O R D E R

The Delhi Medical Council through its Executive Committee examined a representation from the office of Addl. CP West District, Delhi, forwarded by Deputy Secretary (H&FW), Govt. of NCT of Delhi, seeking medical opinion in respect of death of late Ashok Kapoor, allegedly due to medical negligence in the treatment administered by the doctors of Mata Chanan Devi Hospital, Janakpuri, Delhi,resulting in his death on 29.8.2011.

The Order of the Executive Committee dated 14th May, 2015 is reproduced herein-below :-

The Executive Committee of the Delhi Medical Council examined a representation from the office of Addl. CP West District, Delhi, forwarded by Deputy Secretary (H&FW), Govt. of NCT of Delhi, seeking medical opinion in respect of death of late Ashok Kapoor (referred hereinafter as the complainant) allegedly due to medical negligence in the treatment administered by the doctors of Mata Chanan Devi Hospital, Janakpuri, Delhi,(referred hereinafter as the said Hospital) resulting in his death on 29.8.2011.

The Executive Committee perused the representation from police, copy of medical records of Mata Chanan Devi Hospital, post-mortem report No.1016/11 dated 30.8.2011, subsequent opinion dated 2nd May, 2014 in respect of post mortem report No.08/11 and other documents on record.

It is noted that the patient was admitted in Mata Chanan Devi Hospital, C-1, Janak Puri, New Delhi-110058, with alleged history of fall from height.He was deeply unconscious with GCS 5/15, indicating severe head injury. Patient was operated at Mata Chanan Devi Hospital as he had intracranial hematoma. Craniotomy was done and hematoma was evaluated. Patient however did not show any recovery and eventually succumbed on 29th August, 2011.

In view of the observations made herein-above, it is, therefore, the decision of the Executive Committee that prima-facie no case of medical negligence is made out on the part of doctors of Mata Chanan Devi Hospital, Janakpuri, Delhi, as the patient died due to his underlying condition.

Complaint stands disposed.
