Sealed tenders are invited in duplicate from reputed parties, having similar experience to run the Canteen with 2 Nos. Extension Counters on contract/lease basis at Guru Hargobind Thermal Plant, Lehra Mohabat for one year to cater to about 1500 employees. The Building, Furniture, Water, Light fittings, Fans shall be provided free of cost by the department for use during the contract period.

A Set of tender documents/specification can be obtained from this office by depositing its cost i.e. Rs.500/- only (Non-refundable) on any working day in cash with AO/O&M,GHTP, Lehra Mohabat or on demand draft in favour of A.O/O&M, GHTP,Lehra Mohabat payable at Rampura Phul.

Tenders submitted without purchasing tender documents will not be opened.

SECTION-I

GENERAL TERMS AND CONDITIONS FOR RUNNING OF CANTEEN IN PLANT AREA OF GHTP LEHRA MOHABAT.

  1. The lease will be for a period of one year from the date of contract agreement which can be extended for another three months on the same rates, terms and conditions. The contract agreement can be terminated on breach of terms and conditions of the agreement on the part of lease holder and the security will be forfeited after giving opportunity in writing.
  2. Lease agreement will be signed on non-judicial stamped paper worth Rs.15/- by the lease holder on one side and PSPCL on the other side.
  3. The management can visit premises, if needed where bidder is carrying out his job at present in order to assess his capability. It will be the responsibility of bidder to arrange such visit. The vendors having experience in running canteens for an institution having 600 or more workers shall be preferred.
  4. PSPCL shall verify and ascertain the capability of the prospective bidder of running suchcanteen before awarding the lease and the decision of authority in this regard shall be final and no claim whatsoever shall be entertained.
  5. The lease holder shall maintain proper record register as required under Factory Act/other acts applicable at Plant. Action for non compliance of same shall be taken against the lease holder.
  6. The lease holder shall display the approved list of all the items near the coupon issuing counter.
  7. Vendors will be authorized by the competent authority by issuing identity cards to enter the plant area for the purpose of supply of milk and other raw materials.
  8. The authorized persons/canteen committee including dispensary doctor shall have the right to check the quality/ quantity of various items of food stuffs being served in the canteen at any time. If something is found below standard then the same can be destroyed and no compensation shall be made in this behalf by the management.
  9. The lease holder shall not allow any of his employees to stay in plant premises without prior written approval of the management.
  10. The lease holder will be prohibited to serve or use liquor/intoxicants in the canteen.
  11. The lease holder will not sublet any part of the canteen for any purpose whatsoever.
  12. Tender will be finalized on the basis of recommendations of the committee that will be constituted to scrutinize the documents and premises/establishment of the tenderer.Only typed tenders will be accepted.
  1. Tenders shall be submitted in duplicate and all copies shall be separately tagged and clearly marked as ORIGINAL and DUPLICATE.
  2. Telegraphic/Telefax quotations shall not be accepted.
  3. Tenders submitted without purchasing tender documents will not be opened.

The tender shall be sent in two separate envelopes, one envelope containing the consent of the firm to supply the eatables as per rates fixed by the canteen management committee, work experience along with address of the establishment and financial position/balance sheet of the firm and other containing Earnest Money. While opening the tenders, the envelopecontainingearnest money shall be opened first and in case the Earnest Money is in accordance with our requirement as stipulated in Clause-16of the specifications, only then the second envelope containing the tender shall be opened.

Quotations/ tenders should be enclosed in double covers both addressed to SE/Operation Circle, GHTP, Lehra Mohabat. Both inner and outer covers shall be sealed and superscribed with tender specification as given in the enquiry / tender notice together with the date on which tender opening is due and name of work.

Tenders shall be opened in the office of Superintending Engineer/Operation Circle, GHTP, Lehra Mohabat on the due date & time.

In case the due date happens to be a holiday the tenders shall be opened on the next working day at the same time and place.

Contractor having experience of running of such type of canteen for a period of 4 to 5 years will be given preference. Lease order will be allotted through draw out of the valid tenders in the presence of tenderers / representative who wants to be present.

  1. EARNEST MONEY :Tenderer shall be required to submit earnest money amounting to Rs.10,000/-(Rupees TenThousand only) in the form of PSPCL Cash/Bank Draft in the name of AO/O&M,GHTP, Lehra Mohabat payable at Rampura Phul only. In case,EMD is found to be less than this value, then therespective tender will be got resealed.
  2. SIGNING OF THE TENDER: Tender shall be signed by the owner or person holding power of attorney by him to do so. Necessary documents in support thereof should be enclosed with bid at the time of submission of tender, failing which tender may not be considered.
  3. ALL CUTTINGS/CORRECTION TO BE INITIALED: Each page of the tender document including the schedules be signed and dated by the tenderer in ink as a token of his having examined the same. Any correction in the rates quoted in the schedule of quantities shall also be signed with date by tenderer before submitting the tenderer. All corrections and additions should be initialed by the contractor. Non-compliance with these conditions will make the tender liable to rejection.
  4. The lease holder shall abide by the provisions of Factory Act, Bonus Act, EPF Act, Labour laws etc.
  5. ARBITRATION :

(A)If at any time any question, dispute of difference what-so-ever arises between PSPCL and the lease holder in relation to or in connection with the contract either party may forthwith give to other, notice in writing of the existence of such question/dispute or difference and the same shall be referred for sole arbitration to a nominee of the PSPCL, who in case of dispute shall give a reasoned / speaking award. The award of the sole arbitrator shall be final and binding on both the parties under the provision of the Indian Arbitration Act-1940 and of the rules thereunder. Any statutory amendment modification or re-enactment thereof for the time being in force shall be deemed to apply to and be incorporated in the contract. It will not be objectionable if sole arbitrator is an officer of the PSPCL and he has expressed his views on all or any of the matter in question of dispute or difference.

