An ASUCD Senate Resolution in support of California Assembly Bill #889 (the California Domestic Workers Bill of Rights).

WHEREAS, there are over 200,000 domestic workers in the State of California, including many current and former students of the University of California, who serve as housekeepers, nannies, and caregivers in private homes; and,

WHEREAS, domestic workers have historically been exempted from laws governing the rights afforded to all other workers, such as decent wages, a safe and healthy workplace, workers’ compensation and other labor protections, and because of this are currently highly susceptible to exploitation by private employers; and,

WHEREAS, due to the nature of their professions, domestic workers are usually isolated and vulnerable to mistreatment and therefore require protection to prevent work abuse from occurring behind closed doors; and,

WHEREAS, many domestic workers must work around the clock, and may be forced to sacrifice their basic needs such as food and sleep to keep from losing their employment; and,

WHEREAS, the California Domestic Workers Bill of Rights seeks to remove the exclusion of domestic workers from rights provided to all other workers in California under Wage Order 15 including meal and rest breaks, overtime pay, reporting time pay and seeks to eliminate the current domestic worker specific exclusions to workers’ compensation therefore providing them with rights equal to all other workers in the state of California; and,

WHEREAS, this Bill also provides domestic workers with much needed industry-specific protections and standards including the right to eight hours of uninterrupted sleep time for live-in workers and those who work twenty-four hour shifts, and the use of kitchen facilities to cook and eat their own food, which is essential due to the diverse cultural backgrounds and dietary needs of domestic workers; and,

THEREFORE LET IT BE RESOLVED THAT, the Associated Students of the University of California, Davis (ASUCD) Senate stands firmly in support of the California Domestic Workers Bill of Rights and urges its passage in the California State Assembly; and,

THEREFORE LET IT BE FURTHER RESOLVED THAT, the ASUCD Senate supports any peaceful and lawfully gathered event on campus that would promote and bring awareness about this Bill, and;

THEREFORE LET IT BE FINALLY RESOLVED THAT, copies of this resolution shall be sent to California Governor Jerry Brown; California Lieutenant Governor Gavin Newsom; California Speaker of the Assembly John Pérez; Assembly Member Tom Ammaino; Assembly Member Mariko Yamada, UC Davis Chancellor Linda Katehi; UC Davis Assistant Vice Chancellor Griselda Castro; UC Davis Professor Dr. Robin Rodriguez; the UC Davis Student Recruitment and Retention Center; the UC Davis Cross Cultural Center; California Domestic Worker’s Coalition; Centro Labor de Graton; Coalition for Human Immigrant Rights of Los Angeles; Filipino Advocates for Justice; Instituto de Educación Popular del Sur de California; Mujeres Unidas y Activas; Pilipino Workers Center; People Organized to Win Employment Rights; San Francisco Day Labor Program; Women’s Collective of La Raza Centro Legal.
