RESOLUTION 2016-S-195- (Corrected CBJ Tax Appeal)

CORRECTED CBJ TAX APPEAL

WHEREAS, a successful County Tax Appeal Judgement was issued to Mr. Edward P Jr and Daphne H Papaila, owner of record of Block 82.02 Lot 43 Qualifier C00SW, AKA 146 83rd Street South West Unit; and

WHEREAS, the Tax Collector received duplicate Judgements from the Tax Assessor and The Law Office of Michael A. Vespasiano; and

WHEREAS, the Tax Collector posted the adjusted taxes twice; and

WHEREAS, upon the recommendation of the auditor a corrected tax bill was issued with a 25-day grace period in accordance with NJSA 54:4-64; and

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stone Harbor, in the County of Cape May and State of New Jersey that a 25-day grace period was granted under the provisions of NJSA 54:4-64 for the 4th Quarter Tax installment on Block 82.02 Lot 43 Qualifier C00SW; and

BE IT FURTHER RESOLVED that the Tax Collector make the proper adjustment in her records.

RESOLUTION 2016-S-196– (Open Space Application – Bike Path)

Authorizing the Mayor to Sign

The Cape May County Open Space Special Funding Round Application

WHEREAS, the Cape May County Open Space Program has funds available to purchase open space and various other development activities throughout Cape May County; and

WHEREAS, the Borough of Stone Harbor wishes to submit an Open Space Program Special Funding Round Application to this program for funding a Bikeway Initiative.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stone Harbor in the County of Cape May and State of New Jersey that the Mayor, Suzanne M. Walters be and hereby is authorized to sign the attached CMC Open Space Special Funding Round Application on this 6th day of December, 2016.

RESOLUTION 2016-S-197– (Reimburse Fire/Zoning Inspection Fees)

WHEREAS, Ferguson Deckert Realtors submitted a Fire ($50.00) and Zoning ($50.00) inspections fees totaling $100.00 to the Borough; and

WHEREAS, were not required since this property is being demolished and does not need inspections; and

WHEREAS, the Zoning Officer has requested and approved the return of the fee.

RESOLUTION 2016-S-198 (Mayor to sign State Aid Agreement Shore Protection )

AUTHORIZING THE MAYOR TO EXECUTE A STATE AID AGREEMENT FOR SHORE PROTECTION PROJECT #6036-SH-R3-16

WHEREAS, the New Jersey Department of Environmental Protection will soon commence a Shore Protection Project from Townsends Inlet to Cape May Inlet and cost sharing requirements are applicable to the Project and have been stated in the Agreement; and

WHEREAS, the Borough has been presented with the attached State Aid Agreement, listing 23 paragraphs outlining the work to be performed and the breakdown of the costs associated therewith including Appendix B, Cost Sharing Analysis, which shows the Borough of Stone Harbor Estimated Cost Sharing to be $787,977.31; and

WHEREAS, the New Jersey Department of Environmental Protection has authority to act in this matter, and to include the Borough as a participant in this matter, pursuant to N.J.S.A. 12:6A-1 et seq; and

WHEREAS, the Chief Financial Officer has determined that sufficient funds are available to commit the Borough to this project, as evidence by the Chief Financial Officer’s Certification attached hereto.

NOW, THEREFORE, BE IT RESOLVED on this 6th day of December, 2016 by the Borough Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey that the Mayor and Clerk are hereby authorized to execute on behalf of the Borough the aforementioned and attached State Aid Agreement between The Department of Environmental Protection and the Borough of Stone Harbor for Construction of the Townsends Inlet to Cape May Inlet, New Jersey Shore Protection Project Third Partial Renourishment Cycle Project Number 6036-SH-R3-16.

RESOLUTION 2016-S-199 – (Approve Change Order #4 Asphalt Paving )

WHEREAS, the Borough of Stone Harbor is currently under contract with Asphalt Paving Systems Inc., P.O. Box 530, Hammonton, N.J. 08037 for 2015 NJEIT Program Outfall elimination Phase 3; and

WHEREAS, it is the recommendation of the Borough’s Engineer, Remington, Vernick & Walberg Engineers, to authorize Change Order No. 4 – reason for change – Addition of 90th and 91st Street Ends, First Avenue (from 92nd to 89th) and the intersection of First Avenue and 111th Street, at the request of the Borough.

Installation of Underground Conduit per Request of City,

As Built Adjustments $514,022.92

New Contract Change this Change Order $553,022.92

Original Contract Amount $4,115,800.00

NOW, THEREFORE, BE IT RESOLVED, this 6th day of December, 2016 by the Borough Council of the Borough of Stone Harbor, in the County of Cape May, and the State of New Jersey, that the preamble of this Resolution is hereby incorporated by reference and that the aforementioned Change Order No. 4 be and hereby is authorized;

BE IT FURTHER RESOLVED that the Mayor and the Borough Clerk be and hereby are authorized to execute Change Order No. 4 to increase the contract value of $ $553,022.92 for an amended contract amount of $ 4,683,401.92.

DISCUSSION

Councilmember Kramar reminded everyone that recycling cannot be in plastic bags. When recycling goes in the cans for pickup it must be dumped without bags, and washed.

Mayor Walters reminded everyone of the Tree Lighting tomorrow at 6, Caroling on trolleys at 4:45.
