Service Agreement For Religious Teacher

This agreement (“Agreement”) is made this day of , 2013, by and between (“Religious Institute”), and , a member of the Religious Institute (“Teacher”), and [Corporate title of Parish/Name of School.] (“School”).

1.  SERVICE RELATIONSHIP: The School agrees to accept the Teacher’s services, and the Religious Institute authorizes the services of the Teacher to the School according to the terms of this agreement. It is expressly understood by all parties hereto that the relationship of the Teacher, as an agent of the Religious Institute, to the School is one of Mission and not one of employer and employee; and that Canon Law and the Constitutions of the Religious Institute govern the relationship between the Archbishop, the Teacher, and the Religious Institute.

2.  ROLE MODEL/VALUES: The Teacher is called to be a role model and a witness to the Gospel of Christ. By agreeing to serve in a Catholic School, the Teacher agrees to respect Catholic values and to aid in Christian formation by exemplifying a lifestyle of Christian principles both in school and out of school. The Teacher shall exhibit a lifestyle that is compatible with Catholic moral values and professional conduct consistent with Catholic teaching, and shall not do, commit, or permit any act that will tend to demean or degrade him/her in society or bring the Teacher or the School into public disrepute. The Teacher agrees not to commit to any obligations outside the School that would be detrimental to his/her presence or performance as a faculty member of the School or the standing of the School as a Roman Catholic educational institution.

3.  COMPLIANCE WITH SCHOOL PHILOSOPHY: The Teacher agrees to comply with the philosophy of the School as interpreted by the School and to function under the direction of the School principal as a contributing member of the School community. The Teacher shall participate constructively in creating an atmosphere in which the religious faith of each student as well as his/her intellectual, moral, and physical capacities may be developed and strengthened.

4.  DUTIES: The Teacher accepts the terms of this Agreement as to his/her responsibilities as indicated in the job description, as listed in Exhibit A, and as assigned by the School principal. Teacher’s duties may include, in addition to classroom teaching, developing curriculum, sponsoring student activities, attending faculty meetings, parents’ nights and other teaching-related meetings and performing such other duties as may be assigned by the School principal.

5.  TERM: The School agrees to employ the Teacher to perform assigned duties during the 2013/2014 School year. The Teacher agrees to serve the School for the number of days in the official School calendar, to teach in the grade(s) and/or subject(s) or perform other duties assigned by the School, and to work cooperatively with the administrators and others in the School. In the event that the Teacher is not hired at the beginning of the School year or employment is terminated during the School year, the term shall be adjusted accordingly. This Agreement is not to exceed one year.

6.  TEACHING LICENSE: The Teacher shall be responsible for presenting a valid State of Oregon teaching license, application for same, or request for waiver of the license requirements to the School no later than 30 days after being hired. The School principal and the Department of Catholic Schools must approve in writing, on the Archdiocesan Waiver Request Form, any exception to the license requirement.

7.  COMPENSATION: In consideration of the Teacher performing the assigned duties, the School shall pay to the Religious Institute/Teacher the sum listed on Exhibit A, subject to all appropriate deductions and withholdings. These payments shall be made according to the School’s payroll schedule unless the Agreement is terminated, in which case the compensation will be prorated to reflect actual time worked. Compensation is prorated for part-time work.

8.  WORKSHOPS AND MEETINGS: The Teacher agrees to attend faculty meetings, workshops, retreats, institutes, student or liturgical assemblies, in-service days, parent conferences, parent meetings and other such meetings as required by the School Principal or the Department of Catholic Schools, including those scheduled outside of regular School hours. Registration fees (if any) for these events shall be paid by the School. Teachers may be required to attend teacher preparation days prior to the first day of classes without additional compensation.

9.  TIME OFF: Policies and procedures for time off, including, but not limited to, sick leave, personal leave, family medical leave, and holidays are published in the Employee Handbook for Parish/School Personnel (and addendums).

10.  BENEFITS: Policies and procedures for the Archdiocesan benefit programs, including medical/vision/dental, life insurance, and retirement are published in the Employee Handbook for Parish/School Personnel, the Flexible Benefits Program Decision Making Guide and Handbook, the Guide to the Tax-Sheltered Annuity Plan, and the Dependent Care Reimbursement Plan documents.

11.  TERMINATION DURING THE TERM OF THIS AGREEMENT: The Teacher shall not be discharged during the term of this Agreement without just cause as set forth in the Employee Handbook for Parish/School Personnel. However, if this Agreement is the Teacher’s first agreement with the School as a Teacher, then the first 120 calendar days of the Teacher’s employment during which School is in session shall constitute a probationary period within which the School may terminate this Agreement for any reason.

Cause for termination for any Teacher shall include, but not be limited to, changing needs in the curriculum, change in student population, changes in the school’s educational approach, reorganization of school functions, cessation of operations, reduction in personnel, efficiency or economic concerns, or for any of the reasons as stated in the Employee Handbook for Parish/School Personnel.

12.  ISSUE RESOLUTION: Matters of faith, morals, or religious doctrine are within the sole discretion of the Archbishop of Portland (“Archbishop”). Any discharge, discipline, or any other decision affecting the terms or conditions of service of the Teacher, for any reasons involving matters of faith, morals, religion, or religious doctrine, shall not be subject to arbitration or court action, and shall reside solely within the discretion of the Archbishop of Portland.

Except as provided in Section 15 below, and except for issues of faith and morals, any and all disputes arising out of the relationship between the Teacher/Religious Institute and the School, including, but not limited to, any dispute arising out of this Agreement, and all other terms and conditions of the Teacher’s service for the School, shall be resolved through the issue resolution procedure set forth in the Employee Handbook for Parish/School Personnel.

13.  PREVIOUS AGREEMENTS: This Agreement shall supersede all previous agreements between the Teacher/Religious Institute and the School, including any oral or written understandings that are not expressly stated in this document or incorporated by reference. The Teacher agrees to comply with the provisions of the Employee Handbook for Parish/School Personnel, the policies and procedures of the Department of Catholic Schools, and School policies. In the event of conflicting policies, this Service Agreement supersedes all other documents.

14.  RENEWAL OF AGREEMENT: Neither the Teacher/Religious Institute nor the School has any obligation to renew this Agreement. This Agreement shall terminate at the end of the prescribed period or upon separation from service. Nonrenewal of this Agreement shall not be subject matter for the issue resolution process.

Ordinarily the following schedule will apply to the renewal/nonrenewal of this Agreement. However, the School may alter this schedule when, in its sole judgment, circumstances so require. On or before March 15, the Teacher/Religious Institute shall advise the School in writing of the Teacher’s desire and availability to return for the following School year. On or before May 1, Teachers will be notified in writing if the School intends to offer another service agreement for the next School year. Failure of the School to notify the Teacher by the specified date will not automatically renew or extend this agreement. The Religious Institute/Teacher agrees to accept or reject the service agreement offered within 15 calendar days following receipt of an Agreement.

15.  CANCELLATION OF THIS AGREEMENT: The parties may cancel this Service Agreement by mutual consent, or as provided herein during the period commencing with the signing of this Agreement and the end of the School term.

16.  MODIFICATION OF THIS AGREEMENT: Any and all modifications of this Agreement shall be in writing. Except for amendments to Exhibit A which do not require approval by the Department of Catholic Schools, no waiver or modification of this Agreement shall be valid unless in writing and signed by the Teacher, the Religious Institute, the School, and the Superintendent of Catholic Schools.
