Section I - General
A. Scope:
The work covered in this agreement includes furnishing all labor equipment
and materials necessary to perform the services as outlined in the attached
specifications.
B. Personnel Qualifications:
Horizon of Memphis shall employ only qualified operators and workmen
who are skilled in the performance of janitorial work.
C. Security:
Horizon of Memphis shall screen all employees and require satisfactory personal
references in order to determine character of prospective employees before hiring.
D. Identification of Employees:
Each employee shall be furnished proper identification with both the name of Horizon and
the employee.
E. Appearance of Employees:
All employees of Horizon of Memphis shall be neatly attired at all times in a manner that
will reflect credit both upon Horizon of Memphis and the building in which they are
working.
F. Bonding Statement:
Horizon of Memphis shall be responsible for any loss or damage to property including
money, securities, merchandise, fixtures equipment belonging to the customer or to any
person or organization to such extent as the customer is legally liable for such loss or
damage, if any such loss or damage was caused by Horizon of Memphis or any employee
thereof, while such employee is on the premises of the customer as an employee of
Horizon of Memphis. If, in the event question arises as to the guilt or innocence of the
employee of Horizon of Memphis, a polygraph will be arranged. Should it be determined
as the result of this test that Horizon of Memphis employees are responsible, the cost of
the polygraph will be included as a part of the loss for which Horizon of Memphis is
legally liable. If, however Horizon of Memphis employees are determined to be innocent,
then the cost of the polygraph will be borne by the client.
G. Work Hours:
The schedule of work hours for accomplishment of building services shall conform to the
requirements of the building and Horizon of Memphis shall in no way interfere with the
normal routine of your operation.
H. Use of the Premises:
Space shall be made available to Horizon of Memphis for the purpose of storage of
materials and equipment.
I. Safety Precautions:
Horizon of Memphis shall be responsible for instructing its employees in safe work habits
and requirements to comply with the 1970 Williams-Steiger Occupational Safety and
Health Act.
J. Contractor's Representatives:
Horizon of Memphis shall designate a responsible person who will, along with his staff
of supervisors, constantly check the quality of workmanship.
K. Inspection:
All work, equipment, and supplies furnished in performance of the attached specifications
shall be subject to inspection at any and all times by the Building Manager or his duly
authorized representatives.
L. Workman's Compensation, Public Liability, Property Damage Insurance:
The above mentioned insurance requirements shall be furnished in the following
limits and amounts: Bodily Injury Liability $3,000,000.00 each person, $3,000,000.00
each accident; Property Damage Liability $3,000,000.00 each occurrence, $3,000,000.00
aggregate. Horizon of Memphis also carries an additional $5,000,000.000 umbrella to this
coverage. Also, all Horizon of Memphis employees are bonded. We will furnish a
certificate of insurance before start of your services on request.
SPECIFICATIONS OF CUSTODIAL SERVICES
SECTION II- AREAS TO BE SERVICED: All areas throughout the building as spelled out
by the customer to be included in our services.
SECTION III- FREQUENCIES OF SERVICES- FIVE DAYS PER WEEK.
Daily Services:
A. FLOORS- Daily
1. Floors swept and /or dust mopped with dust control treated mops or other tools, and
left clean and free of dust.
2. Floors, wet mopped all areas of the building. Nightly.
3. Vacuum all carpets or concrete throughout the building. Spot clean were possible.
4. Breakroom floors wet mopped daily.
B. RESTROOMS- Daily
1. Floors; detergent mopped and rinsed.
2. Fixtures cleaned and sanitized.
3. Mirrors cleaned.
4. Fittings and supply pipes kept clean.
5. Sanitary napkins receptacles; cleaned and sanitized.
6. Stall partitions and tile walls; kept clean.
7. Waste receptacles; emptied and resulting debris placed in outside containers.
8. Hand soap receptacles refilled.
9. Towel and toilet paper receptacles refilled.
- Walls will be scrubbed down in restrooms weekly.
- Clean and sanitize drinking fountain.
C. BREAKROOM/KITCHENETTES- Daily Unless Noted
- Floors swept and mopped.
- Microwaves cleaned inside and out
- Trash emptied.
- Wipe down refrigerator, stove and ice machine
- Clean all tables, chairs and condiment centers
- Clean inside refrigerator daily.
- Load dishwasher as needed.
HORIZON SUPPLIES ALL HARDWARE AND CHEMICALS. CUSTOMER SUPPLIES ALL PAPER PRODUCTS, HANDSOAP AND CAN LINERS.
