BEREA CITY COUNCIL REGULAR MEETING AUGUST 20, 2013

The Berea City Council met in a regular session; Tuesday, August 20, 2013 at 6:30 p.m., Mayor Connelly presiding. A quorum being present, the meeting was called to order.

MEMBERS PRESENT: Burnside, Kerby, Little, Farmer, Wagers, Powell, Hembree, Terrill

OFFICIALS: Gilbert, Stone, Chasteen, VanWinkle, Fortner, Meeks, Torbeck, Howard, McCay

VISITORS: Seth Littrell, Hubert & Lynetta Chasteen, Robert New, Lezlie Struss, Peter Egerton, Sarah Broomfield, Deborah Payne, Rachel White, Diana Hays

Mayor Connelly called for an amendment to the agenda to move the Water Plant Award, and the East Center Street Overlay, and a presentation to the Police Department as the first items of business. No objections.

WATER PLANT AWARD – ED FORTNER

Utility Department Director, Ed Fortner announced the City of Berea Water Treatment Department operators received the 2013 Medium Sized Water Plant of the Year Award. Operators, Kevin Howard, Jim Rickels, Steve Jones, and Brad Anglin were present and recognized. All of these gentlemen are Class 4 operators. Three awards are given each year to the regional associations of Kentucky and Tennessee.

REVEREND BILL WOODS – KY DEPARTMENT OF FISH & WILDLIFE

Reverend Woods, representing the KY Department of Fish & Wildlife recognized the Berea Police Department for the support they give for the Youth Hunter Education Program.

EAST CENTER OVERLAY – R. STONE

During the past few months the city has worked with the East Center residents on the design for the overlay. At the next city council meeting we will have an ordinance to adopt the overlay which will then become a part of our Land Management Ordinance. Mr. Ned Cranksaw from UK has been our consultant for all our overlay projects within the city. Mayor Connelly requested any feed back regarding this overlay be directed to him or Mr. Stone.

Farmer moved; Kerby seconded to approve the minutes of August 6, 2013. All ayes.

Corporate Counsel read the ordinance by title and summary; Burnside moved, Farmer seconded to adopt Ordinance #16-2013. Roll call vote, all ayes, ordinance adopted.

ORDINANCE #17-2013 – TAX EXEMPT- PITTSBURGH GLASS WORKS – IST READING

Corporate Counsel read the ordinance by title and summary.

MUNICIPAL ORDER #01-2013; A MUNICIPAL ORDER OF THE CITY COUNCIL OF THE CITY OF BEREA, KENTUCKY, AUTHORIZING AND DIRECTING THE CORPORATION COUNSEL TO INITIATE EMINENT DOMAIN PROCEEDINGS TO OBTAIN A PERMANENT RIGHT-OF-WAY EASEMENT AND TWO (2) TEMPORARY CONSTRUCTION EASEMENTS ON AND OVER PROPERTY ON BRATCHER LANE OWNED BY JP MORGAN CHASE NATIONAL ASSOCIATION FOR PUBLIC PURPOSES.

Terrill moved; Farmer seconded to approve Municipal Order #01-2013. All ayes.

MUNICIPAL ORDER #02-2013; A MUNICIPAL ORDER OF THE CITY COUNCIL OF THE CITY OF BEREA, KENTUCKY, AUTHORIZING AND DIRECTING THE CORPORATION COUNSEL TO INITIATE EMINENT DOMAIN PROCEEDINGS TO OBTAIN PROPERTY AT 118 NORTH BROADWAY STREET OWNED BY RICKIE H. HAWLEY, AMANDA HAWLEY, AMY HAWLEY, AND RUBY KRISTINA BAKER, FOR PUBLIC PURPOSES.

Council person Vi Farmer excused herself from the room and from voting on the order due to a personal interest of the property by her son, Jeff Farmer. Terrill moved; Powell seconded to approve Municipal Order #02-2013. Further discussion was held among the council regarding other properties in the area. Roll call vote; Terrill-aye, Hembree-no, Powell-aye, Wagers-aye, Little-no, Kerby-aye, Burnside-no. Order approved.

AUDIT & FINANCE COMMITTEE – V. BURNSIDE

Award of Bid – Mayde Road/595 Bike Path Connector

The Allen Company was the low bidder in the amount of $92, 420.95; Burnside moved; Kerby seconded to accept and award the bid, all ayes.

Award of Bid – Kitchen Equipment for the Folk Center

One bid was received from C-Worth Superstore in the amount of $49,202; Burnside moved; Little seconded to accept and award the bid, all ayes.

CITY ADMINISTRATOR’S REPORT –R. STONE

·  The bid you awarded for the bike-connector path on Mayde Road and 595 will be paid for by the Tourism Budget; we had budgeted $105, 00 for the project, and the bid came in under budget.

·  I encourage everyone to stop by and see the kitchen upgrade we have nearly completed at the Folk Center; the work is to be completed by the Spoon Bread Festival. We will bid out an ice maker for the kitchen also.

·  We received word today that we can begin the Water Street Project; the notice to proceed has been sent out to Ford Contracting. It should be completed in 180 days or less.

·  Southern Madison Water relocation plans are now part of the design and construction plans for the Menelaus Pike Project.

·  The Street Department will be working on three drainage projects during the next two weeks; Hidden Creek, Willow Glen (off Short Line Pike), and Pinnacle Street. Terrill asked about Ridge Avenue; the street department will be replacing the drainage pipe.

·  This week is brush pick-up week and the department has started bush hogging on the west side of town this week.

·  One of the single phase pumps located in the Oaks has failed; we will need to declare an emergency declaration to purchase a new three phase pump to upgrade the well. We expect the expenditure to be $18,000.

·  The Utility Department interviewed three (3) engineering consultants to update Owsley Fork Dam; we have made a decision and presented it to NCRS. This project will help us with creating a design to increase our water storage capacity, and updating the dam; now classified as high hazard.

Questions:

Powell – received a call about an alley way on the west end of Wilson Street that needs to be cleaned and trees trimmed.

Have we received word back regarding the street stripping? Central Seal has been here and looked at the streets we need stripped, they have presented a quote for $5,373.00. They have encouraged us to not make any changes on North Powell at this time, without proper signage it would be very confusing for drivers.

Who determines the fill dirt that is being dumping in specific locations? Mr. VanWinkle addressed the question; the city does have an ordinance requiring

what items can be used for fill. The property owner is required to sign a letter that they will not build on a filled site. The Codes Office has a list of locations that we know has been filled.

COUNCIL COMMENTS:

Terrill - suggested the name of Bob Stewart to fill the vacancy on the Tourism Commission as a restaurant representative.

Wagers – can the city look into adding some parking spaces back on Short Street?
