SUBJECT:Complaint for Administrative Civil Liability for Failure to Submit Technical Report, All Star Gas, Inc., 1791 Pine Street, Concord, Contra Costa County
Dear Mr. Engineer:
A copy of a Complaint for Administrative Civil Liability (ACL) is enclosed for your records and review. The Complaint alleges that All Star Gas, Inc. violated Water Code Section 13267 by failing to submit a technical report.
This matter will be considered by the Regional Board (Board) at its February 21, 2001 meeting. The meeting will be held at the Elihu M. Harris State Building, First Floor Auditorium, 1515 Clay Street, Oakland and will start at 9:30 am.
In responding to this Complaint, you have the following options:
1.You can appear before the Board at that meeting to contest the matter. Please note the February 5, 2001, deadline for submitting written comments. At the meeting, the Board may impose administrative civil liability for a lesser or greater amount than in the complaint, or refer the case to the Attorney General to have a Superior Court consider imposition of judicial liability.
2.You can waive the right to a hearing by signing the last page of the Complaint in the appropriate location. By doing so, you agree to pay the liability.
3.If you would prefer to develop an environmental enhancement project in lieu of payment of part of the liability, do not sign the waiver; instead state your intent in a letter addressed to me, no later than February 5, 2001. Staff can assist you in identifying and developing an acceptable project.
