REVIEW AND ACCEPTANCE OF MINUTES

The June 17, 2017Meeting Minutes were reviewed for accuracy. A motion was made by Sherman Coxto approve the Minutes as written. The motion was seconded by Gary Pickett. The motion passed.

TREASURER’S REPORT

PROPERTY OWNERS ASSOCIATION

Jim Racek presented theJune 30, 2017 POA Financials. A motion was made by Sherman Cox to approve the Financials as presented. The motion was seconded by Margaret Worthington. The motion passed.

Richard asked about the $68.17 and $68.18 under Utilities should be changed to Roane Central which is water. He asked could this be one and the same? 270 Serenity is the club house which should only have one sewer bill. Before Richard leaves, he is going to look into this.

DOCK COMMITTEE

Jim Racek presented the June 30, 2017 Dock Committee Financials. A motion was made by Sherman Cox to approve the Financials as presented. The motion was seconded by Richard Crowton. The motion passed.

Motion to pay $5000 loan from the POA was made by Richard Crowton. It was seconded by Gary Pickett. The motion passed.

COLLECTION REPORT

Al-HASAN – 3 LOTS$9,083.49 / $9,687.49

Currently being treated for Cancer. Luke Durham is working with his Al-Hasan’s Agent.

The lien is in place, the attorney is in contact with the owner and trying to collect on all three lots.

Last Payment – 2/23/16 $150.00

Civil Summons has been filed

Mr. Al Hasan passed away in October, his wife appeared in court and agreed to pay $100.00 per month.

-Jim suggested that we just update the lien each year until she sells. Jim is going to look and make sure that the lots are paid in full so there is not a foreclosure.

- Richard suggested that the lawyer send a letter to her to strongly suggest that she put her lot up for sale or we will take her back to court.

Civil Summons issued.

Court date for judgment is in August, but working on a payment plan with the owner prior to court date.

Owner paid $450 and asked for 30-day extension 8-15-15 to get the rest of what is owed. Expiration of this extension was 9-15-15.

No Payments in December or January 2016

Court Case to obtain a Judgment on Friday January 15, 2016. Proposed a settlement which the Board declined.

He Requested a Trial which will be heard February 5, 2016.

The Association was granted a default judgment on the 10Samona lots (7 Owners) June 30, 2014. There are now 8Samona Lots as of 6/30/2017

Civil Summons has been filed.

LAWSUIT

  • LEXON sent First Set of Written Discovery (INTERROGATORIES) to Plaintiff (ROANE COUNTY) on October 30, 2015. Roden is working with Roane County to answer the Discovery questions.

The Court has put down a Scheduling Order for all sides to complete all discoveries and be prepared to go to trial in September of 2017.

Lexonhas agreed to Arbitration and it is scheduled for April 25, 2017 at 9:00 AM

Richard Crowton, Sherman Cox, and Bill Riden are attending.

The mediation was post-poned and there has been no update from Stan Roden. We are waiting on a new date.

Stan sent an email to Roane County asking why there was such a difference in the bids to repair to road.

-Richard Crowton brought to the boards attention that there was erosion damage to both sides of Docks at Caney Creek.

-Jim Racek suggested that we should file a class action lawsuit against the county since they hold the bond. We need the date that Roane County signed off on the roads and sewer system.

-Gary Pickett asked about the streets and who is responsible. Jim explained that the county has to accept the roads. In 35 years we will have to cap the roads.

CLUBHOUSE/POOL

-The line blew out on the Jacuzzi. Sherman Cox is going to fill the Jacuzzi and the pool people will now start to come every week except for the last. Sherman will stop by the pool place to let them know when he wants to shut it down.

-Nest Cam information- we watched the video. Richard suggested that we get at least one to test it. The board agreed to test one out.

-Richard suggested that when the applications are submitted to Roger Smith then the board will be copied in. The board agreed.

NEW BUSINESS

-Jessie has placed a call to Charlie Redwine about the over grown lots being a brush hazard and asked if there is anything that he can do about it? She has not heard back from him. Would you like for Jessie to move forward with letters without the brush hazard notice?

Blast letter to everyone about keeping their lot cleaned up for the brush and fire hazard.

-Phone line is in with the gate. This week the gate code will be changed.

-There is an aluminum dock in lot 32. There is trash around ramp and the dock is falling apart. This dock is owned by the individual owner of that lot. The HOA does not own it

-$2300.00 for the mailboxes for next year. The kiosk will not go to waste, it will be moved to the other side once it is completed. Jim wants to know how they are holding up in the weather. Richard state that they are holding up.Jim stated that he will add the $3000 in the budget next year to have it moved.

-Rock is coming in.

-Update the website with the information from the meetings. Jessie will do this first thing on Monday.

-Kurt is mowing the area next toGarvis. Next to Pacifico they are only doing one lot from the tree line to his lot.

-Richard typically cuts his own backyard but the HOA really needs to do that. We need to make sure that Kurt keeps all the HOA area cleaned up. We just need to make sure the feet is adjusted when more lots are being built on.

-Gary Pickett wants to thank Richard for all that he does.

-Richard Crowton has resigned as President from the HOA. He sold his home and is supposed to close on August 1, 2017.
