SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIO VISTA APPROVING AN EXTENSION TO AN EMPLOYMENT AGREEMENT WITH CAROLYN PARKINSON FOR SERVICES AS INTERIM CITY CLERK IN AN AMOUNT NOT-TO-EXCEED $77,760

RECOMMENDATION

It is recommended that the City Council of the City of Rio Vista consider approval of Resolution No. ______, “Approving an extension to an employment Agreement with Carolyn Parkinson for services as Interim City Clerk, in an amount not-to-exceed $77,760, and continuing the 10% decrease in the not-to-exceed hours.

BACKGROUND

On May 1, 2009, the City extended an Employment Agreement with Carolyn Parkinson for FY2009-10 to provide City Clerk services. The agreement reflected a 10% decrease from the previous year’s agreement and specified a total number of hours of 864 at $90 an hour for a not to exceed amount of $77,760. (Note: Prior to FY2009-10, the term of Parkinson’s agreement specified a total number of hours of 960 for a not to exceed amount of $86,140.)

REVIEW AND ANALYSIS

With the recent financial situation of the City and in an effort to save costs, staff feels it is beneficial to extend the City’s agreement with Ms. Parkinson on a part-time basis through FY 2010-11. Ms. Parkinson has agreed to a continued 10% reduction in hours and the $77,760 not-to-exceed amount of the Employment Agreement. During this time, it is anticipated that the Administrative Assistant to the City Manager will assist Ms. Parkinson as the Deputy City Clerk thus resulting in salary saving by not hiring a fulltime City Clerk. Additionally, Ms. Parkinson can assist the City through her experience in performing City Clerk duties in accordance with State Law and City of Rio Vista laws and policies.

Attached for your review and consideration is an extension to Ms. Parkinson’s agreement. The term of the agreement is not-to-exceed 864 hours prior to June 30, 2011 and an amount not-to-exceed $77,760.

Ms Parkinson will be at City Hall for a period not to exceed 864 hours for the FY2010-11. She will also attend the City Council meetings on the first and third Thursday of the month and the special meetings, as authorized hours permit. In accordance with the agreement, the City will provide Ms. Parkinson with an office and a computer to perform City Clerk duties.

Ms. Parkinson will be responsible for her own travel and sleeping accommodations. This agreement is very similar to the previous agreements entered into with Ms. Parkinson, with the 10% continued decrease in not-to-exceed hours.

Staff is recommending approval of the agreement extension with Ms. Parkinson as Interim City Clerk.

FINANCIAL CONSIDERATIONS

The contract extension with the Interim City Clerk will result in a salary and benefit savings of $80,927. Based on the last full time City Clerk’s employment contract, with today’s benefits, a full time City Clerk would cost $158,687 for salary and benefits. The not-to-exceed contract with the Interim City Clerk is $77,760.

·  Decline to approve the amendment and advertise for a Regular Full-time Clerk

APPROVING AN EXTENSION OF THE EMPLOYMENT AGREEMENT WITH CAROLYN PARKINSON FOR SERVICES AS INTERIM CITY CLERK IN AN AMOUNT NOT-TO-EXCEED $77,760

WHEREAS, on May 1, 2009, the City extended the Employment Agreement with Carolyn Parkinson as a part-time interim City Clerk; and

WHEREAS, the Employment Agreement will expire on June 30, 2010; and

WHEREAS, an extension to the Agreement is requested for FY2010-2011, and

WHEREAS, in no event shall the Agreement be extended in such a way to allow Ms. Parkinson to exceed 864 hours prior to June 30, 2011 and an amount not-to-exceed $77.760.

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIO VISTA that said Council does hereby approve an extension to the Agreement with Ms. Carolyn Parkinson, hereby attached as Exhibit “A”, for Interim City Clerk services at an amount not-to-exceed $77,760.
