LEGAL NOTICE

PUBLIC HEARING

The Department of Natural Resources and Environmental Control (DNREC), Delaware Coastal Management Program (DCMP) section will conduct a public hearing on the proposed routine program change to the DCMP Federal Consistency Policies and Procedures. The DCMP, as dictated by the National Oceanic and Atmospheric Administration (NOAA), must routinely update its policies to maintain the authority to manage the coastal resources of Delaware and evaluate federal activities, permits and plans by those pursuing these actions. This action will update the existing list of Federal licenses and permits for which DCMP conducts Federal Consistency reviews to include alternative energy authorizations granted by the Bureau of Ocean Energy Management Regulation and Enforcement and the Federal Energy Regulatory Commission; and will establish a new list of federal activities occurring outside of State boundaries for which DCMP will conduct Federal Consistency reviews.

The public hearing on the proposed changes to the Federal Consistency Policies will be held March 22, 2011 at 6 pm at the St Jones Reserve located at 818 Kitts Hummock Road, Dover, Delaware 19901.

The proposed changes to the Federal Consistency Policies may be inspected at the Department’s offices located at 5 E. Reed Street, Suite 201, Dover, Delaware 19901 or online at http://www.swc.dnrec.delaware.gov/coastal/Pages/FederalConsistency.aspx.

Interested parties shall submit comments in writing on the proposed changes to the Federal Consistency Policies by the end of the comment period, as designated by the hearing officer at this hearing, to Tricia Arndt and/or statements and testimony may be presented either orally or in writing at the March 22, 2011, public hearing. It is requested that those interested in presenting statements at the public hearing register in advance and that written statements and comments be addressed to:
