abuse/neglect. Lutheran – serves 97, 2 allegation of neglect, unfounded; serves 65 in Southside, 1 founded allegation. Lynchburg Treatment Center – has 155 on daily census, received license renewal in September, no complaints or allegations of abuse/neglect. The Madeline Centre – serves a total of 128, no program changes, no complaints or allegations of abuse/neglect. McKinney’s Residential – serves 9 in 2 locations, has 2 sponsored homes with 1 individual in each, had unannounced visit from Ms. Miles. Mt. View – policies and procedures are still under review, submitted revision as requested. Otter River – serves 16 in Day Support, Ms. Miles recently came for unannounced visit, no citations, no complaints or allegations of abuse/neglect. Poindexter’s – serves 7 with 1 opening, Ms. Miles paid unannounced visit, corrective action plan submitted, no complaints or allegations of abuse/neglect. Rice – serves 8, no program changes, no complaints or allegations of abuse/neglect. Richland Homes – Ms. Miles visited on Nov. 30, no citations, no program changes, no complaints or allegations of abuse/neglect. Sisters Heavenly Homes – waiting for Ms. Miles to visit. Strategic – serves 176 in Lynchburg and Danville, no complaints or allegations of abuse/neglect. Support Services – serves 39, 2 neglect allegations pending. United and Empowered Care – serves 2 in sponsored home, no complaints or allegations of abuse/neglect. VP&J Services – serves 10, received a 1-year license, 1 allegation of verbal abuse founded and 1neglect (med error), in both cases the staff person was terminated. Wall – serves 153 with 20 openings; 2 abuse/neglect (1 peer-to-peer, 1 med error)- both unfounded; 2 complaints-1 unfounded. Wynne Adult Care – serves 8, Ms. Miles came unannounced, no problems cited. Youth and Family Counseling Services – serves 3 intensive in-home, no program changes, no complaints or allegations of abuse/neglect.
