General Provisions

PennStateErie'sTrafficandParkingRegulationsaredesignedtoaccomplishthesethreeobjectives:

  • Toprovidefortheefficientuseofparkingspaceandtheorderlyflowoftraffic
  • Toprotectthesafetyandsecurityofpersonsandproperty
  • Toensureconsistentandfairrepresentationoftheneedsoftheentirecampuscommunity

AllprovisionsoftheVehicleCodeoftheCommonwealthofPennsylvaniamustbeenforced.Provisionsoftheseregulationsareineffectatalltimes,unlessotherwiseannounced.

Allvehiclesaresubjecttotheseregulations.Theoperatorisresponsibleforknowingtheregulationsandforinformingotherswhooperatevehiclesoncampusonhisorherbehalf.Anyparkingviolations,regardlessofwhoisdriving,shallbetheresponsibilityoftheregistrant.

Students,whethertheyresideonoroffcampus,andfacultyandstaffmembersmustregistertheirvehicleswiththePennStateBehrendPoliceServicesOfficeiftheirvehicleswillbedrivenorparkedoncampusatanytime.VisitorstocampusarerequiredtoobtainaguestpassfromPoliceServices,priortodrivingorparkingtheirvehiclesoncampus.

Eachparkingpermitisregisteredtoaperson,nothisorhervehicle.Onlyonemotorvehiclecanbeusedoncampusinconjunctionwiththeparkingpermitatanygiventime.

Regulations

Traffic and Parking Regulations are enforced twenty-four hours aday.

ThePennsylvaniaAdministrativeCode,Section2416(a)allowsPennStateBehrendtohavecampuspoliceofficerswhomaypossessandexerciseallthepowersofapoliceofficerinthisCommonwealthinanduponthepropertyofthecollege.

Section6113(b)oftheVehicleCodeoftheCommonwealthofPennsylvaniapermitsPennStateBehrendtocontrolpublictravelinanduponitspropertywithtrafficcontroldevices.

Section6109oftheVehicleCodeoftheCommonwealthofPennsylvaniaprovidesfortheelectedofficialsofauniversityorcollegetoestablishrulesandregulationsconcerningtraffic-controlandparking.

AsindicatedinSection6109(b)theelectedofficialsofauniversityorcollegecanappointsomeonetoreviewallrequestsfortraffic-controldevicesandthenadoptappropriateordinancesfortherequiredtraffic-controldevices.

AgeneraltrafficordinancecanbeapprovedbytheelectedofficialsofauniversityorcollegegivingfullauthoritytoanindividualsuchastheManagerofPoliceServicesoracommissionauthorizingoneortheothertoapprovetheerectionsofspecifictrafficcontroldevices.

Jurisdictionforenforcingalltraffic,vehicleregistrations,paymentoffines,andtrafficcommitteebusinessshallbeunderthedirectionoftheManagerofPoliceServices,PennStateBehrend.

AppealsofparkingviolationsshallbeunderthejurisdictionoftheappropriateStudentorFaculty/StaffAppealsBoard.

AnappointedTrafficCommitteeshallreviewtherulesandregulationsandexistingconditions,andmakerecommendationstoPennStateBehrendconcerninggeneraltrafficordinances.

Affiliate:AnypersonwhohasbeenissuedaPennStateAffiliateIDcard.

AuthorizedVehicle

  • AnyvehicledesignatedassuchbydefinitionintheVehicleCodeoftheCommonwealthofPennsylvania.
  • AnyvehicledesignatedassuchbytheTrafficCommittee.

CommuterStudents:AllpersonsenrolledinformalorinformalinstructionalprogramsoftheUniversitywhodonotresideoncampus.

CommuterParkingLots:Thoseparkingareasthatarerestrictedforusebycommuterstudents,andfacultyandstaffvehiclesduringreservedtimespans.

EmergencyVehicle:AnyvehicledesignatedassuchbydefinitionoftheVehicleCodeoftheCommonwealthofPennsylvania.

FacultyandStaff:Allpersonswhoarenotstudentsandareemployedfull-timeorpart-timeatPennStateBehrend.

