About this seminar

Thisone and 1/2 day intensive seminaris a must for those engaged in medical malpractice lawsuits, but it is also useful for those generally involved in litigation. It will serve as a pathfinder to strategic, effective and efficient litigation, focussing on the different nuances and legal principles specifically applicable in medical law.

A useful course manual will be provided and you will be awarded with a certificate for successful attendance.

Areas of coverage

Brief refresher course featuring the main principles of medical law.

Pre – Litigation investigation including how to gather the facts in support of your case/defence.

Drafting pleadings including Particulars of Claim/Plea/Special Plea.

Pre – Trial stage including consultations with lay witnesses/expert witnesses; pre –trial conferences/mediation – arbitration proceedings as possible options.

Calling for expert assessors to preside with judges over the trial.

The trial itself and techniques available to effective litigation i.e. trial advocacy skills. This will include how to deal with expert witnesses in evidence in chief and under cross-examination.

Learning through practical application. Two case studies will be presented to you where the facts are based on two more recent cases. You will be required to peruse the facts and write an opinion arising from one of the case studies, as well as draft pleadings in respect of the other.

This seminar is aimed at attorneys, candidate attorneys, legal advisors in the public sector, corporate law advisors, state attorneys and legal advisors in local government. Practising attorneys with litigation experience, taking on medical law matters often as a result of the decline of RAF matters will find the workshop indispensable.

Presenters
Dr Henry Lermhas a wealth of experience in practice both in practice as well as academically. He has long been an admitted attorney and has appeared in both the lower courts and the High Court. Dr Lerm holds the degrees BPROC, LLB, LLM, LLD. He received his LLD from the University of Pretoria in 2008 and his dissertation is titled ‘A Critical Analysis of Exclusionary Clauses in Medical Contracts’. DrLerm has been a LEAD trainer on Medical Law, Contract Law, Constitutional Law and Legal Interpretation. He has been attached to the School for Practical Legal Training at the Nelson Mandela Metropolitan University, Port Elizabeth for many years and is a member of the South African Medico-Legal Society.
Rita du Plessis will be assisting Dr Lerm. She is an admitted attorney and has appeared in both the lower courts and the High Court. Ria runs her own practise in Durban, specialising in medical and commercial law. Her passion for medical law stems from her training in biological sciences and legal developmentto be more accessible using new technology. She has been assisting LEAD in drafting material at an entry- andadvanced level.
