WAIVER OF CLAIMS, RELEASE OF LIABILITY, INDEMNITY & ASSUMPTION OF RISK AGREEMENT
In consideration of One Stop Family Adventure Center, L.L.C., a Maryland limited liability company, (hereinafter referred to as the “Company”) allowing the below named visitor to participate in recreational activities, including, but not limited to, participation in paintball games, go-carting, and use of inflatable equipment (hereinafter referred to as “recreational activities”)upon the Company’s facilities located at 22630 Gregory Drive, Leonardtown, Maryland 20650 (hereinafter referred to as the “Premises”), and allowing the below named visitor to use any recreational activity equipment, including, but not limited to,paintball guns, paintballs, paintball shields and headgear, go-carts, moon bounces and other inflatables (hereinafter referred to as “recreational activity equipment”) owned or leased by the Company on the Premises, I hereby agree to all of the terms set forth below.
Iacknowledge the substantial risk of injury to person and property arising from participation in recreational activities and further acknowledge that injury and damage can be caused by the negligent acts and omissions of persons and organizations connected with such events. I hereby assume all risks of loss, damage or injury (including death) to my person or property, and to the below named visitor, from any cause whatsoever, whether or not such cause is attributable to the negligence or recklessness of others, including, but not limited to, the conduct of the owners, members, managers, servants, agents, officers, invitees or employees of the Company,the Company’s successors and assigns, the Company’s equipment manufacturers and sponsoring agencies, or any other person or entity.
Ifurther agree to waive all claims against and release from any present or future liability the Company, its successors, assigns, owners, members, managers, servants, agents, officers, invitees and employees. I, on behalf of myself, my personal representatives, executors, administrators and heirs, do expressly hereby waive forever, release, indemnify, hold harmless and forever discharge the Company, its owners, members, managers, servants, agents, officers, inviteesand employeesfrom any and all liabilities, claims, demands, injuries, damages, actions, or courses of action whatsoever arising out of any damage, loss or injury to me, the below named visitor, or our property while upon the Premises in any way arising out of or connected with the recreational activities on the Premises, the use of the recreational activity equipment on the Premises, the use of the Premises, and participation in any of the activities contemplated by this Agreement, whether such loss, damage or injury results from the negligence of the Company,its successors, assigns, owners, members, managers, servants, agents, officers, invitees and employees, the Company’s equipment manufacturers and sponsoring agencies, or any other person or entity,or from acts of active or passive negligence, gross negligence, willful misconduct, recklessness, or other cause on the part of the Company,its owners, members, managers, servants, agents, officers, invitees or employees, the Company’s equipment manufacturers and sponsoring agencies, or any other person or entity. If any clause or provision of this Agreement is illegal, invalid or unenforceable under present or future laws, then, and in that event, the remainder of this Agreement shall not be affected thereby.
I HAVE HAD ADEQUATE TIME TO READ AND HAVE READ THE ABOVE WAIVER OF CLAIMS, RELEASE OF LIABILITY, INDEMNITY & ASSUMPTION OF RISK AGREEMENTAND BY VOLUNTARILY SIGNING IT I AGREE THAT IT IS MY INTENTION TO EXEMPT AND RELIEVEOne Stop Family Adventure Center, L.L.C., its successors, assigns, owners, members, Managers, servants, agents, officers, INVITEES, AND EMPLOYEESFROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE, RECKLESSNESS OR ANY OTHER CAUSE.

If the Visitor is a Minor under the age of eighteen (18) years old, a signature of the Visitor’s Parent or Legal Guardian is required below. By so signing, the Parent/Legal Guardian agrees to the terms set forth above, grants permission for the Minor Visitor to participate in any recreational activity at the Premises and to use the Company’s recreational activity equipment, and waives any and all claims, demands, injuries, damages, actions or causes of action, as set forth above, on behalf of both the Parent/Legal Guardian, the Minor Visitor, their heirs, personal representatives, executors and administrators.