D. DUSTING
1. Dust all desk, file cabinets, tables, chairs, picture frames etc. Daily
2. Dust all window sills, ledges, partitions etc. Daily
3. Dust all vents, ledges throughout. Daily.
4. Dust all high areas. Weekly.
5. Dust all blinds throughout the building. weekly.
6. Dust all baseboards weekly.
- Dust all partition tops. Daily
E. GLASS
1. Entrance door glass cleaned. Daily
2. Partition glass inside offices; smudges removed, daily
3. All glass cleaned inside and out, on call at additional charge.
4. Picture frame glass cleaned once per week.
F. MISCELLANEOUS
1. Keep supply closet orderly and clean.
2. Turn off lights, turn off fans, etc. when nightly cleaning is completed.
3. Use minimum lights while work is in progress.
4. Telephones cleaned and sanitized daily.
- All trash collected and placed in outside dumpster.
- Empty and keep clean outside cigarette cans twice weekly.
- Patrol and clean entrance area of debris daily.
- Keep all areas free of webs etc...
G. FLOOR SERVICE-
- All tile floors will be stripped and waxed quaterly.
- All carpet will shampoo scrubbed and extracted quarterly.
OUR QUOTATION IS BASED ON PROVIDING THE ENCLOSED SERVICES.
SHOULD WE CHANGE THESE SPECIFICATIONS, IT WOULD REQUIRE POSSIBLE
PRICE CHANGES. OUR CHARGE FOR THE JANITORIAL SERVICES AS SPELLED
OUT IN THIS PROPOSAL WILL BE-
HORIZON OBSERVES THE FOLLOWING HOLIDAYS, NEW YEAR,LABOR DAY, MEMORIAL DAY, INDEPENDENCE DAY, THANKSGIVING AND CHRISTMAS. OUR CHARGES ARE BASED ON OUR NOT WORKING THESE DAYS.
HORIZON OF MEMPHIS SHALL SUBMIT INVOICES FOR ITS SERVICES, AND
ALL SUCH INVOICES SHALL BE DUE AND PAYABLE WITHIN 30 DAYS OF
RECEIPT. ANY AMOUNTS NOT PAID AS PROVIDE HEREIN SHALL BE AND
BECOME DELINQUENT AND THE CUSTOMER SHALL PAY, IN ADDITION
TO THE AMOUNT OF SUCH INVOICE, ONE AND ONE HALF (1.5%) PER MONTH
FOR EACH MONTH OR PORTION THEREOF, DURING WHICH SUCH ACCOUNT
IS DELINQUENT. SUCH FAILURE SHALL ALSO BE DEEDED A DEFAULT FOR
THE RIGHT TO TERMINATE THIS AGREEMENT AND SERVICES HEREUNDER
IMMEDIATELY. IN THE EVENT ANY AMOUNTS HEREUNDER ARE
COLLECTED BY OR THROUGH AN ATTORNEY-AT-LAW, THE CUSTOMER
AGREES TO PAY, IN ADDITION TO AMOUNTS OTHERWISE DUE HEREUNDER, ALL COST OF COLLECTION, INCLUDING ATTORNEYS FEES.
THIS CONTRACT SHALL BE EFFECTIVE AND
MAY BE TERMINATED BY EITHER PARTY BY GIVING 30 DAYS PRIOR WRITTEN NOTICE.
THE CUSTOMER AGREES THAT DURING THE TERM OF THIS CONTRACT
AND FOR A PERIOD OF SIX MONTHS FOLLOWING THE TERMINATION
OF THIS CONTRACT NOT TO EMPLOY ANY EMPLOYEE OF HORIZON OF
MEMPHIS WHO RENDERED SERVICES IN ACCORDANCE WITH THE TERMS
OF THIS CONTRACT TO PERFORM SERVICE WORK SIMILAR TO THE TYPE
PERFORMED BY THE EMPLOYEE FOR THE CUSTOMER.
ALL EMPLOYEES WILL HAVE A BACKGROUND CRIMINAL CHECK BEFORE EMPLOYED AND ALL DESIGNATED WAREHOUSE EMPLOYEES WILL BE DRUG TESTED AND RECEIVE REQUIRED THE VEHICLE TRAINING.
THE MONTHLY PRICE UPON RENDERING OF THE CONTRACT WILL NOT BE INCREASED FOR A PERIOD OF THREE YEARS UPON SIGNING OF CONTRACT.