ParkorParking

  • Whenpermitted,thetemporarystoringofavehicle,whetheroccupiedornot,offtheroadway.
  • Whenprohibited,thehaltingofavehicle,whetheroccupiedornot,exceptmomentarilyforthepurposeofandwhileactuallyengagedinloadingorunloadingpropertyofpassengers.

ParkingSpace:Anareadesignatedbylinesonanimprovedsurfacefortheparkingofonevehicle.

Pedestrians:Personsafootorpersonsinwheelchairs.

Permit:AninstrumentissuedbyTheOfficeofPoliceServicestoverifythattheoperatorofavehiclehasregisteredthevehicleandhaspaidthefeeforparking.

ResidentStudents:AllpersonsenrolledinformalorinformalinstructionalprogramsoftheUniversitywhoresideoncampus.

ResidentParkingLots:Thoseparkingareasthatarerestrictedforusebyresidentstudents,faculty,andstaffvehiclesduringreservedtimespans.

Roadway:Theentirewidthbetweentheboundarylinesofeverywaymaintainedwhenanypartthereofisopentothepublicforpurposesofvehiculartravel.

Shall:Indicatesthatanactionisrequired.

Sidewalk:Improvedareasdesignedspecificallyforpedestriantraffic.

StaffParkingLot:Parkingareasthatarerestrictedforusebyfacultyandstaffmembervehiclesduringreservedtimespans.

Suspension:TowithdrawregistrationprivilegestemporarilybyformalactionoftheUniversity.

Vehicle:Shallincludebicycles,automobiles,trucks,motorcycles,motorbikes,motorscooters,andanyothermotordrivenvehicle.Askateboardisnotconsideredavehiclebythisdefinition.

Visitor:AnypersononthegroundsofPennStateBehrendwhoisnotaBehrendStudent,facultymember,staffmember,oraffiliateofthecampus.

Walkway:Thoseareasspecificallydesignatedforpedestriantrafficonly.

300RegistrationofVehicles

Allmotorvehiclespossessed,maintained,oroperatedatPennStateBehrendbyanystudents,faculty,orstaffmembershallberegisteredwiththePoliceServicesOffice.Allregisteredvehiclesshallbearaparkingpermit,whichshallbehungfromtheinteriorrearviewmirror,indicatingtheareasinwhichthevehiclemaybeparked(i.e.commuter,resident,faculty/stafflots).

Parkingpermitscannotbesoldorloanedtoanotherperson.

  • Studentsemesterparkingpermitsmustbeobtainedbyregisteringon-line.TheparkingpermitwebpagecanbeaccessedthroughthePennState–Eriehomepage(CurrentStudentsandselectParking.Yourparkingfeewillbeplacedonyourstudentaccount.Yourparkingpermitwillbeavailableforpick-upatthePoliceServicesOffice(ErieHall).

Studentsshallregistertheirvehiclesforthesemesternolaterthanoneweekafterthestartofclasses.

AnypersonwhoreceivesaparkingticketfornotregisteringtheirvehicleandappearsatthePoliceServicesOfficewithinten(10)daysoftheviolationshallhavetheparkingticketreducedtoImproperDisplayifthey:

  • Immediatelyregistertheirvehicle
  • Haveonlyoneparkingticketfornon-registration.
  • Facultyandstaffmembersshallregistertheirvehiclewithinoneweekofthefirstdayoftheiremployment.
  • Students,faculty,andstaffmembersgenerallymayregisterthosevehiclesthatareownedbythemortheirimmediatefamilies,includingleasedandcompany-ownedvehicles.Toregisteravehiclenotownedbytheregistrant,thatpersonshallbring

withthemanotarizedstatementfromtheownerofthevehiclegivingpermissiontousethevehicleandregisteritwithPennStateBehrend.