(B)Upon every or any such reference, the cost of incidental to the reference and award respectively shall be at the discretion of the sole arbitrator so appointed who may determine the amount thereof and direct the same to be taxed as between solicitor and client or as between party and shall direct by whom and in what manner the same is to be borne and paid.

(C)The work under the contract shall continue during the pendency of arbitrationproceedings and no payment due to or payable by PSPCL to the contractor or by the contractor to the PSPCL shall be with-held on account of such proceedings. All clauses of this contractor shall remain in force during such period.

19. VALIDATY OF TENDERS:

The tenders as submitted should be valid for acceptance for at least 120days from the date of opening of tenders.

20.Competent authority reserves the right to reject any or all the tenders without assigning any reason.

SECTION-II

SPECIAL TERMS & CONDITIONS FOR RUNINGTHE CANTEEN IN PLANT AREA OF GHTP LEHRA MOHABAT.

  1. Security Deposit: Earnest Money amounting to Rs.10,000/-(Rupees Ten Thousand only) deposited by the successful bidder shall be adjusted against security deposit of the lease holder.No interest shall be payable on the earnest money or security deposit or any other amount which shall become payable to the contractor under this contract.

The security shall be refunded after 3 months from the date of faithful completion of contract by the lease holder to the satisfaction of GHTP, Authorities.

2. The lease holder shall not claim any compensation for any damage or loss resulting to him due to any act of God,Riots, floods etc.during the contract period.

3. The lease holder shall be required to run the Canteen as per Annexure-‘A’ and ‘B’. The prices quoted shall be valid for a period of one year from the date of contract agreement executed and no increase in the prices of articles to be served in the Canteen, will be allowed under any circumstances. Eatable rates will be fixed by canteen management committee. Lease order will be finalized by draw system from the tenders received from the different firms.

  1. The following facilities shall be provided to the lease holder free of cost by the management:-

a)Canteen building.

b)Furniture.

c)Water.

d)Water Cooler & R.O. Filter System.

Note:Maintenance of above will be doneby different maintenance cells.

e)Light fittings (with Tube Rods & Bulbs), Fans etc. will be provided by PSPCL. Subsequently fused lamps/tubes and damaged tube fittings /fans will be got replaced/repaired by the EMC Circle. At the close of above contract, all the fittings / fans will be handed over to PSPCL by the lease holder complete in all respects in working order, taken over by him at the time of contract agreement.

f)Electricity for lighting, fans and water coolers or any other appliance will be provided by the PSPCL. The lease holder shall not use electricity for any purpose other than specified above. Use of electricity for any other purpose shall be considered as misuse of electricity.

g)Cleanliness of canteen hall, officer room, water cooler room, windows, roofs, floors, walls,kitchen, toilets(inside/outside canteen), providing of dustbins with lid, cleanliness of area around canteen will be got carried out by Civil Mtc. Cell twice during working hrs in the morning & evening.

5. The lease holder will have to arrange the following:

a)The lease holder will put one canteen worker especially for cleaning of tables, shanks,wash basin, garbage removal from tables & floor, clearing of dustbins and for clearingof floors during non-working hrs. and at off times.

b)Kitchenwares required in canteen, utensils for serving meals to 100 workers at a time, crockery for servicing tea/coffee, snacks etc.

c)The contractor shall make his own arrangement for fueli.e. commercial LPG cylinder/ kerosene bhatthionly for preparing eatables. Use of coal will not be allowed.

d)The contractor shall provide uniform/dresses to the canteen workers working under him.

e)Contractor will arrange ovens for keeping the food stuff in hot condition wherever required.

f)Contractor will arrange good quality defreezer/fridge of suitable capacity for storage the food stuffs.

g) The Contractor shall have to provide the items mentioned in Annexure “B” on demandat all the times.

6.The lease holder can be fined Rs.500/-for first default and Rs.1000/- for subsequent default for any one of the following reasons:-

a) For not observing the given time schedule.

b)For not keeping the proper cleanliness of canteen hall, tables, shanks, garbage removal from tables & floor, clearing of dustbins.

c)For poor quality and less quantity of food being served in canteen.

d)For poor quality of raw materials/unhygienic raw material used for serving of food.

e)Misuse of electricity for purpose other than specified in clause No.4.

f)Sale of intoxicants/cigarettes/bidis/liquor etc. in canteen.

g)Use of intoxicants within the plant premises.

Important Note: In case the contractor fails to bring the improvement/or fails to take remedial actions as intimated by Canteen Management Committee even after five instances, the whole of security deposited Rs.10000/- shall be forfeited and PSPCL shall have the right to cancel the lease order at any time without assigning any reason to the contractor .
