INTRODUCTION

The authority for the Federal Communications Commission to impose and collect fees and associated charges is contained in Title III, § 3001 of the Omnibus Budget Reconciliation Act of 1989 (Public Law 101-39),§8, revising47U.S.C.§158,whichdirectstheCommissiontoprescribechargesforcertaintypesofservices it providestocommunicationsentitiesoverwhichithasjurisdiction.

This Fee Filing Guide is considered a reference guide to identify and describe the entire fee filing requirements fortheWirelessTelecommunicationsBureau. Itismeanttobe ahandyreferenceoftheservicesandrequests forFCCactionsthataresubjecttoafee. Theguidecontainsabreakdownofthetypesofapplications,form numbers,feeamounts,paymenttypecodes,andthemailingaddressforeachserviceprovided.

FILING INFORMATION

IfyouwishtoconductbusinesswiththeFCC,youneedanFCCRegistrationnumber(FRN). Thisnumberis mandatoryforafilingandusedtouniquely identify you in all transactions with the FCC. Itisimportantto have the FRN available when contacting or submitting documents to the FCC.Unless the payer and the applicantarethesamepersonorentity,aseparateFRNnumbermustbeusedfor thepayerandforthe applicant.  OnlinePayment -Online credit card payments are encouraged. Online credit card payment is an available option when filing electronic application submissions.  PayFees-IndividualULSapplicantswhohavealreadysubmittedapplicationsearlierbutdidnotpaywhilefilingcanusePayFees.Visit Pay Feesunder the ‘Quick Links’. For ULS users who submit a large volume of applications for wirelesslicensesusing ElectronicBatchFiling(EBF),PayFeesenablesyoutopayyourfees online by credit card and submit FCC 159 applications simultaneously. The Commission will accept Visa, MasterCard, American Express, and Discover credit cards. The applicant must remit payment within 10 calendar days of submitting the application, or the application willbedismissed. Paymentreceived morethan ten (10) days afterelectronicfilingof an applicationonaBureau/Officeelectronicfilingsystem(e.g.,ULS)willbeforfeited(see

§§1.934and1.1111).

 Formofpayment: Per § 1.1112 (a)of the Commission’s rules, the form of paymentof annualandmultipleyearregulatoryfeesmustbepaidelectronicallyasdescribedinSection

1.1112(e).1 Feepayments,otherthanannualandmultipleyearregulatoryfeepayments, shouldbeintheformofacheck,cashier’scheck,ormoneyorderdenominatedinU.S.dollars

and drawn on a United States financial institution and made payable to the Federal

FormofPaymentforAnnualandMultipleYearRegulatoryFees: Per§1.1158of the Commission’s rules, any annual and multiple year regulatory fee payment must be submittedbyonlineAutomaticClearingHouse(ACH)payment,online Visa,MasterCard, American Express, or Discover credit card payment, or wire transfer payment denominated in U.S. dollars and drawn on a United States financial institution and made payable to the Federal Communications Commission. No other credit card is acceptable. Any other form of payment for annual and multiple year regulatory fees (e.g., paper checks, cash) will be rejected and sent back to the payor. The Commission will not be responsible for cash, under any circumstances, sent through the mail.

Payment of fees, fines, and other debts may also be made by electronic payment. There are two types of electronic paymentsavailable.Thefirsttypeisdesignedspecifically forlargercorporations capable of CPU/CPUcommunication.Underthismethod, the payerbankwiresfundsdirectly tothe Commission's lockbox bank.As with cash payments, the funds must be wired from a U.S. financial institution. The second type is designed for smaller businessesand individuals.Under this method, the lockbox bank is given authority to withdraw funds from the customer's bank account. Authorization can be transmitted by a

REMITTANCE ADVICE -FCC 159

The Remittance Advice, FCC 159, must accompany payment to the Federal Communications Commission for

ApplicationProcessingFees,Fines,Forfeitures,FreedomofInformationAct(FOIA)billingsoranyother debtduetotheFCC. Theinformationonthisformiscollectedandstoredinadatabasetoensurecreditof full payment of monies due, to expedite any refunds due, and to service public inquiries. Please refer to this guideforspecificformrequirements. Reproducedformsareacceptable.FCC159Cisaremittanceadvice continuationsheetthatmustbeusedwhenpayingformorethantwocallsignsinasinglefilingorwhen paying for multiple applicants in a single filing. DEBT COLLECTION IMPROVEMENT ACT

In accordance with the Debt Collection Improvement Act (DCIA), the Commission will withhold action on applications and other requests for benefits upon discovery that the entity applying for or seeking benefitsisdelinquentinitsnon-taxdebts owed totheCommission, and dismiss such applicationsor requestsifthedelinquentdebtisnotresolved. The Commission’s applicationfeerules have been amended to state that if payment of the delinquent debt is not made or satisfactory arrangements for paymentarenotmade,wewillwithholdactiononapplicationsandotherrequests.

FEE EXEMPT APPLICATIONS

Please check the appropriate block on your application and provide the proper documentation, as required, to certifythatyourapplicationisfeeexempt. 47CFR,Part1,§1.1116oftheCommission'srulesexplainswho

MANAGING DIRECTOR DECISIONS

Requests for waivers, fee determinations, reconsiderations, applications for review, deferments, and specific refundrequestsarereferreddirectlytotheOfficeoftheManagingDirector. Eachrequestisforwardedtothe

Therequiredfilingfeemustbepaidfortheservicerequestedusingthenormalprocess. Allrequestsfor

REFUND PROCESS

ULS is an integrateddatabase and automatedprocessing system which will support electronicfiling of applicationsand otherfilingsassociatedwithapplications(i.e.amendments, waiver requests,transfersandassignmentsoflicenses,leases, licensee ownership information, etc.), collection of licensing information and public access to such information. Upon submittingapplicationselectronicallyviaULS, theapplicantreceivesaconfirmationof thefee(s)due(ifany)for the applicationandisinstructedtoeitherpayon-linecreditcardorprintFCC159directlyfromULS. Ifnotpayingonline immediately,theapplicantmaywithin10calendardaysofthefiling,utilizethe PAYFEESoptionat If electronicfilingis not available to the applicant and is not required to file electronically, the filing may be submitted manually along with FCC 159 and the appropriate fee and submitted to the appropriate address providedinthisguide.