  • Changesoflicenseplatenumber,name,address,ortelephonenumbershallbereportedtothePoliceServicesOfficewithinten(10)daysofsuchchange.
  • Aprovisionalparkingpermitmaybeissuedtostudents,facultyandstaffwhohavesufferedatemporaryphysicalinjury.Adoctor’sexcusestatingtheneedforthispermitisrequiredpriortoissuance.Theprovisionalparkingpermitallowsthedrivertoparkincommuterandresidentstudentparkinglots,theLowerReedlotandtheParkingDeck.Thisprovisionalpermitdoesnotallowthedrivertoparkinanyhandicappedparkingspace,inspacesmarkedastowawayzonesnortoviolateanyUniversityparkingregulations.Thispermitwillexpirethree(3)weeksfromthedateofissue.Shouldtheinjuryrequireadditionaltimetoheal,itisthedriver’sresponsibilitytoobtainatemporaryhandicappedparkingpermitfromPennDOT.Theprovisionalparkingpermitmaynotberenewed.Allstudents,facultyandstaffrequestingaprovisionalpermitmustpossessavalidPennStateBehrendparkingpermit.

301Permits

  • Permitsshallbedisplayedonanyvehicleoperatedbythepersontowhomthepermitwasissued
  • Permitsnotproperlydisplayedshallbedeemedinvalid.
  • Temporarypermitsarenottransferablefromonevehicletoanother.
  • Permitsshallbehungfromtheinteriorrearviewmirrorwithinthepermitnumbersfacingthefrontofthevehiclesothattheentirepermitnumberisclearlyvisible.
  • Bluepermitsareforresidentstudents.
  • Greenpermitsareforcommuterstudents.
  • Orangepermitsareforeveningcommutersstudents.
  • FacultyandStaffpermitsaredeterminedbytheemploymentstatusofthefacultyorstaffmember.
  • Permitsarehangingtagsassignedtotheregistrantandnotthevehicle.Thesepermitsmaybetransferredtoanothermotorvehiclebeingusedbytheregisteredstudentorfacultyorstaffmember.ThoseforgettingtotransfertheirpermitsshallobtainatemporarypermitfromthePoliceServicesOffice.
  • Motorcyclesorothermotorizedvehicles:contactTheOfficeofPoliceServicesforinformationastopermitdisplay.
  • StudentEveningPermits
  • Commuterstudentsmaypurchasesemestereveningparkingpermitsthatarevalidfrom4:00PMuntil6:00AM.Thesepermitsarevalidonlyinparkinglotsdesignatedforcommuterstudentparking.
  • TemporaryPermits
  • Studentsareissuedtemporarypermitsforaperiodnottoexceedtwoweeks.Eachpre-numberedpermitshalldesignatetheexpirationdateandtheareawherethevehicleshallbeparked.Thesepermitsaresoldatacostof$4.00perday.
  • FacultyandStafftemporarypermitsareavailableatthePoliceServicesOfficefor$4.00perday.
  • VisitorPermits
  • Visitorsarerequiredtodisplayapermit.VisitorPermitsmaybeobtainedfromthePoliceServicesOffice.ThereisnocostforaVisitorPermit.

302Costs

  • ThecostofstudentpermitsmaybeobtainedfromtheOfficeofPoliceServices.
  • FacultyandStaffPermits
  • Full-timefacultyandstaffpaybythemonthtoregistereachmotorvehiclethatwillbepresentoncampus.
  • Bi-weekly/wagepayrollemployeespaybythenumberofhourstheyworkduringaweek.ContactthePoliceServicesOfficeforthecurrentpricestructure.
  • ReplacementPermits
  • Studentsshallpayaprocessingfeeof$25.00foreachpermitreissuedasareplacementforalostorstolenpermit.
  • FacultyandStaffmembersandaffiliatesshallpayaprocessingfeeof

$25.00foreachpermitreissuedasareplacementforalostorstolenpermit.

Purpose:

TheaboveprovisionshavebeenenactedtoensurethateachmotorvehicleatPennStateBehrenddisplaysacurrentparkingpermit.Incaseswheremultiplevehiclesarecoveredunderoneregistration,onlyonevehiclemaybepresentoncampusatagiventime.

303StateRegistration,Insurance,andOperatorLicense

AllmotorvehiclesonPennStateBehrendpropertyshallbeproperlyregisteredwiththeappropriatestate.

Proofofcurrentstateregistrationandavalidoperator'slicensefortheindividualwhowillbedrivingthevehicleshallbeprovidedatthetimeofregistration.

