2231.8 - 2231.8—1 - Updates the listing of forms needed for issuance of term grazing permits.

2231.8 - Waiver and Reissuance of Grazing Permits with Term Status Because of Changes in Ownership. Following are listed the forms needed for issuance of term grazing permits because of changes in ownership. All documents must be in the name of the permittee whether it be an individual, partnership, company or corporation.

*1.Two copies of form 2200-12, Waiver of Term Grazing Permit, properly witnessed and signed. Date of transaction in the third paragraph must be the same as the execution date of the deed, bill of sale, etc. If sale of livestock is involved, be sure the blank is filled in. The legal description of real estate must be the same as shown on the deed.

2.One copy of the executed and recorded deed or contract to purchase. If the transaction is based on sale of base ranch property these documents must include the deeded lands which have been confirmed as the base property.

3.Two copies of 2200.16, Application for Term grazing Permit, Section A, completed and signed by the permittee. All items must be completed. If an item, such as item 5 on reverse side is not applicable, the permittee should wither enter a dash (--) in the blank or "NA". The second copy of the application is to be given to the permittee at the time of completion without completion of Section B. The Range Staff then completes the recommendation and the Ranger approves the application.

4.One copy of the notarized bill of sale for any permitted livestock. If the transaction is based solely on the sale of livestock and the base property is not purchased, the new permit can be issued for no more than the number of permitted livestock purchased. (See FSH 2209.13 12.22). Where sale of livestock only is involved, the purchaser is required to furnish the cancelled check, receipt, or other clear proof of ownership.

5.One copy of the brand certificate, or if it is in the process of being transferred, one copy of the bill of sale for the brand. Copy of brand certificate must be furnished after issuance and must be in the permittee's name.

6.If there is an outstanding Escrow Waiver, one copy of the release of escrow waiver executed by the lender.

7.One copy of R3-2200-1, Annual Validation of Term Grazing permit, for the remainder of the current year (e.g., from approval date on permit to 2/28).

8.One copy of FS-2200-1, Refund, Credit or Transfer of Fees application, executed by the current permittee, if unused fees are to be transferred to new permittee (e.g., from approval date on new permit to 2/28).

9.One copy of R3-2200-6, List of Stockholders, completed by the permittee if other than individual.

10.One copy of Articles of Incorporation or partnership agreement. Filed with appropriate State office if it is a corporation.

11.One copy of R3-2200-59, Authorization for Permittee's Representative to Sign Grazing Application, (optional - only needed if the Permittee wishes to designate others to sign.

12.If desired by the mortgagee, four copies of completed 2200-13, Escrow Waiver, executed by the permittee and verified by the lender.

13.Two copies of the completed 2200-10, Term Grazing Permit, signed by the permittee and the District Officers. Form 2200-10 must have attached to each copy all the appropriate special provisions and requirements, the Range Improvement Inventory and Maintenance Report, the Allotment Management Plan, and the Range Improvement Map. All pages must be properly identified by page number, permit and permittee numbers, permittee name and allotment name.

14.A copy of letter of permit transmittal documenting the review of the permit clauses, management plan, allotment analysis, etc.

15.A copy of closeout letter to the previous permittee.

16.A copy of letter to the previous and/new holder of an escrow waiver as appropriate.

17.Other items to be checked:

(a) Are any special use permits involved?

(b) Are there any outstanding permit modifications for construction of

range improvements?

(c) Does the purchaser hold a grazing permit on the Prescott or another

Forest? If so, will the upper limit be exceeded upon recognition of the new

permit?

After issuance of the permit, a Grazing Permit Data Worksheet will need to be prepared and entered in the FSRAMIS data base.
