-Please list below the food items you will be vending at the festival including the price.

-You are limited to threeEntrées (fries and chips will not be considered as an entrée unless sold separately as a specialty item). The Fall Festival Board will provide a sign that lists your menu and prices. You must use the sign provided.

-You may not sell any drinks whatsoever (frozen or non- frozen), unless expressly permitted by the FF Committee.

- We allow only two of the same food items to be sold at the festival. If one of your menu items is already taken we will call you to request an alternativeitem for you to sell.

Strictly Enforced:Upon approval, youmay only sell the items you have listed below. Any vendor selling menu items outside of the items that were approved by the Commission, will be told to leave the premises.

Each vendor will be provided with standard 120V outlets. The city will not provide extension cords. Please describe any additional electrical needs you will have. Additional costs may apply.

Please understand that by submitting an application does not guarantee you a space at Maringouin Fall Festival. All applications must be approved by the Maringouin Fall Festival Commission.We will not hold any postdated checks. All checks will be deposited upon receipt. If you are not accepted, a refund will be promptly mailed to you.

Any application received without checks/money orders will not be accepted.

I understand that I am responsible for obtaining any required licensing from the State of Louisiana. I also commit to attend the event. The Town of Maringouin will not be responsible or liable in any way for damage to any property/individuals participating in the event.

2016Maringouin Fall Festival- Waiver of Liability and Hold Harmless Agreement

In consideration for receiving permission to participate in the 2015Maringouin Fall Festival,I hereby release, waive, discharge and covenant not to sue the Town of Maringouin, Parish of Iberville, State of Louisiana, and all their sponsors, volunteers, assignees, representatives, officers, agents, servants, or employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any of the property belonging to me, whether caused by the negligence of any of the above entities, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.

I am fully aware of the risks involved and hazards connected with being a vendor for the 2016Maringouin Fall Festival, and I hereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, which may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such an activity, whether caused by the negligence of any of the above entities or otherwise.

I further hereby agree to indemnify and hold harmless all of the above entities from any loss, liability, damage or costs, including court costs and attorney fees, that they may incur due to my participation in said activity, whether caused by negligence of the above entities or otherwise.

I understand that the Town of Maringouin does not maintain any insurance policy covering any circumstance arising from my participation in this event or any activity associated with or facilitating that participation. As such, I am aware that I should review my personal insurance portfolio and provide my own insurance appropriate to cover myself, my employees, volunteers and customers.

I further understand that I and my vendor area including all volunteers, employees, or appointees hired or used by me to assist in my vendor areas fall solely under my responsibility and it is my full responsibility for any and all insurance or claims arising from any type of negligence.

It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a release, waiver, discharge and covenant not to sue the above-named entities. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Louisiana.

In signing this release, I acknowledge and represent that I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this release for full, adequate and complete consideration fully intending to be bound by same. I further acknowledge and agree that I have received a copy of this agreement.