Expiration,revocation,orsuspensionofstateregistration,operator'slicense,orinsuranceautomaticallyinvalidatesthePennStateBehrendmotorvehicleregistration.ItshallbetheresponsibilityoftheregisteredindividualtonotifythePoliceServicesOfficeofallexpirations,revocations,orsuspensions.

304Liability

ThePennsylvaniaStateUniversityassumesnoresponsibilityorliabilityforlossordamagetoanymotorvehicleparkedonPennStateBehrendproperty.

305CivilContract

Allstudents,faculty,andstaffofPennStateBehrendwhoregistertheirmotorvehiclesaresignifyingtheiragreementwiththePennsylvaniaStateUniversity'scivilcontractpolicy.

Thiscontractpermitsunpaidpenaltiesforparkingviolationstobeplacedonthestudent'sbillordeductedfromthefacultyorstaffmember'spayintheamountoftheappropriatefineplusa$3.00processingfee.

Innoinstanceshalladeductionbemadewithoutfirstattemptingtocontactthestudent,faculty,orstaffmemberorbye-mailorletterwithintendaysofthedateoftheviolation.

ThiscivilcontractdoesnotpreventtheissuanceofaCommonwealthofPennsylvaniatrafficcitationfrombeingissued.

306Refunds

  • Refundsforparkingpermitsshallbegrantedonaproratedbasis.
  • Theamountoftherefundisdeterminedbythepricepaidfortheparkingpermit.TherefundpricemaybeobtainedbycontactingTheOfficeofPoliceServicesduringnormalbusinesshours.
  • Theparkingpermitsshallbereturnedinordertoreceivearefund.
  • Norefundsontemporaryorsummerparkingpermits.

400Towing

TheUniversityreservestherighttotowanyillegallyparkedvehicleattheriskandexpenseoftheowner.

401PennsylvaniaStateLaw

Section3353(c)oftheVehicleCodestates,inpart,"Propertyownermayremovevehicle.Theownerorotherpersoninchargeofpossessionofanypropertyonwhichavehicleisparkedorleftunattendedinviolationoftheprovisionsofsubsection(b)mayremoveorhaveremovedthevehicleatthereasonableexpenseoftheownerofthevehicle.Suchpersonwhoremovesavehicleleftparkedorunattendedinviolationoftheprovisionsofsubsection(b)shallhavealienagainsttheownerofthevehicle..."

402Procedure

  • Anyvehicleparkedorleftunattendedinamannerthatconstitutesatrafficand/orsafetyhazard,parkedonorisblockingasidewalk,isparkedinaspacethatisreservedona24-hourbasis,whoseparkingpermitissuspended,orisparkedinanylocationwherenoticeisgiven,shallbetowedimmediately,withoutpriornoticeoftheowner.
  • Exceptforsectiononeabove,beforeavehicleistowed,areasonableattempt(includingsigns,verbalorwrittennotices)shallbemadetocontacttheowner.
  • Iftheowneroroperatorofavehiclecannotbecontacted,thevehiclewillberemovedbyUniversityattheowner'sexpense.
  • Ifavehicleistowed,theownerorpersonhavingcontrolshallbenotifiedbye-mailortelephonewithintwenty-four(24)hoursofthetowingiftheyhavenotbeenincontactwiththetowingserviceprovider.
  • Towingchargesshallbethosesetforthbythetowingagent,andtheownershallberesponsibleforthetowingcharges.

403DisabledVehicles

Asacourtesytoothermembersofthecommunity,driverswhosevehiclesareinoperableshallimmediatelynotifytheOfficeofPoliceServices.

404SuspendedVehicles

Whenparkedoncampus,ownerswhohavehadtheirparkingpermitssuspendedwillhavetheirvehiclestowedwithoutpriornotice.

500ParkingViolations

1.UnregisteredVehicle(A)

Anystudent,faculty,orstaffmemberwhoisfoundtopossess,maintain,oroperateavehiclethatisrequiredbytheseregulationstoberegisteredwhileonthegroundsofPennStateBehrend,andwhohasfailedtoregisterthevehiclewiththeproperauthority,commitsaviolationoftheseregulations.

2.ParkedonSidewalkorWalkway(B)

Nopersonshalloperateanymotorvehicle(exceptthoseoperatingemergencyorauthorizedvehiclesintheperformanceoftheirduties)uponanyareadesignatedasasidewalkorwalkway.

