HIWP THE SALE OF CHAMETZ 5775/2015 [Check if travelling to East of NY (Europe, Israel…) ]

Any chametz that can neither be consumed nor disposed of before Pesach may be sold in advance to a non-Jew through the Rabbi (mechirat chametz). This may certainly be done for the chametz in pots and pans not being used on Pesach, so that they will not need to be scrubbed, or for benchers you won’t be using; simply set them aside with the other chametz being sold. A contract of sale/power of attorney form for this sale is attached below, where more explanation of the process can be found. After Passover, the gentile who purchases usually sells it back to its original owner.

Please note: The mitzvah of ridding ourselves of chametz was intended to have us go through a process of doing just that. One should not carelessly purchase chametz close to Passover having in mind that it will be sold along with the other chametz. In addition, bread, pasta products, cookies, etc – chametz b’ein – should preferably be used up or given away instead of being sold, unless you have a significant amount of said products. We sponsor a food drive, which enables you to give your chametz to the Gentile poor.

If you will be away for the entire week of Passover, you might want to arrange an early mechirat chametz to free yourself of some of the bedikat chametz obligations. Please speak with the rabbi.

Power of Attorney for the Sale of Chametz

I, the undersigned, do hereby fully empower and authorize Rabbi Chaim Marder of White Plains, NY, or his representative, to sell and transfer all legal title of all the following items of property possessed by me, at the time that he determines (in advance of Passover 2015), to anyone of his choice:

1)All products made of either barley, oats, wheat, rye, or spelt which are chametz according to Jewish law and/or tradition

2)All products containing any mixture or derivative of the grains described above which are chametz.

3)All items which have been prepared together with chametz.

4)Any and all items of property which Jewish Law declares may not be owned by member of the Jewish Faith during Passover.

5)Al items about which there is un-resolvable doubt as to whether they fall into the above categories.

These items include, although not exclusively, the following: Groceries; Liquor; Medicines; Toiletries; stock in corporation dealing in chametz.

The rabbi has full right to sell, dispose, and conduct all transactions, including rental of the place where the chametz is stored and rental of the right of way as he deems fit and proper. The purchaser will have free access to the chametz he acquires, and to the storage area in my possession that he will rent.

This document, when accompanied by the full bill of sale and rental shall be considered as the bill of sale itself, with all of the conditions and clauses that are enumerated in the full bill of sale.
