Terms & Conditions for Fast Broadband Internet Service

1)The Service: The Logie Broadband Project provides a broadband wireless local area network for the Logie Community as defined by the Logie Community Council Area. Subscribers outside of this area may be provided with a service where practicable and at the discretion of the Project Group.

2)Speed.Subscribers should expect speeds of up to 20 Mbps. If the connection to computers within the premises is made by an internal wireless link a lower speed may be obtained. The Logie wireless network is shared by all the subscribers and the speed obtained depends on the number of subscribers using it at any one time. This is known as the contention ratio.

3)Connection Costs: The connection charge is £120, payable by cheque at the time of connection. This includes the provision of the wireless receiver/transmitter (Nanostation) and a local router. There may be other costs for cable etc depending on the premises. The local router in the premises provides connections to a computer by Ethernet cable or by wireless. It is suitable for operation with wireless only devices such as an iPad.In some buildings it may be necessary to have a wireless repeater and these are available at low cost from various suppliers. The Nanostation and the router will be the property of the Subscriber and if lost or damaged must be replaced by the Subscriber to continue using the service.
Limited assistance with installation will be provided, but safe mounting of the Nanostation and any cable routes inside the premises are the responsibility of the subscriber. If it is necessary to mount the Nanostation externally the project group can suggest local tradesmen or roofers who will provide this service.

4)Subscription: Subscription to the service (currently £18.00 per calendar month) is payable annually in advance at £206 which is a discount of 5%.

All subscriptions are paid by cheque or BACSand are due annually on the 1st April. For new connections the charge will be levied pro-rata from the first day of the month following the date of connection.

Alteration to Subscription: Logie Broadband Project will review costs and charges from time to time and will give three months notice of any changes.

Termination by Subscriber: Subscribers are required to give one month’s notice to terminate their service. Refunds will not be provided for any remaining period of the contract year. There is a minimum initial contract period of one year.

5)Suspension or Termination by Project Group: The service to an individual subscriber may be suspended immediately and without notice if evidence is presented of misuse in any of the following ways:

a)Use without payment

b)Fraudulent use, or use in connection with a criminal offence

c)Transfer of any material that is obscene, indecent, offensive, menacing, abusive, or defamatory

d)Transfer of any material in breach of copyright, privacy or other rights

e)Sending unsolicited advertising or promotional material (known as ‘spam’)

f)Sending any material that may damage data, software or hardware (known as viruses)

6)Usage Limits: bandwidth usage will be monitored and a fair usage policy applies. Any excessive usage may involve an increased subscription.

7)Reconnection: In the event that the service is disconnected for reasons of misuse or non payment as described above, there will be a reconnection charge of £25.

8)Faults and Maintenance:The service cannot be guaranteed, but the Project Group will make best efforts to ensure that faults on its own network or on the supplier networks are rectified as soon as possible. As far as possible, notice will be given if any maintenance work will result in temporary loss of service. Business users should retain their BT aDSL line and ensure that they have aswitch over mechanism that they can operate for themselves if the Logie service should not be operational.

9)Limitations: Logie Fast Broadband cannot provide a general PC support service. The support to subscribers will be limited to verifying that the Logie Broadband wireless link to premises is operating correctly.

10)Compensation Policy: No compensation will be provided for any temporary loss of service.

11)Liability:

a)The Project Group will accept no responsibility for goods, services, information, software, or other materials obtained when using the Logie Fast Broadband connection to the Internet.

b)The Project Group has no liability of any sort for the acts or omissions of other providers of telecommunication services or for faults or failures of their networks and equipment.

c)The Project Group has no liability for any loss of revenue or reputation due to faults or loss of service.

12)Force Majeure: If either party is unable to perform any obligation under this Agreement due to circumstances beyond their reasonable control (including but not in any way limited to lightning, flood, severe weather, fire, explosion, war, civil disorder, industrial disputes) they will have no liability to the other for that failure to perform.

13)This Agreement is made under Scottish Law.