3.ParkingatYellowCurb(C)

Nopersonshallparkavehiclenexttoanycurbthatismarkedinyellow.

4.ParkingAlongRoadway(D)

NopersonshallparkavehicleontheroadwayoralongtheroadwayanywhereonthepropertyofPennStateBehrendunlessauthorizedsignspermittingparkinginaspecificareaareinplace.

5.NoParkingArea(E)

NopersonshallparkavehicleinanyplaceatPennStateBehrendotherthaninapprovedparkingspacesinparkinglots.Thissectionprohibitsparkingongrass,parkingtooclosetoanothervehicle,parkingwithinfifteenfeetoffirehydrants,blockingaparkedvehicle,blockinganaccessroad,orparkinginanyplacenotspecificallydesignatedforparking.

6.ParkinginLoadingZone(F)

Parkingshallbepermittedinareasthataredesignedtopostedasloadingareasprovidedthatthevehicleisintheactofeitherbeingloadedorunloaded.

7.ParkinginReservedSpace(G)

Nopersonshallparkavehicleinanyareadesignatedbysignorregulationtobereservedunlessthatareaisreservedspecificallyfortheiruse.Vehiclesfoundinviolationofthissectionaresubjecttobeingtowed.

8.ParkinginRestrictedArea(H)

Nopersonshallparkavehicleinanyareadesignatedbysignorregulationtoberestrictedunlessthatareaisrestrictedspecificallyfortheiruse.

9.ParkingOutsideofLines(I)

Allvehiclesthatareparkedinanapprovedparkinglotthatismarkedwithspacesshallbeparkedinsuchamannersothatnopartofthevehicleextendsoverthelinesdesignatingthespace.

10.DrivinginUnauthorizedAreas(J)

Nopersonshalloperateamotorvehicleonanytrails,accessroads,orinanyareanotdesignatedforpublictravelorinanyareaposted"foremergencyorauthorizedvehiclesonly."

11.PermitImproperlyDisplayedorCurrentPermitNotDisplayed(L)

Anypersonwhohasavalidpermitshalldisplaythepermitonhisorhervehicleasprescribedbytheserulesandregulations.

12.FailuretoReportChangeofLicense/Address(M)

Anypersonwhohasbeenissuedaparkingpermitandchangeshisorherlicenseplatenumber,name,oraddress,shallreportsuchchangetotheOfficeofPoliceServicewithinten(10)daysofsuchchange.

13.HandicapSpace(N)

NopersonshallparkavehicleinanyparkingspaceatPennStateBehrendthatispostedormarkedasahandicapspaceunlessheorshedisplaysahandicapplateorplacardissuedbyPennDOTandthevehicleisbeingoperatedbyorforthetransportationofahandicappedperson.

14.TimeLimitParkingSpaces(P)

Nopersonshallparkavehicleinaparkingspacedesignatedbysignsasalimitedtimeparkingspaceinexcessofthetimeallotted.

15.Lending/MisusingPermit(R)

Anyonewholendsormisusesthepermitissuedtohisorhervehicleshallbeinviolationoftheseregulations.

16.UsingaParkingPermitIssuedtoAnother(S)

Anyonewhousesaparkingpermitthathasbeenissuedtoanotherpersonshallbeinviolationtotheseregulations.

17.FraudulentUseofParkingPermit(T)

Anyonewhomanufactures,alters,orpossessesanunauthorizedparkingpermitsshallbeinviolationoftheseregulations.

18.SnowRestrictions(U)

FromNovember1sttoApril1stofeachyear,certainparkinglotswillbeclosedtoparkingfrommidnightto6:00AMforthepurposeofsnowremoval.Snowrestrictionsignswillbepostedattheentrancetotheselots.SnowrestrictionparkinglotsarealsonotedinSection701oftheParkingRulesandRegulations.

501HabitualOffenders

Anystudent,faculty,orstaffmemberwhoreceivesfive(5)parkingticketswithinonesemestershallbeadvisedinwritingofthePolicyonSuspensionofParkingPrivileges.

