Zoning Hearing Board Minutes

February 22, 2016

The February 22, 2016 meeting of the Lititz Borough Zoning Hearing Board was called to order by Vice Chairman Kurtz at 7:00 PM. The meeting was opened with Silent Meditation, followed by the Pledge of Allegiance to the Flag.

Zoning Hearing Board members present: Kurtz, Westcott, Eberly, Learn, McDonald (Alt)

Zoning Hearing Board members excused: Matthews, York (Alt)

Lititz Borough Council members present: C. VanBrookhoven

Also present: Susan Peipher, Solicitor; Vanessa Smith, Court Stenographer; Dorene Shaffner, Brian Carroll, Jennifer Rutter

The January 25, 2016 minutes were approved unanimously (5 – 0) from a motion by Learn and a second by Westcott.

Case #1722 – Dave Bomberger – 503A S Broad Street

Applicant forwarded by email a request for an extension of time to allow an additional 6 months to begin construction of the new home in order to get the information needed to construct a driveway from the rear of the property through an unopened street, for this property located at 503A S Broad Street, within the RS Residential District.

Westcott made a motion to extend the time frame to begin construction another 6 months from the date of the hearing (2/22/16). The motion was seconded by Eberly and passed unanimously, 5 – 0.

Case 1732 – Jennifer Rutter/Brian Carroll – 429 Hummingbird Drive

Applicants took no issue with the alternate member voting on their request and presented their request for a Special Exception from Section 207.C.3 and 401.D (Home Businesses, to operate a beauty salon within their home) and Section 311.I.2.c (Signage in a Residential District, to place business signage) of the Lititz Borough Zoning Ordinance in the R-1 Residential District.

Testimony included:

·  The business will be compatible with the residential use

·  The property owner will be the sole proprietor

·  The only outside appearance of the business would be a 16” by 20” double sided sign suspended below the mailbox, and will not have any type of lighting

·  Nothing will create noise, vibration, glare, fumes, odors or electrical interference

·  The driveway will be expanded to allow for increased on-site parking

·  Deliveries and traffic to the site will not exceed those volumes normally expected in a residential neighborhood

·  Hours will be Tuesday through Saturday from 9am to 8pm by appointment only

After a brief discussion, Learn made a motion to approve the request as testified with the stipulation that the signage is not to exceed 16” x 20”, double-sided with no lighting. The motion was seconded by McDonald and passed unanimously, 5 – 0.

With no further items on the agenda for the evening, the hearing was adjourned at 7:35 pm.
