Overview
EPA has defined and used the term “major” permittee in a number of aspects in the NPDES permitting, compliance monitoring and reporting, data sharing, and enforcement programs.
Major facility means any NPDES “facility or activity” classified as such by the Regional Administrator, or, in the case of “approved State programs,” the Regional Administrator in conjunction with the State Director. See 40 CFR 122.2
Through previous guidance EPA has established working definitions for POTW and non-municipal major facilities.[1]For POTWs, major facilities are those that have a design flow of one million gallons per day or greater or serve a population of 10,000 or more or cause significant water quality impacts.[2] Non-POTW discharges are classified as major facilities on the basis of the number of points accumulated using the NPDES Permit Rating Work Sheet.[3]
EPA generally allows both Regions and authorized NPDES programs to directly adjust the “Permit Major/Minor Status Indicator” data element as it more efficient for authorized NPDES programs to directly manage this data element. However, it is important to note that authorized NPDES programs will need to first coordinate with their Region beforethey make any changes to the “Permit Major/Minor Status Indicator” data element. This guidance is consistent with EPA regulations and past practice as the “major facility” designation is determined by the “Regional Administrator in conjunction with the State Director” [emphasis added]. This form can be used by EPA Regions and authorized NPDES program to ensure effective coordination on any changes to the “Permit Major/Minor Status Indicator” data element.
It is important to note that EPA Regional staff should verify the information in this form and send notice in a timely fashion to the authorized NPDES program if the EPA Region approves of the requested change to the “Permit Major/Minor Status Indicator” data element. Please also note that an authorized NPDES program must submit a change request form for each permittee that they would like to change the “Permit Major/Minor Status Indicator” data element.Authorized NPDES programs should also make any necessary updates for changes in ICIS-NPDES to the data elements that support this change request (e.g., “Permit Application Total Design Flow”).
EPA Regional staff should print out, sign, and scan each approved application and supporting documentation. The signed form should be stored by EPA Regional staff in accordance with EPA Records Schedule 1044 (Compliance and Enforcement - Item d: Short-term compliance and enforcement records).[4]Signed paper copies should be organized and stored for a minimum of five years. EPA Regional staff may dispose of the paper copies of the documents after five years in accordance with EPA Records Schedule 1044.Scanned forms and supporting documents should be stored by EPA Regional staff for easy retrieval.
Information to Accompany All Requests
The following information must accompany all requests to change the “Permit Major/Minor Status Indicator” data element.
- For POTWs: The “Permit Application Total Design Flow” (in millions of gallons per day) must be provided on the form.
- For Non-POTWs and Federal Facilities: Therating score from the “New NPDES Non-Municipal Permit Rating System” worksheet must be provided on this form for non-POTWs (i.e., “FACILITY_TYPE_INDICATOR” is “NON-POTW” or “FEDERAL” in the “ICIS_PERMIT” table in ICIS-NPDES).This score should include any points added by the authorized NPDES program for “discretionary majors.”
Authorized NPDES programs should also confirm the current facility status of the permittee (i.e., POTW, NON-POTW, or FEDERAL) as well as the requested date for making the change to Permit Major/Minor Status Indicator. The Region should review and verify that all relevant information in ICIS-NPDES for this facility is accurate and consistent with the NPDES Electronic Reporting Rule (see Appendix A).
Supplemental Information
This form includes an open field for authorized NPDES programs to provide any additional information that would help EPA Regional staff assess the requested change to the permittee’s Permit Major/Minor Status Indicator. This information may include the authorized NPDES program’s assessment of the current compliance status and the corresponding compliance status in ICIS-NPDES. This open field can be used to describe any data corrections or updates make in ICIS-NPDES for this permittee.