502SuspensionOfParkingPrivileges

Anystudent,faculty,orstaffmemberswhoreceivenine(9)parkingticketswithinonesemester,shallhavehisorherparkingprivilegessuspendedforaperiodofone(1)week.

  • AnypersonwhoparksavehicleatPennStateBehrendduringhisorhersuspension periodshallbeissuedaparkingticketforsuspendedparkingprivileges,andthe vehiclewillbetowedattheowner'sexpense.
  • A$25.00restorationfeewillbechargedtoregistervehicleswhosepermitshavebeensuspended.Thisisinadditiontothenormalchargeforregisteringavehicle.
  • Anysubsequentparkingviolationwithinthesamesemesterofasuspensionshallresultinanadditionalsuspensionofone(1)week.

503SeriousViolations

Violationsofaseriousnatureshallresultinthesuspensionofparkingprivilegesand,inaddition,mayresultintheissuanceofaCommonwealthofPennsylvaniaTrafficCitation/Summons.

504ContinuingViolation

Morethanoneparkingticket/citationmaybewrittenforthesame,continuingoffenseifthevehicleremainsparkedinviolationinexcessoftwenty-four(24)hours.Except,morethanoneticket/citationmaybewrittenforthesame,continuingoffenseifavehicleremainsinviolationoftimelimitparkingspacesinexcessofeight(8)hours.

505MovingViolations

AllmovingviolationsshallbechargedundertheappropriatesectionoftheVehicleCodeoftheCommonwealthofPennsylvania.

506Miscellaneous

  • Motorcycles,motorbikes,andmotorscootersshallbeparkedinspeciallydesignatedareas.
  • PennStateBehrendhasestablishedspecialparkingareasforvisitors.RegulationsregardingvisitorparkingareavailableattheOfficeofPoliceServices.Ifyouhavevisitors,pleasemakecertainthattheyareawareofthevisitorparkingregulationspriortotheirarrival.Itisalsorequiredthatallvisitorsobtainavisitorparkingpermit,atnocost,fromtheOfficeofPoliceServices.
  • Avehicleownedoroperatedbyastudentwhoisnotalsoanemployee,butismarriedtoanemployee,oristhesonordaughterofanemployee,shallbeconsideredasa"StudentVehicle."
  • AlltrafficaccidentsoccurringoncampusshallbereportedtothePoliceServicesOffice.
  • Incaseofanemergency,theemergencyflashersorheadlampsofthevehiclemustbeactivated.

600Exclusions

Emergency,maintenance,anddeliveryvehiclesdirectlyengagedintheperformanceoftheirassigneddutiesareexcludedfromparkingregulations.However,saidvehiclesshallnotbeoperatedorparkedinanymannerthatconstitutesasafetyhazard.

601Visitors

VisitorsarerequiredtoparkintheappropriatelotsasindicatedunderSection700.

Visitorsarerequiredtodisplayaparkingpermit.AvisitorpermitmaybeobtainedfromthePoliceServicesOfficelocatedinErieHall.Thereisnocostforavisitorpermit.

602Payment

Inallcasestheviolator'scopyoftheparkingticketshallbebroughttothePoliceServicesOfficewithinten(10)daysoftheviolations.

  • Allticketspaidwithinthreedaysshallhavethefinereducedby$2.00.
  • Ifthefineisnotpaidwithinten(10)days,therewillbeanadditional$3.00latefeeandaholdwillbeplacedontheviolator'stranscriptsandclassregistration.
  • Allunpaidticketsofstudentswillbebilledtothestudent’saccount.
  • AllunpaidticketsofFaculty/Staffwillbepayrolldeducted.

603Appeals

Allappealsshallbemadewithinseven(7)daysofthedateoftheissuance.AppealsmustbefiledonofficialformsobtainedfromtheOfficeofPoliceServices.Fullpaymentofyourparkingticketisrequiredatthetimetheappealisfiled.Paymentmustbemadeincash,bycheck,ormoneyorder.Allappealdecisionsarefinal.Iftheappealisdecidedinyourfavor,youwillreceivearefund.YouwillbenotifiedoftheAppealsCommitteedecisionbye-mail.

  • StudentappealswillbeforwardedtotheStudentAppealsBoard.Studentsmaybepresentwhentheirappealisheard.
