Stallion Breeding Agreement for CC Thoroughbred Farm

This agreement is by and between CC Thoroughbred Farm and ______, hereafter known as Mare Owner. CC Thoroughbred Farmagrees to breed the mare ______, Reg. No.______, Breed______, hereafter known as the Mare, at CC Thoroughbred Farmduring the designated breeding season to ______. This agreement is made and entered into this ___day of ______200_.

CC Thoroughbred Farm and Mare Owner hereby agree to the following:

Mare Owner agrees to pay CC Thoroughbred Farm a non-refundable booking fee of $150.00 due upon signing of this contract. Mare Owner shall pay CC Thoroughbred Farmthe remaining stud fee due at mare’s departure or when mare is confirmed pregnant at 35 days, whichever comes first. Mare Owner agrees to pay $5.00 per day for dry mares and $7.00 for wet mares.

Mare Owner agrees to give breeder ample opportunity to settle mare. Breeder is not responsible if mare does not settle for any reason. Mare Owner agrees to allow a qualified veterinarian to examine and/or treat the mare and/or foal if necessary. Mare Owner agrees to pay for all veterinary expenses before the mare is released. Mare shall be in a healthy and sound condition, free from infections, contagious, and transmissible diseases. We require a current coggins test and photocopy of registration papers.

This contract contains a “live foal guarantee”. A live foal is described as a newborn foal, which stands and nurses without assistance. If foal is born dead, there are return privileges for the following season only if stallion owner is notified within 5 days and receives a veterinarian’s statement confirming death. If after being pronounced “safe in foal” the mare should miscarry, abort or prove barren, mare owner has the privilege to return for the remainder of the season or return in the following breeding season. Any mares returning the following year will be charged a $200.00 chute fee.

Both parties agree that CC Thoroughbred Farm, its agents and employees are not liable for accident, sickness, or death to above named horses while in the care of the stallion owner. We will exercise the best judgement in care and supervision of mare and/or foal. If mare dies or is sold, stallion owner has the option to accept a substitute mare. If stallion dies or becomes unfit for breeding, then this contract shall become null and void, and the breeding fee, less the booking fee, shall be refunded.

This contract is non-assignable and non-transferable.

When both the stallion owner and mare owner sign this contract it will then be a binding contract subject to the above terms and conditions. This contract is entered into in the state of Wyoming and will be enforced under the laws of Wyoming.
