This agreement is for the purchase of a purebred Miniature or Toy Australian Shepherd puppy as described below. Southern Star is a registered kennel name and will be the first 2 words of the puppy’s name.

A $250 non-refundable deposit is required to HOLD a puppy.

All puppies must be paid for by 7 wks of age or mutually agreeable arrangements made. The eye color and mature size of a puppy cannot be guaranteed, only estimated.

The SELLER will provide up to date health record/information to BUYER at time of transfer along with application for registration, except in the instance of a Co-Own. SELLER guarantees puppy to be healthy and disease free when it leaves Sellers premises. All efforts are made to eliminate internal and external parasites, but puppies are puppies. Buyer has 3 days excluding weekends to have puppy examined by a licensed veterinarian. If above puppy is found to be unhealthy (other than parasites) during this time, buyer is to obtain a written statement. The seller reserves the right to a second opinion from a vet of seller’s choice and expense. If both concur, the Buyer has the option to return the puppy for a full refund. Seller’s liability is limited to the original purchase price of the puppy. If Buyer chooses to keep the puppy, the Buyer will assume all expenses involved with puppy care.

This Basic Guarantee covers all puppies provided they have been checked by a licensed veterinarian as stated above. Puppies do stress and may show signs of diarrhea for a short period of time.

Genetic Defect Guarantee (for puppies purchased w/Breeding Rights) If puppy fails to receive either of the following within the stated period of time as follows:

1.  A certifiable rating from CERF (Canine Eye Registration Foundation) for the first 24 months of life. This certification must be done by a board certified ophthalmologist and seller notified by 25 months.

2.  A “Fair” or better rating on HIPS from OFA (Orthopedic Foundation for Animals). If the rating is less than “FAIR”, I must be notified by the time the pup is 25months of age with documentation of such to follow. If your pet is used in herding, agility, flyball, disc dog, etc.. during this time, this guarantee will be null and void. This heavy activity, even innocent jumping and such can cause hip dysplasia and have nothing to do with genetics. This guarantee is also void if the dog has been bred, mated, or conceived a litter prior to receiving a Hip Rating from OFA and/or notifying seller of unacceptable results.

3.  There are no other guarantees stated or implied.

The Buyer shall have 2 choices when documentation stating negative results from CERF, or OFA is supplied:

·  Buyer may keep the puppy and receive 25% of the purchase price back when a licensed veterinarian provides proof of sterilization. (This % is basically the difference in price between a pet quality pup and that charged for a breeding pup)

·  Pup may be returned to seller at buyers expense and receive a replacement pup of the same sex / quality from a future litter.

Any monetary settlement the Seller’s liability is limited to the original purchase price of the puppy, which excludes shipping, handling, and any medical expenses.

This purchase agreement and/or guarantees are non-transferable. By signing this agreement, Buyer certifies that the puppy will be living with the buyer and will be offered proper socialization, adequate exercise, quality food, and necessary health care. Every effort should be made to provide the puppy with a safe environment. Buyer also agrees that the puppy will not be sold to a pet store, animal research facility, or taken to an animal shelter. In the event Buyer wishes to re-home the puppy, Seller will be notified and has the first right to purchase the puppy back.

We take every precaution we can to ensure you are getting a happy, healthy new companion. SELLER however can make no guarantees regarding accidental death, loss, and/or sickness due to lack of future vaccinations or proper care once the puppy leaves the sellers premises.

Seller reserves the right to refuse a puppy sale to anyone they choose.

Buyer has read, understood, and agreed to enter into this binding agreement with the Seller. Although there are no plans at present to stop breeding these dogs, this Sales Contract will become null and void should the seller cease breeding for any reason. Should there be a dispute regarding this contract, action will be initiated in Smith County, Texas.

In some instances a Breeder has a special pup which they wish to retain an interest in at which point the pup will be sold on a Co-Own basis. New Buyer and Seller will both be listed as Owners of the said animal and registration papers kept in the possession of the Seller. Seller will then have access to exhibiting the animal as well as the Buyer and reserves “X” number of breedings and/or pups back. Health testing will be done prior to breeding.

Details of this Co-Own will be handled on a supplemental agreement between Buyer and Seller.
