This award binds:
4.1Employers named in Schedule A - Respondents in respect of persons employed by them (whether members of the union or not), in the callings described in clause 13 - Wages in:
4.1.1Private hospitals; or
4.1.2Residential care facilities wholly or partially funded under the Aged Care Act 1997 (Cth);
licensed under the Hospitals Act 1927 (WA);
4.2The Australian Red Cross Society WA Branch in respect of Blood Transfusion Service Mobile Assistants.
4.3The Cerebral Palsy Association of WA Ltd in respect of Residential Care Workers; and

4.4the Liquor, Hospitality and Miscellaneous Union and its members;
in the State of Western Australia.

Clause 5Who is Bound by this Award
This award shall apply in the Australian Capital Territory and shall be binding upon the employers in respect of their employees, whether members of The Liquor, Hospitality and Miscellaneous Workers Union of Australia or not, and upon The Liquor, Hospitality and Miscellaneous Workers Union of Australia, the Confederation of A.C.T. Industry and the Aged Services Association of New South Wales and Australian Capital Territory.
Clause 6Where and Who the Award Covers
This award shall govern the wages and conditions of employment of all persons engaged in the performance of all work in or in connection with, or incidental to, the conduct of aged and disability care centres and facilities within the Australian Capital Territory, including JohnJamesHospital.
Clause 8Definitions
“Union” means the Liquor, Hospitality, and Miscellaneous Workers Union of Australia.
Common Rule Declaration
[Note: Common rule declared in on 19 December 1995, Print M7870]
1.That the whole of the terms of the Community Care Services (A.C.T.) Award 1995 be a common rule of the relevant industry in the Australian Capital Territory and shall be binding on all employers in the said industry in respect of the employment of them by employees in the classifications for which provision is made in the said Award and shall be binding on all such employees.
2.That this declaration shall not apply to the Australian Government in respect of employees under the Public Service Act 1922.
3.That the foregoing declaration shall operate from 19 December 1995.

A.Pursuant to s.501 of the Workplace Relations Act 1996 and the decision of Vice President Ross on 29 April 1997 [Print P0458], the following minimum wage order is made for employees who are employed in the State of Victoriawho are not subject to a federal award, a certified agreement or an AWA.
Clause 4Application
The Health and Community Services Sector which applies to any industry mainly engaged in health and community services and incorporates:
4.1Hospitals and nursing homes
4.1.1Hospitals (except Psychiatric Hospitals);
4.1.2Psychiatric Hospitals;
4.1.3Nursing Homes.

4.1This award binds:
4.1.1the employers named in Schedule A - Respondents, in respect of persons employed by them (whether members of the union or not), in the callings described in clause 13 - Wages in residential care facilities wholly or partially funded under the Aged Care Act 1997 (Cth) which are not licensed under the Hospitals Act 1927 (WA); and
[4.1.2 varied by PR962490 ppc 13Sep05]
4.1.2the Liquor, Hospitality and Miscellaneous Union and its members;
in the State of Western Australia.
4.2Provided that any residential care facility covered by this award shall continue to be covered by this award, to the exclusion of the Private Hospital and Residential Aged Care (Nursing Homes) Award 2002 and the Nursing Assistants’ Award 2002, notwithstanding any subsequent change in licensing status.

Clause 6Definitions

6.5Nursing assistant means an employee, other than one registered pursuant to the provisions of the Nurses Act 1992 (WA) or one who is in training for the purpose of such registration, whose substantial employment in terms of the purpose to be achieved by it is the provision of nursing care to persons.
6.6Nursing care means:
6.6.1giving assistance to a person who, because of disability, is unable to maintain their bodily needs without frequent assistance; or
6.6.2carrying out tasks which are directly related to the maintenance of a person‘s bodily needs where that person because of disability is unable to carry out those tasks for themselves, or
6.6.3assisting a person registered pursuant to the provisions of the Nurses Act 1992 (WA) to carry out the work described in 6.6.1 or 6.6.2 hereof or any other work directly related to a person‘s care.
6.6.4The term does not include work related to a person‘s care where that work does not involve personal contact with that person.
Clause 13Wages
13.1The minimum rate of wage payable to nursing assistants covered by this award shall be as follows:

13.7This 13.7 shall only apply to House care persons (as defined) employed by Anglican Homes Incorporated, RockyBay (Inc) and Brightwater Care Group (Inc) within cluster or modulised nursing homes or group homes, provided that it shall not apply to enrolled nurses.
13.7.1House care person means a person appointed as such who is a member of a care team within a cluster or modulised nursing home or group home and who assists residents with all their individual personal, domestic and communal needs.
13.7.2Care teammeans the group of individuals responsible for the overall care and well being of residents.

13.7.3The minimum rate of wage payable to House care persons shall be as follows:

13.7.4A House care person shall be paid at the Level two rate if:
13.7.4(a)they have been satisfactorily employed at the House care person Level one rate for twelve months; or
13.7.4(b)they have had prior experience and have been satisfactorily employed as a Nursing assistant for a period of three years; or
13.7.4(c)they have been satisfactorily employed and have had prior experience as a Nursing assistant and House care person Level one provided that the combined experience of the employee in the positions is three years.

Clause 3Incidence and Application
This award shall be binding upon the Federation and its members and the respondents listed in Schedule A in respect of registered nurses employed by the respondents in the State of Western Australia.
