All documentation showing how LBHF carried out their own research into the claims made in 'Daylight and sunlight report' from Anstey Horne dated February 29 2012 regarding the effect the development in planning application 2011/03262/FUL would have on daylight and direct sunlight to properties on Rowan Road W6 and Latymer Court W6.
3. All documentation showing how LBHF independently determined the effect the development in planning application 2011/03262/FUL would have on daylight and direct sunlight to properties on Rowan Road W6 and Latymer Court W6.

I can confirm that Hammersmith and Fulham holds the information you requested. I am disclosing all the relevant information with regard to points 1, 2, and 3 of your request, with the exception of personal details such as names and contact details of individuals. This information is considered personal data and is exempt from disclosure under s40 of the Act.

I have not included information which is already published via the planning portal on the Council’s website, and this information is exempt from disclosure under s21 of the Act as it is already available by other means.


1. Copies of all documentation showing how LBHF verified the data provided in planning application 2011/03262/FUL in particular with
regard to 'Daylight and sunlight report' from Anstey Horne dated February 29 2012.

The documentation enclosed includes emails between Officers and the Agent (TP Bennett) for the planning application, showing how further information was requested from the agents and the results of the submitted light survey were queried for accuracy and assessed for acceptability. These documents relate to the consideration of the planning application 2011/03262/FUL and the preparation of the report on the proposal for the agenda of the Planning Applications Committee meeting on 25th July 2012. The results of the analysis and Officers' assessment of the submitted daylight and sunlight information are set out in the report to this committee, which is available on the council’s internet pages.

2. All documentation showing how LBHF carried out their own research into the claims made in 'Daylight and sunlight report' from Anstey Horne dated February 29 2012 regarding the effect the development in planning application 2011/03262/FUL would have on daylight and direct sunlight to properties on Rowan Road W6 and Latymer Court W6.

Officers’ research into the claims made in the Anstey Horne report concerning the impact of the proposal on the lighting arrangements to neighbouring property, including the properties you name, is as described in my answer to point 1 above. The process of assessing the information in the submitted Anstey Horne report and the Council's own research i.e. consideration of the claims and information in this report are one and the same matter.

3. All documentation showing how LBHF independently determined the effect the development in planning application 2011/03262/FUL would have on daylight and direct sunlight to properties on Rowan Road W6 and Latymer Court W6.

The Council did not seek independent verification of the results of the submitted daylight and sunlight report; this is not unusual; it is not general practice to seek a further specialist opinion on such matters when the report submitted to Officers has been carried out by chartered surveyors who are specialists in this field, and officers have the ability and experience to properly assess it.

The Council is itself an independent assessor of the information submitted, looking carefully at both the applicant’s submission and any representations from residents and drawing its own judgements and conclusions on the acceptability of the proposal.

The submitted report which assessed the impact of the proposed development on properties in both Rowan Road and Latymer Court to this were analysed by planning Officers and additional information and clarifications were sought from the applicant so that Officers could fully understand the impact of the development upon neighbours’ daylight and sunlight conditions.

The information submitted and officers’ assessment of it had regard to how the scheme would comply with BRE guidelines. The BRE guidelines set out levels of impact upon daylight and sunlight to neighbours which are generally considered to be acceptable; they do not conclude that any impact at all upon daylight and sunlight to neighbours as a result of a development proposal renders such a scheme unacceptable. This is a matter of judgement for planning Officers.

Anstey Home’s report was revised during the consideration of the proposal following substantial revisions to the proposal as originally submitted, including the reduction of the bulk of the building at the rear opposite properties at Latymer Court and on Rowan Road; which arose as officers had concerns about the impact of the building on the amenities of these residents. The further information submitted by the Applicant with regard to impact on neighbours’ lighting conditions following this revision was also scrutinised by officers.

4. Minutes of meetings held, at which LBHF representatives were present, with representatives of a) Haymarket Media Group, b) tp bennetts, c) Anstey Horne with regard to or in which planning application 2011/03262/FUL was discussed..

There were no meetings held at which there were representatives of the Council, Haymarket Media Group, TP Bennett and Anstey Horne present.
